Justice S.SIRI JAGAN\n\n Dated :11\/02\/2011\n\n O R D E R\n                            S.SIRI JAGAN, J.\n\n                ----------------------------------------------\n\n                    W.P(C).No.11410 of 2008\n\n                ----------------------------------------------\n\n            Dated this the 11th day of February, 2011\n\n                               JUDGMENT\n<\/pre>\n<p>      Petitioner was a member of the Kerala High Court Service. His<\/p>\n<p>original date of retirement on attaining the age of 55 years as per<\/p>\n<p>the original rule was 31.7.2007. But the Chief Justice of the Kerala<\/p>\n<p>High Court, invoking his powers vested in him, framed revised rules<\/p>\n<p>as per which the retirement age was enhanced to 58 years. Validity<\/p>\n<p>of that rule was upheld in the decision reported in Valsakumari v<\/p>\n<p>State of Kerala (2007(3) KLT 805). Subsequently, the Government<\/p>\n<p>of Kerala issued Ordinance No.61\/07, by which retirement age was<\/p>\n<p>retrospectively reduced as 55 years. Subsequently, all persons who<\/p>\n<p>had crossed the age of 55 years including the petitioner, who was<\/p>\n<p>also continuing by virtue of the rules fixing the retirement age as 58<\/p>\n<p>years, were retired on 22.10.2007. The petitioner now contends that<\/p>\n<p>in view of the retrospective amendment of the rules, two Deputy<\/p>\n<p>Registrars in service would have notionally retired on 31.5.2007 and<\/p>\n<p>30.6.2007, as a result of which there would have been two<\/p>\n<p>vacancies of Deputy Registrars arising on 1.6.2007 and 1.7.2007.<\/p>\n<p>But, because of the intervening amendment of the rules, those<\/p>\n<p>WP(C) No.11410\/08\n<\/p>\n<p>                                 &#8211; 2 &#8211;\n<\/p>\n<p>vacancies did not physically arise and the petitioner had to retire<\/p>\n<p>without getting the promotion as Deputy Registrar which was<\/p>\n<p>notionally due to the petitioner on account of the retrospective<\/p>\n<p>Ordinance.    Therefore, the petitioner is entitled to have his<\/p>\n<p>retirement benefits calculated in the scale of pay applicable to<\/p>\n<p>Deputy Registrar, is the contention raised by the petitioner in this<\/p>\n<p>Writ Petition.\n<\/p>\n<p>      2. Learned counsel for the first respondent would contend that<\/p>\n<p>without actually a vacancy arising on 1.6.2007 and 1.7.2007 and<\/p>\n<p>without a declaration that the rule framed by the Chief Justice was<\/p>\n<p>unsustainable, it cannot be stated that the petitioner is entitled to<\/p>\n<p>promotion to any vacancy which did not physically arise. Therefore,<\/p>\n<p>the petitioner is not entitled to any notional retrospective<\/p>\n<p>promotion, is the contention raised.\n<\/p>\n<p>      3. I have considered the rival contentions in detail. I am of<\/p>\n<p>opinion that insofar as no vacancy legally arose on 1.6.2007 and<\/p>\n<p>1.7.2007, the petitioner cannot aspire for promotion to the post of<\/p>\n<p>Deputy Registrar with effect from any date whatsoever. Till the date<\/p>\n<p>of retirement of the petitioner there was no vacancy of Deputy<\/p>\n<p>Registrar, to which the petitioner could have aspired for promotion.<\/p>\n<p>The raising of the retirement age to 58 years and lowering of the<\/p>\n<p>same subsequently by the State by a legislative declaration all were<\/p>\n<p>made legally. Of course, if the raising of retirement age was not<\/p>\n<p>WP(C) No.11410\/08\n<\/p>\n<p>                                &#8211; 3 &#8211;\n<\/p>\n<p>there, perhaps the petitioner would have been eligible for<\/p>\n<p>promotion, but that is not a reason to say that there was actually a<\/p>\n<p>vacancy on 1.6.2007 or 1.6.2007 even notionally so as to enable the<\/p>\n<p>petitioner to claim promotion to one of those vacancies. Such<\/p>\n<p>lowering of the retirement age will have effect only on the<\/p>\n<p>retirement benefits of those who continued beyond the age of 55<\/p>\n<p>years till the Ordinance came into force and not for any other<\/p>\n<p>purpose. In this connection I note that even when the retirement<\/p>\n<p>age was 55 years, the Chief Justice had powers to extend the period<\/p>\n<p>of service of particular employees after complying with the<\/p>\n<p>procedure prescribed.
