No.16833 of 2008\n                             JANARDAN GAUR\n                               Versus\n                           THE STATE OF BIHAR\n                              -----------\n<\/pre>\n<p>3\/   7.7.2008                   Since both the above applications arise out<\/p>\n<p>                   the    one and the same P.S.Case, they have been heard<\/p>\n<p>                   together     and    are    being    disposed       of     by    this   common<\/p>\n<p>                   order.\n<\/p>\n<p>                                According         to    allegation,          Dr.A.P.S.Kamal,<\/p>\n<p>                   father      of    the   informant,        was    called    by    petitioner<\/p>\n<p>                   Md.Jawed     and    thereafter       informant&#8217;s          father   did    not<\/p>\n<p>                   return and it was suspected that he might have been<\/p>\n<p>                   kidnapped.\n<\/p>\n<p>                                In course of investigation, the victim has<\/p>\n<p>                   been recovered and he has given his statement under<\/p>\n<p>                   Section 164 of the Code of Criminal Procedure in which<\/p>\n<p>                   he has stated that petitioner Md.Jawed had asked him to<\/p>\n<p>                   accompany and on his behest, he leaved the house and he<\/p>\n<p>                   was kidnapped and          a demand of Rs.20,00000\/- as ransom<\/p>\n<p>                   was made. The victim was taken away from one place to<\/p>\n<p>                   another but he was lastly rescued by the police.<\/p>\n<p>                                On         behalf       of         petitioner         Md.Jawed<\/p>\n<p>                   (Cr.Misc.No.15040 of 2008), it has been submitted that<\/p>\n<p>                   he was merely used in the offence and there is no<\/p>\n<p>                   allegation of using any force against him.<\/p>\n<p>                                The victim in his statement has described as<\/p>\n<p>                   to how he was called by this petitioner Md.Jawed and as<\/p>\n<p>                   to how he was kidnapped. Considering the allegation, I<\/p>\n<p>                   am    not   inclined      to     grant    bail    to    this    petitioner.<br \/>\n<span class=\"hidden_text\">                            2<\/span><\/p>\n<p>          Accordingly, his prayer for bail is rejected.<\/p>\n<p>                    So    far    another    petitioner    Janardan   Gaur<\/p>\n<p>          (Cr.Misc.No.16833 of 2008) is concerned, he is ordered<\/p>\n<p>          to be released on bail on furnishing             bail bond of<\/p>\n<p>          Rs.10,000\/-(ten thousand) with two sureties of the like<\/p>\n<p>          amount   each   to    the   satisfaction   of   Chief   Judicial<\/p>\n<p>          Magistrate, Bhagalpur in Kotwali P.S.Case No. 695 of<\/p>\n<p>          2007.\n<\/p>\n<\/p>\n<pre>Tahir\/-                         ( Shyam Kishore Sharma, J. )\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Janardan Gaur vs The State Of Bihar on 7 July, 2008 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
