Justice K.K.DENESAN\n\n Dated :27\/02\/2007\n\n O R D E R\n                            K.K.DENESAN, J.\n\n                   -----------------------------\n\n                       WP(C)No. 29160 OF 2006\n\n                   -----------------------------\n\n                Dated this the 27th February, 2007.\n\n\n\n                                 JUDGMENT\n<\/pre>\n<p>      The petitioner retired from service on 31.1.2006 while<\/p>\n<p>holding   the   post   of   Subedar   Major.     According   to   him   a<\/p>\n<p>Junior   Commissioned   Officer   of   the   rank   of   Subedar   and<\/p>\n<p>Subedar   Major   can   be   granted   honorary   ranks   of   Lieutenants<\/p>\n<p>and   Captains   on   active   list   on   two   occasions   i.e   on<\/p>\n<p>Republic   day   and   Independence   day   falling   in   the   last   year<\/p>\n<p>of   their   service   by   His   Excellency   the   President   of   India<\/p>\n<p>on   the   basis   of   the   recommendation   of   higher   authorities<\/p>\n<p>based   on   merit   and   after   due     assessment   following   the<\/p>\n<p>procedure  laid   down   in   the   Army   Regulations   as   also   by   the<\/p>\n<p>Army   Headquarters.     The   petitioner   feels   aggrieved   because<\/p>\n<p>he   was   not   considered   for   the   grant   of   honorary   ranks   of<\/p>\n<p>Lieutenants   and   Captains.     He   sought   for   a   direction   in<\/p>\n<p>this   writ   petition   to   the   respondents   to   grant   him   the<\/p>\n<p>honorary rank of Lieutenants and Captains from 26th January<\/p>\n<p>2006 with all the benefits including pay and allowances and<\/p>\n<p>other terminal benefits.\n<\/p>\n<p>      2.    I do not  find any  provision  of law    which confers<\/p>\n<p>any   vested   right   in   the   petitioner   to   say   that   the<\/p>\n<p>respondents   have   got   a   duty   to   confer   such   honorary   ranks<\/p>\n<p>on   any   Subeddar   or   Subedar   Major   in   the   last   year<\/p>\n<p><span class=\"hidden_text\">WPC  29160\/2006                                   2<\/span><\/p>\n<p>immediately   preceding   his   retirement.     The   conferment   of<\/p>\n<p>such   honorary   ranks   is   absolutely   discretionary   and   based<\/p>\n<p>on   assessment   made   by   the   concerned   authorities.     The<\/p>\n<p>petitioner   does   not   appear   to   have   approached   the<\/p>\n<p>authorities   if   he   has   got   a   genuine   grievance   for   the<\/p>\n<p>redressal   of   such   grievance.     It   is   trite   that   a   writ   of<\/p>\n<p>mandamus   will   issue   only   when   a   right   is   vested   in   the<\/p>\n<p>person   who   demands   and   a   duty   is   cast   on   the   respondents<\/p>\n<p>to   consider   such   demand.     Neither   is   present   here.     It   is<\/p>\n<p>also  trite  that  only  when  a  demand  is  made  and  that  demand<\/p>\n<p>is   either   not   considered   or   rejected   the   party   concerned<\/p>\n<p>need   invoke   the   jurisdiction   under   Art.226   of   the<\/p>\n<p>Constitution of India.  That element also is lacking here.\n<\/p>\n<p>       3.
