It is evident that the appellant\n\nis not interested in taking advantage of the said order dated\n\n14\/12\/2009.\n\n     2. The petition for condonation of delay shall hence stand\n\ndismissed for non-compliance with the conditions imposed. APPLICATION NO. 549 OF 2008 &amp;\n\n                   MAT APPEAL NO. 182 OF 2008\n\n             ============================\n\n        DATED THIS THE 14TH DAY OF DECEMBER 2009\n\n                              ORDER\n<\/pre>\n<p>Basant,J.\n<\/p>\n<p>     This petition is to condone the delay of 34 days in filing an<\/p>\n<p>appeal. The appeal in turn is directed against a direction to pay past<\/p>\n<p>maintenance at the rate of Rs.2500\/- per mensem to the wife and<\/p>\n<p>Rs.1,000\/- per mensem to the child. There was a further direction to<\/p>\n<p>pay an amount of Rs.15,000\/- for the treatment expenses of the wife.<\/p>\n<p>This application is opposed. But notwithstanding the opposition, we<\/p>\n<p>C.M. APPLN. IN MAT APPEAL NO. 182\/2008<br \/>\n<span class=\"hidden_text\">                                     -3-<\/span><\/p>\n<p>are satisfied that a lenient view can be taken and the delay can be<\/p>\n<p>condoned subject to         appropriate terms and conditions.       We are<\/p>\n<p>satisfied that the appellant who is said to be a person employed<\/p>\n<p>abroad can be directed to deposit the entire amount due under the<\/p>\n<p>impugned order as condition for condonation of delay.<\/p>\n<p>       2. In the result:\n<\/p>\n<p>       a) This petition is allowed subject to conditions.<\/p>\n<p>       b)The delay shall stand condoned and this petition shall stand<\/p>\n<p>allowed on condition that the appellant deposits the entire amount due<\/p>\n<p>under the impugned order before the Family Court within a period of<\/p>\n<p>thirty days from this date.\n<\/p>\n<p>       3. Call after thirty days or earlier, if deposit is made and voucher<\/p>\n<p>is produced.\n<\/p>\n<\/p>\n<p>                                             R.
