This writ petition has been filed by the<\/p>\n<p>                   petitioner for a direction to the respondents to implement<\/p>\n<p>                   Circular No.5633(Ga) dated 17.07.2008 as well as their letter<\/p>\n<p>                   no.48 dated 06.01.2009 issued by Superintending Engineer,<\/p>\n<p>                   Building Construction Circle, Chapra and to pay entire dues of<\/p>\n<p>                   petitioner as per the revised rates for the execution of works as<\/p>\n<p>                   well as for the ongoing works of construction as per the<\/p>\n<p>                   agreement between the parties for the year 2007-08.<br \/>\n<span class=\"hidden_text\">                                -2-<\/span><\/p>\n<p>                      3. Considering the averments made by learned<\/p>\n<p>         counsel for the parties as well as the materials on record, it is<\/p>\n<p>         quite apparent that the petitioner wants payment at revised rate<\/p>\n<p>         from the respondents for the works done by him as per the<\/p>\n<p>         agreement. In the said circumstances, this writ petition is<\/p>\n<p>         disposed of with a liberty to the petitioner to file an application<\/p>\n<p>         before the Superintending Engineer, Building Construction<\/p>\n<p>         Circle, Chapra (respondent no.2) raising all his grievances<\/p>\n<p>         which he had raised before this court. If such an application is<\/p>\n<p>         filed by the petitioner within 15 days from today along with a<\/p>\n<p>         copy of this order, the said authority shall consider the matter<\/p>\n<p>         in accordance with prescribed rules and resolutions and shall<\/p>\n<p>         decide it expeditiously preferably within a period of two<\/p>\n<p>         months. If such an amount is found payable, the said authority<\/p>\n<p>         shall pay the same to the petitioner immediately thereafter.<\/p>\n<p>         However, if any amount is not found payable, a speaking order<\/p>\n<p>         must be passed by the said authority so that the petitioner may<\/p>\n<p>         challenge the same before the appropriate forum.<\/p>\n<pre>Harish                                       (S.N.
