RAVAL, ASST.\nGOVERNMENT PLEADER for Respondent(s) : 1, \nNone for Respondent(s) :\n2 - 3. \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE S.R.BRAHMBHATT\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 19\/10\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tOn<br \/>\n10.10.2011, the Court has passed the following order:\n<\/p>\n<p>\t&#8220;Shri<br \/>\nB.P.Munshi, learned advocate appearing for the petitioner in the main<br \/>\npetition as well as in Civil Application submits that the petitioner<br \/>\nis in fact desirous to withdrawing this petition and he would be<br \/>\nwithdrawing.  However, if the matter is adjourned for a period of one<br \/>\nweek, in the mean time the petitioner is attempting to persuade the<br \/>\nconcerned authorities so that he can avoid stigma on account of<br \/>\nremoval from the office.\n<\/p>\n<p>\tThe<br \/>\narguments are over.  This request was made when the Court was not<br \/>\ninclined to entertain the petition.  At the request of Shri Munishi,<br \/>\nthe matter is kept on 17.10.2011.&#8221;\n<\/p>\n<p>1.1\tToday, it was<br \/>\nspecifically mentioned on behalf of State for taking up the matter,<br \/>\nas it was originally adjourned only for withdrawal of the same, but<br \/>\nwhen the matter is called out, none is present for the petitioner.<br \/>\nThe Court is of the view that the matter is heard fully and<br \/>\ntherefore, it is required to be disposed of properly.\n<\/p>\n<p>2.\tThe petitioner, by<br \/>\nway of this petition under Article 226 and also under Article 227 of<br \/>\nthe Constitution of India approach this Court with following prayers:\n<\/p>\n<p>\tThis Hon&#8217;ble Court<br \/>\n\twould be pleased to issue writ of certiorari or any other<br \/>\n\tappropriate writ, order or direction in the nature of certiorari, or<br \/>\n\tany other appropriate writ, order or direction and thereby would be<br \/>\n\tpleased to quash and set aside the order dated 21\/01\/2011 passed by<br \/>\n\tthe respondent No.2 herein above (at Annexure &#8220;C&#8221; to the<br \/>\n\tpetition) and be pleased to quash and set aside the order dated<br \/>\n\t20\/09\/2011 passed by the respondent No.3 herein above, (at Annexure<br \/>\n\t&#8220;E&#8221; to the petition) and be pleased to direct the<br \/>\n\trespondents herein above, to permit the petitioner to continue to<br \/>\n\thold the office as Sarpanch of the Motibhojpur Gram Panchayat till<br \/>\n\tthe expiry of the terms of his office on 14\/01\/2012, in the interest<br \/>\n\tof justice.\n<\/p>\n<p>\tPending admission and<br \/>\n\ttill final disposal of present petition this Hon&#8217;ble Court would be<br \/>\n\tpleased to stay the execution, implementation and operation of the<br \/>\n\timpugned order dated 21\/01\/2011 passed by the respondent No.2<br \/>\n\thereinabove (at Annexure &#8220;C&#8221;to the petition) and thereby<br \/>\n\tto stay the execution, implementation and operation of the impugned<br \/>\n\torder dated 20\/09\/2011 passed by the respondent No.3 hereinabove (at<br \/>\n\tAnnexure &#8220;E&#8221; to the petition), in the interest of<br \/>\n\tjustice and equity.\n<\/p>\n<p>\tThis Hon&#8217;ble Court<br \/>\n\twould be pleased to award the costs of present petition.\n<\/p>\n<p>\tThis Hon&#8217;ble Court<br \/>\n\twould be pleased to grant such other and further relief\/s as may be<br \/>\n\tdeemed fit, just and proper in the facts and circumstances of the<br \/>\n\tcase, in the interest of justice.\n<\/p>\n<p>2.1\tThus, essentially<br \/>\nthe petition is filed challenging the order passed for removing the<br \/>\npetitioner as Sarpanch by respondent No.2 and that order is confirmed<br \/>\nby respondent No.3 in appeal proceedings.\n<\/p>\n<p>2.2\tFacts, as narrated<br \/>\nby the petitioner in the memo of the petition indicate that<br \/>\npetitioner was elected as Sarpanch of Motibhojpur Gram Panchayat.\n<\/p>\n<p>3.\tAt<br \/>\nthis stage, Shri Mankad, who now appears in place of original<br \/>\nadvocate for the petitioner has submitted that the draft amendment be<br \/>\npermitted to place on record. The same is taken on record and is<br \/>\nallowed and is ordered to be carried out.\n<\/p>\n<p>3.1\tMr.Mankad<br \/>\nhas submitted that the withdrawal was with a view to avoid stigma,<br \/>\nbut as the removal order is received on 07.10.2011 of which the<br \/>\npetitioner was not aware, therefore on 10.10.2011 it was submitted<br \/>\nbefore this Court that the petitioner is desirous to withdraw the<br \/>\npetition and persuade the authority for avoiding stigma. Hence, the<br \/>\nCourt may pass appropriate order on the submission canvassed.\n<\/p>\n<p>3.2\tThe<br \/>\npetitioner received show-cause notice on 21.04.2009 as to why action<br \/>\nagainst him may not be taken for removing him from service as per the<br \/>\nGujarat Panchayats Act (herein after referred to as &#8216;the Panchayats<br \/>\nAct&#8217;) for the misconduct enumerated thereunder.  Mr.Mankad has<br \/>\nsubmitted that he is not aware of the show-cause notice and it is not<br \/>\non record of this petition or in his reply, be that as it may.\n<\/p>\n<p>3.3\tIt<br \/>\nseems that show-cause notice ultimately converted in the order of<br \/>\nremoval  dated 21.01.2011.  Said order of removal was assailed by the<br \/>\npetitioner by filing appeal u\/s. 57 (3) of the Panchayats Act before<br \/>\nthe Additional Development Commissioner who concurred the findings<br \/>\nrecord by the District Development Officer, rejected the appeal vide<br \/>\nits order dated 20.09.2011. Hence, this petition.\n<\/p>\n<p>3.4\tThe<br \/>\nlearned advocate for the petitioner invited this Court&#8217;s attention to<br \/>\nthe allegations made in the show-cause notice, on which the<br \/>\npetitioner call upon to answer and submitted that infact the sale of<br \/>\nthe property in question had been concluded longback and it was only<br \/>\nthe execution of the sale deed by the present petitioner which could<br \/>\nhave been found to be objectionable by the concerned authorities.<br \/>\nThe said action of the petitioner could not have been in any manner<br \/>\npermitted to be a misconduct so as to arrive about the drastic step<br \/>\nof removal of an elected representative of people.\n<\/p>\n<p>3.5\tThe<br \/>\npetitioner&#8217;s advocate further contended that the movement it served<br \/>\non the petitioner that it was a mistake on the part in executing the<br \/>\ndocuments, he take all the steps in ailing the same and therefore<br \/>\nthere exists no loss on the part of the Panchayat and hence entire<br \/>\nexercise of show-cause notice and order of removal is not at all<br \/>\nnecessary. The land which is alleged to be wrongfully alienated was<br \/>\ninfact received by the Panchayat as gift and it would fall under the<br \/>\nprovisions of old Section 98 requiring any permission.  This<br \/>\ncontention is not raised before the authority, but it is raised<br \/>\nbefore this Court.  The person in whose favour the execution was<br \/>\nmade,  has given affidavit of unailing of land.\n<\/p>\n<p>3.6\tMearly<br \/>\nthe amount of Rs.600\/- is taken by the earlier member of Panchayat,<br \/>\nno misconduct is done by the existing Sarpanch. No action was taken<br \/>\nagainst Panchayat from 1971 till 2007. Therefore, petitioner<br \/>\nembodiment to alienate the land in favour of the person, who passed<br \/>\naway back in the year 1971.\n<\/p>\n<p>4.\tThis<br \/>\nCourt is of the considered view that plain reading of Section 57(1)<br \/>\nwould persuaded this Court to hold that the Panchayat and Sarpanch&#8217;s<br \/>\naction are viewed as possibility of indulging in corrupt practice is<br \/>\nabsolutely hasting and hence the conduct of the present petitioner is<br \/>\nrequired to be seen from  that angle only.\n<\/p>\n<p>4.1\tThe<br \/>\npetitioner has failed in establishing as to how and in what<br \/>\ncircumstances it occurred to him for obliging the person who had paid<br \/>\nalleged consideration in the year 1971 by executing the documents in<br \/>\nthe year 2009. The petitioner &#8211; Sarpanch was not prevented from<br \/>\nanyone from seeking appropriate approval from competent authority.<br \/>\nThe very factum that in the year 1971 alleged sale deed is sought to<br \/>\nbe executed and given legal form in the year 2009 wihout their being<br \/>\nany provisional order from any Court, which speaks volume about the<br \/>\npetitioner&#8217;s tendency.  The petitioner has shown tendency of dealing<br \/>\nwith public funds and public property which cannot be overlooked by<br \/>\nany Court of law.\n<\/p>\n<p>4.2\tThis<br \/>\npetition being hopelessly bereft of merits, deserves rejection and it<br \/>\nis rejected. The rejection is with cost and cost is quantify at<br \/>\nRs.5000\/- to be deposited in the High Court Legal Services Committee.<br \/>\nMatter is disposed of, accordingly.
