Hoskote \u00a5 Bangalore road near checkpost, Kattamnellur<\/p>\n
"ll  a lorry bearing registration No. HR~\u00ab38–4l6 came<\/p>\n
l\u00e9from behind in a rash and negligent manner and<\/p>\n
dashed against his scooter, as a result he fell down and<\/p>\n

sustained grievous injuries. Hence, he filed a claim
\npetition before MACT, Bangalore seeking compensation<\/p>\n
of Rs.10_00,000\/– and the Tribunal has fawarded<\/p>\n
compensation of Rs.1,16,600\/- with interest' at  <\/p>\n

5. ”  learned Counsel appearing for
\nthe partjiesjgandj judgment and award of the<\/p>\n
Tribunal all V.,Vgrr1 of’  View that the compensation<\/p>\n
  thevvillriibunal is not just and reasonable, it<\/p>\n
 _is__ lower side and therefore it is deserved to be<\/p>\n
enhanCe.d}’ A<\/p>\n
 _  it  claimant has sustained the following injuries:<\/p>\n
i) Fracture of clavicle:\n<\/p>\n
ii] Fracture of \ufb01bula;\n<\/p>\n
3?.\n<\/p>\n
iii] Fracture of 531 metatarsal, dislocation;<\/p>\n
Injuries sustained by him are evident from ‘wound<\/p>\n
certi\ufb01cate, discharge summary, case sheet,_;K”rays_\u00a5’ <\/p>\n
supported by oral evidence of the  <\/p>\n
doctor examined as PWS  and?  1 .resp’ectively.<\/p>\n
Immediately after the acci-ilpent he was    2<\/p>\n
GGV\u20ac1″I’llT1Q~f1t Hospital and  .aid_:treatment he
\nwas shifted to  where he
\nwas treated as inpa.tie’nt,:’foVr’   Operation was
\nconducted’    treatment after
\ndisch.a’rge,’p”~..f”‘\u00a35W:   has stated that
\nclaiIn–ant inpatient in Bowring Hospital
\nwound   suturing was done, claimant<\/p>\n
 got VVdeforri1ity_,.of right clavicle, restriction of right<\/p>\n
‘  shoulder_’moveme’nts and restriction of movement of left<\/p>\n
ll tanirleifpl:-l’eV..assessed 15% disability to right upper limb,<\/p>\n
28″\/\u00e9clltio the left lower limb and 19% to the whole body.<\/p>\n
 his cross examination he admitted that even if<\/p>\n
 clavicle bone fracture is united in a mal position, it does<\/p>\n
not cause functional disability if there is no restriction<\/p>\n
$35<\/p>\n
of movement in left shoulder joint. He further admitted<\/p>\n
that fracture was in the middle of the clavicle bone_._<\/p>\n
7. Considering the nature of injuries <\/p>\n
awarded by the Tribunal towards pain  <\/p>\n
on the lower side and it is deserv\u00e9dtito the’:<\/p>\n
another sum of Rs.lO,0OVf\u00a7_\/~\u00bb__Vandr-I, <\/p>\n
under this head.\n<\/p>\n
8. The claimant  medical bills.\n<\/p>\n
Considering  was  ..in\ufb01:atient in Bowring
\nHospital   V  l   Rs. 1 O, 000\/ ~ towards
\n as against Rs.5,000\/~<\/p>\n
awarded by the <\/p>\n
 3’_:Cehside”ri\u00abng__i.’vthe year of accident. age of the<\/p>\n
d  his occupation the Tribunai has rightly<\/p>\n
dd  income of the claimant at Rs.3,000\/- p.rrs..<\/p>\n
Nat1;.re’of injuries suggests that he was under treatment<\/p>\n
 V.  rest at least for a period of four months and I<\/p>\n
 award Rs.12,()0O\/– towards loss of income during laid<\/p>\n

Tribunal.\n<\/p>\n
10. Considering the nature of injuries and_;_.ofA _<\/p>\n

11. Claimant is agled\ufb01 abotiltlg’l”l*h’e”rnultip1ier
\napplicable to his age   doctor has
\nassessed   limb and 28%
\nto left  whole body. Hence<\/p>\n
tota1:.;ldisabilii;y  t_hei2lvlhole body is assessed at<\/p>\n
13%  ”   “assessed by the Tribunal.<\/p>\n
Accordingly ..,l”los’s loflwlfuture income works out to<\/p>\n
  [I7{sv.\u00e9l,l(l)OO\/~ X 13% X 12 x 17) and it is<\/p>\n
 awarded against Rs.57,600\/– awarded by the<\/p>\n
Tribunal;\n<\/p>\n
  Thus the claimant is entitled for the following<\/p>\n
 Compensation:\n<\/p>\n

 interest is ordered to be invested in ED. in the name of<\/p>\n
