SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 05\/03\/2010 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>RULE.\n<\/p>\n<p>\tMr.Niraj Soni, learned Assistant<br \/>\n\tGovernment Pleader waives the service of notice of rule on<br \/>\n\tbehalf of the opponent State.\n<\/p>\n<p>With<br \/>\n\tthe consent of the learned advocates appearing on behalf of the<br \/>\n\trespective parties, present application is taken up for final<br \/>\n\thearing today.\n<\/p>\n<p>Present<br \/>\n\tapplication has been preferred by the applicant   original<br \/>\n\tappellant to condone the delay  in preferring the application for<br \/>\n\trestoration of the main Second Appeal No.217  of 1983 which came to<br \/>\n\tbe dismissed for non-prosecution.\n<\/p>\n<p>Having<br \/>\n\theard the learned advocates appearing on behalf of the respective<br \/>\n\tparties and considering the averments in the application and<br \/>\n\tconsidering the fact that the cognate Second Appeal No.216 of 1983<br \/>\n\tis already pending and is on Board for final hearing, present<br \/>\n\tapplication is allowed. Second Appeal 217 of 1983 is restored to<br \/>\n\tfile. Registry is directed to notify Second Appeal No.217 of 1983<br \/>\n\talong with Second Appeal No.216 of 1983 for final hearing on<br \/>\n\t31\/3\/2010. Rule is made absolute accordingly.
