Justice M.SASIDHARAN NAMBIAR\n\n Dated :30\/09\/2010\n\n O R D E R\n             M.Sasidharan Nambiar, J.\n            --------------------------\n             W.P.(C)No.27969 of 2010 Q\n            --------------------------\n\n                     JUDGMENT\n<\/pre>\n<p>    Petitioner, the mother of the second accused in<\/p>\n<p>C.C.No.221\/2010 on the file of Judicial First Class<\/p>\n<p>Magistrate&#8217;s Court-II, Aluva, filed this petition<\/p>\n<p>under Article 226 of Constitution of India for a<\/p>\n<p>writ of mandamus directing respondents 1 to 3 to<\/p>\n<p>take necessary steps to produce the accused for<\/p>\n<p>trial and for a direction to the learned Magistrate<\/p>\n<p>to dispose the case within a time frame alleging<\/p>\n<p>that case could not be disposed for the failure to<\/p>\n<p>produce the accused.\n<\/p>\n<p>    2. A report was called for from Judicial First<\/p>\n<p>Class  Magistrate-II,  Aluva.  The  report  of  the<\/p>\n<p>learned Magistrate shows that accused were remanded<\/p>\n<p>to judicial custody and though the case was posted<\/p>\n<p>on 28.8.2010, the accused were not produced and<\/p>\n<p>therefore, a memo was issued to the Superintendent,<\/p>\n<p>Sub Jail, Ernakulam to produce the accused after<\/p>\n<p><span class=\"hidden_text\">WPC 27969\/10              2<\/span><\/p>\n<p>extending the period of remand for six days. On<\/p>\n<p>3.9.2010 also, accused were not produced and the<\/p>\n<p>Superintendent informed that there were not lodged<\/p>\n<p>in that jail and as the accused were shifted to<\/p>\n<p>Central Prison, Viyyur, a direction was issued to<\/p>\n<p>the   Superintendent,  Central  Prison,  Viyyur  to<\/p>\n<p>produce the accused on 16.9.2010. But the accused<\/p>\n<p>were not produced on the ground that woman police<\/p>\n<p>escort was not made available and the case now<\/p>\n<p>stands    posted  to 30.9.2010. Learned  Magistrate<\/p>\n<p>stated that charge could not be framed as the<\/p>\n<p>accused were not produced and the case could be<\/p>\n<p>disposed within a time frame of three months.<\/p>\n<p>     3.    Learned Additional Director  General  of<\/p>\n<p>Prosecutions submitted that instructions will be<\/p>\n<p>issued to produce the accused on all posting dates<\/p>\n<p>before the Magistrate without fail and directions<\/p>\n<p>would be issued to arrange necessary escort.<\/p>\n<p>     Petition is disposed directing Judicial First<\/p>\n<p>Class    Magistrate-II, Aluva  to  dispose  C.C.No.<\/p>\n<p><span class=\"hidden_text\">WPC 27969\/10             3<\/span><\/p>\n<p>221\/2010 as expeditiously as possible, at any rate,<\/p>\n<p>within three months from the date of receipt of a<\/p>\n<p>copy of this judgment.
