A   of the CAT, Bangaiore dated 24.1.1999<\/p>\n
 OA98 is chalienged by the petitioners herein.<\/p>\n
2. The essential facts necessary for consideration<\/p>\n
of the case are that the respondent is a <\/p>\n
appointed in the Customs House at  <\/p>\n
examiner on 24.9.1990. As dated’ 9<\/p>\n
7.12.1992, he addressed a  for  <\/p>\n
from Cochin to Madras.  rep1’esenta.tion’Vthehas29′<\/p>\n
stated his parents arepld, ,t’h’ei’v\u00a2’ 1′ ar”e_._no dmaleinembers
\nin the family to lookdkdafterd a resident of
\nBagalpur in  spondilytis
\nsince two  itraiiisferred from Cochin to
\nMadras; him to look after his
\nparents.”   15.12.1992 the request of<\/p>\n
the responde1’1tV_VWas accepted by the department and a<\/p>\n
pcondition was imposed that on transfer his service will<\/p>\n
“i1o’t”___be”‘considered for promotion and confirmation in<\/p>\n
Customs House, Cochin and that he will not claim<\/p>\n
2 at the new place i.e,. Madras. In obedience to<\/p>\n
—  tliedsaid order, on 21.12.1992 the respondent has given<\/p>\n
” “an undertaking giving up his service. claim for seniority<\/p>\n
in Cochin House and proceeded to Madras. Thereafter,<\/p>\n
the respondent addressed a requisition as per Ann-exure<\/p>\n
“c” dated 7.2.i995. In this letter, he states’:<\/p>\n
given a declaration but as per the rules   <\/p>\n
appears illogical, ultra vires of”the\u00ab basic  of<\/p>\n
recruitment\/ seniority. He soughtffor seniority <\/p>\n
fixed according to the C()I1tlf1al;lzC’1l.,1S se1″v_V_ic’ea by
\nhim in the departmeri:t~..\/[rorniJiggtjt 141.831. Annexure D, the
\nsaid request is rejected;  nrequest to fix<\/p>\n
seniority is aism-e;ee_tec1  .’per’–lPm.neXure F. In the<\/p>\n
rejection  by the Department, it is
\ncontended that ‘t.he:..grespo:rident having voluntarily given<\/p>\n
up his” seniority’ in service at Cochin House for transfer<\/p>\n
 :lfio_use,  is not entitled for counting of the<\/p>\n
 of service which he has rendered at<\/p>\n
if .V Cocl1in.”–.’?l.’Fie’V’ vvrit petitioners have supported the action
\n  department contending that on a representation<\/p>\n
—  to surrender the seniority, he is transferred to Madras,<\/p>\n
\u00a7\/<\/p>\n
his request was accommodated, but now he cannot go<\/p>\n
back. So, pray for dismissal of the OA.<\/p>\n
3. CAT has considered the case of”‘\u00ablt_:he. <\/p>\n

the writ petitioners have imefelrrevdfthisgpetition.<\/p>\n
4. C’  Leariiedmadiroeate for the writ petitioners<\/p>\n
submit that hereis aease of transfer of an employee on<\/p>\n
ll:h\u00abisri’ecjuCst”\u00ab.according to his undertaking. He has<\/p>\n
  expressed that he will not claim any<\/p>\n
V . seniority liflhe is transferred from Cochin to Madras.<\/p>\n
ll  transfer, he cannot go back. There is no merit in<\/p>\n
—  thzelease of the respondent to grant him seniority. The<\/p>\n
” “orders of CAT, Ernakularn to the said effect is produced.<\/p>\n

The said finding of the CAT, Ernakulam is distinguished<\/p>\n
without appreciating the subject involved in UNION OF<\/p>\n
INDIA vs c N PONNAPPAN [AIR 1996 so 784].” “so;Ii’jp;-‘ay<\/p>\n
for allowing the writ petition.\n<\/p>\n
5. on the other hand,l4’3._elar_ned ‘p’ar1dvoc’a\u00a3eftof~,T<\/p>\n
respondent contends that tl1’1<e:'senioritgf_  is
\nconsidered on the  rendered by a
\nperson. It cannot be   than the one
\nprescribed  " respondent has

7. The facts are not at all in dispute. The
\ncontention of the advocate for the respondent is.__that<\/p>\n
continuous service is the criteria to consider”g:’–._the<\/p>\n
seniority whereas the reply is that   <\/p>\n
undertaking given by the respor:.’de’n’t;.   <\/p>\n
CAT has placed reliance on <\/p>\n

1996 sc 764). In ti1:e~…said’i’ease,._ theitr Lordships were
\nconsidering the requiremegr\ufb01isllflora.-.,the’_’ifjrornotion from
\nLower Divisicg’nl’\u00a3iel1erk;ito  Clerk and also
\nfor  Stenographer Grade III to
\nGrade lliI_ 4′ Whereasf  “Jrequisite criteria for the<\/p>\n
consideration’-\u00bbto”the post of Upper Division Clerk was<\/p>\n
llleighlt  “of service and for the post of Stenographer<\/p>\n
l”G_ra.dye Ii  years service. So, their Lordships have<\/p>\n
V . heldthat tile service at the earlier place being a regular<\/p>\n
 Ve.Vyse1rv.ice, the same has to be counted.<\/p>\n
8. In the facts of the case, the respondent in the<\/p>\n
letter dated 7.2.l995\/Annexure “C” contends that the<\/p>\n
undertaking given by him is illogical. No <\/p>\n
authorising calculation of the services renderediiearlieri V’ <\/p>\n
in the earlier place is placed by   <\/p>\n
contention that rules provide fordsuch a <\/p>\n
the services rendered asserte'”Cl\u00bb.is\u00bbnot probabalised.<\/p>\n

\nfortify these.lassertions”‘~i.n”the reply. Even it is not the<\/p>\n
caseglofythea ‘1inl’OA that any rule is violated by<\/p>\n
if  the._submission of the respondent to forego his<\/p>\n
i”‘s.eri’iority7if.__he”is transferred from Cochin to Madras.<\/p>\n
V . Sofdthe-Vipreasoning of the CAT in directing the writ<\/p>\n
if lllypvspetitioners to count the services rendered by the<\/p>\n
 respondent at Cochin for fixing the seniority of the<\/p>\n
Hlrespondent is not justified. So, it is set–aside. The<\/p>\n
submission of the learned advocate for the petitiorxers is<\/p>\n
