Papers are received from the Registry.\n<\/p>\n<p>1.1.\tLeave<br \/>\nto amend.\n<\/p>\n<p>2.\tHeard<br \/>\nlearned advocate Champaneri for the petitioner. The learned advocate<br \/>\nfor the petitioner submitted that during the pendency of Lavad Case<br \/>\nNo.817 of 2008, the Board of Nominees vacated the interim relief<br \/>\ngranted at the time of filing of the suit after two years after<br \/>\nbi-parte hearing.\n<\/p>\n<p>2.1.\t\tAgainst<br \/>\nthat order of the Board of Nominees, the petitioner approached the<br \/>\nGujarat State Co-operative Tribunal by filing Revision Application<br \/>\nNo.56 of 2010 in Lavad Case No.817 of 2008. Exh. 5 and the Revision<br \/>\nApplication No.56 of 2010 are rejected by the Hon&#8217;ble Tribunal by<br \/>\norder dated 30.11.2010. It is against this order that the petitioner<br \/>\nis before this Court.\n<\/p>\n<p>3.\tThe<br \/>\nlearned advocate for the petitioner submitted that the Hon&#8217;ble<br \/>\nTribunal has given undue importance to the fact that the petitioner<br \/>\nis not able to produce the certificate of regularisation of<br \/>\nconstruction put up by the petitioner by AUDA, though the petitioner<br \/>\nhad produced a receipt showing  payment of Impact Fee by him.\n<\/p>\n<p>3.1.\t\tBesides,<br \/>\nthe learned advocate for the petitioner submitted that the<br \/>\nconstruction put up by the petitioner is of the nature which is<br \/>\npermissible and the only irregularity is that the petitioner did not<br \/>\nobtain permission at the time of putting up the construction but,<br \/>\nlater on,  after making payment of impact fee, the construction<br \/>\nstands regularised.\n<\/p>\n<p>4.\t\tBesides,<br \/>\nthe learned advocate for the petitioner submitted that as the Lavad<br \/>\nCase No.817 of 2008 is pending before the Board of Nominees, and for<br \/>\nall this time, the injunction granted against demolition was<br \/>\noperative, which is vacated by the Board of Nominees by bi-parte<br \/>\nhearing, against which a revision was filed and the stay application<br \/>\nis rejected, the interest of justice would be served if the Board of<br \/>\nNominees is directed to hear and decide the Lavad Case No.817 of 2008<br \/>\nin a time frame and in the meantime, the authorities be directed to<br \/>\nmaintain the status-quo qua the construction in question.\n<\/p>\n<p>4.1.\t\tThe<br \/>\nlearned advocate for the petitioner submitted that it will be in the<br \/>\ninterest of justice to order the authorities to maintain the<br \/>\nstatus-quo qua the construction in question because the construction<br \/>\nis not in the nature of any encroachment or obstruction to even<br \/>\nneighbouring properties. The only irregularity is that the petitioner<br \/>\ndid not obtain prior permission for putting up the construction and<br \/>\nit is for that, the petitioner already stands punished by way of<br \/>\npayment of impact fee.\n<\/p>\n<p>5.\tNOTICE<br \/>\nreturnable on 21st<br \/>\nDecember 2010.
