SINGH, JUDGE    \nDate : 04\/12\/2008\n:J U D G M E N T: \n<\/pre>\n<p>Petitioner has filed this writ petition questioning<br \/>\nIndian Oil Corporation Limited&#8217;s communication no.<br \/>\nJMDO\/LOI\/ICHGAM dated 14.07.2008, offering award of<br \/>\nRetail Outlet Kissan Seva Kendra Dealership at village<br \/>\nIchgam District Budgam, Jammu and Kashmir, to Manzoor<br \/>\nAhmed Wani-respondent no. 5, besides seeking a direction to<br \/>\nthe Corporation to reconsider his case for awarding the<br \/>\nRetail Outlet Dealership to him.\n<\/p>\n<p><span class=\"hidden_text\">2<\/span><\/p>\n<p>According to the petitioner, the Corporation had acted<br \/>\narbitrarily violating Article 14 of the Constitution of India in<br \/>\nomitting to provide opportunity of hearing to the petitioner<br \/>\nbefore awarding Retail Outlet Dealership at village Ichgam<br \/>\nto respondent no. 5 when he had been shown at S. No. 1 in<br \/>\nthe merit panel of the candidates who had sought award of<br \/>\nRetail Outlet Dealership in their favour.<br \/>\nRespondent-Corporation and Manzoor Ahmed Wanirespondent<br \/>\nno. 5 have indicated in their separate objections<br \/>\nthat the petitioner has no locus standi to question the<br \/>\nimpugned communication as he was ineligible to compete<br \/>\nbecause of his not fulfilling one of the necessary conditions<br \/>\nrequired for award of Retail Outlet Dealership, i.e., of<br \/>\npossessing land at village Ichgam, the notified place which<br \/>\nhad been earmarked by the Corporation for setting up of a<br \/>\nRetail Outlet.\n<\/p>\n<p>The parties were not at variance as to the place where<br \/>\nthe Retail Outlet had to be set up by the Corporation. The<br \/>\nplace notified by the Corporation for setting up the Retail<br \/>\nOutlet, as admitted by learned counsel for the parties at the<br \/>\ntime of hearing of the petition, is village Ichgam in District<br \/>\nBudgam of Kashmir Province.\n<\/p>\n<p>Petitioner&#8217;s learned counsel, Mr. K. L. Pandita, when<br \/>\nconfronted with the objections of the respondents that the<br \/>\npetitioner did not possess any land at the notified place,<br \/>\n<span class=\"hidden_text\">3<\/span><br \/>\ncandidly admitted that the land which the petitioner had<br \/>\noffered to set up the Retail Outlet pursuant to the issuance<br \/>\nof Advertisement notice, was located at village Zooribagh.<br \/>\nLearned counsel, however, submitted that having been<br \/>\nplaced at S. no. 1 of the merit panel, petitioner was entitled<br \/>\nto be heard in the matter before someone else could be<br \/>\nconsidered for allotment of Retail Outlet Dealership at<br \/>\nvillage Ichgam.\n<\/p>\n<p>I do not find any substance in petitioner&#8217;s counsel&#8217;s<br \/>\nsubmission, in that, having failed to offer land for setting up<br \/>\nof Retail Outlet at the notified place, i.e., village Ichgam, the<br \/>\npetitioner would have no locus standi to question the<br \/>\nallotment of Dealership to the person who had offered land<br \/>\nat village Ichgam for setting up of Retail Outlet. Placement<br \/>\nof petitioner at S. No. 1 in the merit panel, would not cure<br \/>\nhis basic ineligibility to compete for securing Retail Outlet<br \/>\nDealership at village Ichgam.\n<\/p>\n<p>Possessing no land in village Ichgam, the place notified<br \/>\nby the Indian Oil Corporation for setting up a Retail Outlet<br \/>\n(KSK), the petitioner was thus ineligible to compete for the<br \/>\nDealership and hence disentitled to seek consideration for<br \/>\naward of the Retail Outlet. His ineligibility, thus, disables<br \/>\nhim to maintain this writ petition to question the award of<br \/>\nRetail Outlet Dealership to Manzoor Ahmed Wanirespondent<br \/>\nno. 5.\n<\/p>\n<p><span class=\"hidden_text\">4<\/span><\/p>\n<p>This writ petition, therefore, lacks merit. It is,<br \/>\naccordingly, dismissed without any order as to costs.<br \/>\n(J. P.
