Respondents\n\n\n\n\tWrit Petition filed under Article 226 of the Constitution praying to issue\na Writ of Mandamus directing the   respondents herein particularly the 4th\nrespondent herein to permit the petitioner herein to participate in the\ncounselling on 20.7.2o06 for admission to the B.E.\/B.Tech(Vocational) Course for\nthe academic year 2006-2007 conducted by the Tamil Nadu Engineering Admissions\n2006.\n\n\n!For petitioner\t \t...\tMr. K.Elangovan\n\n\n^For respondents \t...\tMr. D.Rajendran\n\n\n:ORDER\n<\/pre>\n<p>\tMr. P.Thilak Kumar is directed to take notice on behalf of Mr.<br \/>\nD.Rajendran, learned counsel for the Anna University.\n<\/p>\n<p>\t2. By consent, the Writ Petition is taken up for disposal.\n<\/p>\n<p>\t3. Admittedly, in this case, the petitioner  belongs to SC community and<br \/>\ngot cut off mark and was sent a call  letter for counselling to appear before<br \/>\nthe fourth respondent on 19.7.2006 @ 11.00a.m.   However, according to the<br \/>\npetitioner, the said call letter was received by him on 19.7.2006 at 1.00p.m. as<br \/>\nit is evidenced by the certificate issued by the postal authorities.\n<\/p>\n<p>\t4. In view of the said delay delivery, the petitioner could not attend<br \/>\ncounselling on the said date.  However, as per a clause in the intimation<br \/>\nletter, if a candidate could not attend the counselling on the specified date<br \/>\nand time, he\/she can attend on a subsequent date\/time, during the counselling<br \/>\nperiod.  But, the candidate can only opt for the seats available at that time<br \/>\nand cannot claim any seat as per original rank.\n<\/p>\n<p>\t5. By virtue of the said clause, which is available in the call letter, as<br \/>\nadmitted by the learned counsel for the University and subject to the conditions<br \/>\ncontained therein, there is absolutely no reason to deny the said benefit to the<br \/>\npetitioner.  In view of the same, the petitioner is permitted to attend the<br \/>\ncounselling before the fourth respondent on 20.7.2006 before 4.00p.m.\n<\/p>\n<p>\t6. Since according to the learned counsel for the petitioner, for<br \/>\nvocational course, which the petitioner has chosen, 4.00p.m. of today is the<br \/>\nlast date, the fourth respondent is directed to permit the petitioner to<br \/>\nparticipate in the Counselling today i.e. on 20.7.2006 before 4.00p.m.<br \/>\nAccordingly, the Writ Petition stands allowed.  No costs.
