Justice M.SASIDHARAN NAMBIAR\n\n Dated :07\/12\/2010\n\n O R D E R\n            M.SASIDHARAN NAMBIAR,J.\n          ===========================\n          W.P.(C).No. 29262   OF 2010\n          ===========================\n\n    Dated this the 7th day of December,2010\n\n                   JUDGMENT\n<\/pre>\n<p>    Petition is filed under Article 226 of the<\/p>\n<p>Constitution of India for a writ of mandamus<\/p>\n<p>directing  first  respondent  to   entrust  the<\/p>\n<p>investigation    of    Crime    242\/2010     of<\/p>\n<p>Vattiyoorkavu  Police Station   to  a  superior<\/p>\n<p>officer not below the rank of Superintendent of<\/p>\n<p>Police and also for a direction to consider and<\/p>\n<p>pass orders on Ext.P6 representation seeking<\/p>\n<p>fair investigation and action against officers<\/p>\n<p>who are not fairly investigating the case.<\/p>\n<p>Petitioner the accused contended that though he<\/p>\n<p>is  an   accused   the  case   was   originally<\/p>\n<p>registered under section 354 of Indian Penal<\/p>\n<p>Code, based on the statement given by the de<\/p>\n<p>facto complainant and   subsequently an offence<\/p>\n<p>under section 376 of Indian Penal Code was<\/p>\n<p><span class=\"hidden_text\">W.P.(C)29262\/2010             2<\/span><\/p>\n<p>incorporated and the case is not being fairly<\/p>\n<p>investigated.\n<\/p>\n<p>     2.        The  Assistant  Commissioner  of  Police,<\/p>\n<p>Narcotic        Cell,    Thiruvananthapuram  filed    an<\/p>\n<p>affidavit         showing    the   progress    of    the<\/p>\n<p>investigation.\n<\/p>\n<p>     3.          Learned  counsel   appearing  for   the<\/p>\n<p>petitioner       and  learned   Public  Prosecutor  were<\/p>\n<p>heard.\n<\/p>\n<p>     4.     Learned Public Prosecutor made available a<\/p>\n<p>certified copy of the statement of the victim<\/p>\n<p>recorded under section 164 of Code of Criminal<\/p>\n<p>Procedure by the learned Magistrate which discloses<\/p>\n<p>an offence under section 376 of Indian Penal Code.<\/p>\n<p>It    is     also    clear  that   the  case  is   being<\/p>\n<p>investigated properly by the Assistant Commissioner<\/p>\n<p>of Police.\n<\/p>\n<p>     5. In such circumstances, I do not find any<\/p>\n<p>reason to give any direction as sought for.
