Justice ANTONY DOMINIC\n\n Dated :29\/02\/2008\n\n O R D E R\n                           ANTONY  DOMINIC, J.\n\n                           =======================\n\n                             W.P.(C) No.7080  of 2008 (P)\n\n                           =======================\n\n\n                    Dated this the   29th  day of February, 2008\n\n\n\n\n                                   JUDGMENT\n<\/pre>\n<p>       The   writ   petition   is   filed   by   the   petitioners   who   are<\/p>\n<p>defaulters to the respondent Bank.  It is seen that following   the<\/p>\n<p>default,   steps   were   initiated   under   the   Securitisation   and<\/p>\n<p>Reconstruction   of   Financial   Assets   and   Enforcement   of   Security<\/p>\n<p>Interest     Act.     Ext.P1   is   the   notice   under   Section   13(2).     It   is<\/p>\n<p>thereafter     that   proceedings   have   been   initiated   and   the   bank<\/p>\n<p>obtained   an   order     under   Section   14   of   the   Act.     Thereafter<\/p>\n<p>possession   was   also   taken   over.     Though   the   petitioners   raised<\/p>\n<p>several   contentions   on   the   merits   and   sought   a   direction   to<\/p>\n<p>handover   possession   of   the   building   back   to   them,     I   am   not<\/p>\n<p>inclined to pass such an order since the Bank cannot be faulted<\/p>\n<p>for     the       action   that   they   have   taken.     However,   the   learned<\/p>\n<p>counsel   for   the   petitioners   prays   for   an   opportunity   to   clear   off<\/p>\n<p>the dues.  Though the standing counsel for the Bank opposes this<\/p>\n<p>prayer, I think that the petitioners may be given an opportunity<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.7080\/2008\/P                         -2-<\/span><\/p>\n<p>to clear the dues. Hence, I dispose of this writ petition with the<\/p>\n<p>following directions:\n<\/p>\n<\/p>\n<p>        That   the   Bank   will   retain   the   possession   of   the   building<\/p>\n<p>taken over from the petitioners.   Retaining possession as above,<\/p>\n<p>the petitioners will  repay the amount in default  in three monthly<\/p>\n<p>equal instalments,   the first of which will start from 1st week of<\/p>\n<p>March   2008   and   subsequent   instalments   will   be   payable   in   the<\/p>\n<p>first week of every succeeding month.
