MOHANAN, J.\n            ----------------------------------------\n          Bail Application No.2300 of 2010\n            -----------------------------------------\n        Dated this the 20th day of April, 2010\n\n                         O R D E R\n<\/pre>\n<p>         This is an application filed under Section 438 of<\/p>\n<p>Cr.P.C. seeking anticipatory bail.\n<\/p>\n<p>     2.   The petitioners apprehend arrest connected with<\/p>\n<p>Crime No.215 of 2010 of Anchalummoodu Police Station in<\/p>\n<p>which offences punishable under Sections 143, 147, 148,<\/p>\n<p>323, 324, 452, 427 &amp; 308 r\/w 149 of I.P.C. are involved.<\/p>\n<p>     3.   The allegation against the petitioners is that on<\/p>\n<p>28.02.2010 at about 3.15 p.m the petitioners attacked the<\/p>\n<p>defacto complainant for the reason that the defacto<\/p>\n<p>complainant had questioned the accused persons regarding<\/p>\n<p>their purchase of cigarette from a super market. As per the<\/p>\n<p>allegation the defacto complainant was inflicted injuries<\/p>\n<p>outside a shop room and there happened some damages to<\/p>\n<p>the shop room.\n<\/p>\n<p>     4.   I have heard learned counsel for the petitioners<\/p>\n<p>and the learned Public Prosecutor.\n<\/p>\n<p>B.A.No. 2300 of 2010<br \/>\n<span class=\"hidden_text\">                                 -:2:-<\/span><\/p>\n<p>      5.    Having regard to the facts and circumstances<\/p>\n<p>involved in the case, especially the gravity of the offences<\/p>\n<p>involved and the allegations, I am not inclined to grant<\/p>\n<p>anticipatory bail to the petitioners as the same will adversely<\/p>\n<p>affect the investigation in the above crime which is now in<\/p>\n<p>progress. Considering the grievous nature of the injuries<\/p>\n<p>sustained by the victim and the weapons used to inflict such<\/p>\n<p>injuries, it is not proper for this Court to grant anticipatory<\/p>\n<p>bail in favour of the petitioners at this stage.<\/p>\n<p>      In the result, I find no reason to grant anticipatory bail<\/p>\n<p>to the petitioners by exercising the extra ordinary<\/p>\n<p>jurisdiction of this Court under Section 438 of Cr.P.C.<\/p>\n<p>Therefore, there is no merit in this petition and accordingly,<\/p>\n<p>the same is dismissed.\n<\/p>\n<\/p>\n<p>                                          V.K.MOHANAN<br \/>\n                                               JUDGE<\/p>\n<p>rtr\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Abhilash vs State Of Kerala on 20 April, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 2300 of 2010() 1.
