Shahi, learned Standing Counsel.\n<\/p>\n<p>      By means of this writ petition, the petitioner assails the<br \/>\norder dated 2.9.2003 passed by the Senior Superintendent of<br \/>\nPolice, Lucknow, whereby the petitioner has been removed from<br \/>\nservice and the order dated 9.3.2007 passed by the Appellate<br \/>\nAuthority\/Deputy Inspector General of Police rejecting the appeal.\n<\/p>\n<p>      The facts giving rise to the instant writ petition are that a<br \/>\ncharge-sheet was issued by the Additional Superintendent of<br \/>\nPolice (City), Lucknow, requiring him to submit reply the charges<br \/>\nthat on 7.6.1997, when the petitioner was posted as Constable at<br \/>\nPolice Station Krishna Nagar, Lucknow, on 8.6.1997, he proceeded<br \/>\non 14 days casual leave and on expiry of leave, he should have<br \/>\nreported for his duties on 24.6.1997, but he did not report for<br \/>\nduties and he remained absent for duties for a period of 3 years<br \/>\n19 days and 10 minutes. The petitioner could not submit reply to<br \/>\nthe aforesaid charge-sheet because it was never served upon him<br \/>\neither personally or through registered post as required by Note<br \/>\n(I) of Appendix I of the U. P. Police Officers of the Subordinate<br \/>\nRanks (Punishment and Appeal) Rules, 1991. The Enquiry Officer,<br \/>\nhowever, without considering whether the charge sheet has been<br \/>\nserved on the petitioner or not, proceeded with the departmental<br \/>\nproceedings behind the petitioner on the ground that the<br \/>\npetitioner had not submitted reply to the charge sheet         and he<br \/>\nhad also not appeared before the inquiry despite service of notice.<br \/>\nAfter the departmental proceedings, the Enquiry Officer submitted<br \/>\nthe enquiry report dated 25.4.2003 and he came to the conclusion<br \/>\n<span class=\"hidden_text\">                                        2<\/span><\/p>\n<p>that the charges levelled against the petitioner stood proved and<br \/>\nas such, a recommendation was made that punishment of removal<br \/>\nfrom service be imposed on the petitioner. On the basis of the<br \/>\naforesaid enquiry report, a show cause notice dated 29.5.2003<br \/>\nwas issued by the Senior Superintendent of Police, Lucknow. On<br \/>\naccount of illness, the petitioner could not submit reply to the<br \/>\nshow cause notice, as a result of which the impugned order has<br \/>\nbeen passed.\n<\/p>\n<p>      Learned Counsel for the petitioner submits that against the<br \/>\nimpugned order, he filed a Writ Petition No. 2705 (SS) of 2004<br \/>\nand this Court dismissed the said writ petition on the ground of<br \/>\navailability of alternative remedy. In pursuance of the order<br \/>\npassed by this Court, an appeal was filed, which was rejected by<br \/>\nthe order dated 9.3.2007. Further, he contends that neither the<br \/>\ncharge sheet nor the Enquiry Report has been served upon the<br \/>\npetitioner.\n<\/p>\n<p>      In the counter-affidavit it has been stated that the petitioner<br \/>\nhas been dismissed after detailed enquiry as per Rules 1991. The<br \/>\npetitioner, while he was posted at P. S. Krishna Nagar in the year<br \/>\n1997, proceeded on 14 days casual leave on 7.6.1997 and as per<br \/>\nLeave Rules, he should have reported back on duty after availing<br \/>\nleave on 24.6.1997, but the petitioner did not report back and<br \/>\ninstead remained absent without any sanctioned leave or any<br \/>\napplication for leave in an unauthorized manner beyond the Rules<br \/>\nculminating        to   misconduct.    The     petitioner     after   remaining<br \/>\nunauthorized absent for a long period of about 3 years, reported<br \/>\nback on duty on 13.10.2000. For this act of misconduct, a<br \/>\npreliminary enquiry was ordered against the petitioner. On the<br \/>\nbasis of the proved charges in the preliminary enquiry, a detailed<br \/>\nenquiry under Rule 14 (1) was ordered. The petitioner despite<br \/>\nhaving knowledge of the date and time of recording evidence did<br \/>\nnot participate in the departmental proceedings. The charge sheet<br \/>\nwas sent to the petitioner through Special Messenger, which was<br \/>\nreceived on 21.9.2002 by his wife Smt. Nirmala Singh. One of the<br \/>\ncharge sheet was affixed on the door of the petitioner&#8217;s residence<br \/>\nin   front    of    witnesses.   The       petitioner   was     given   several<br \/>\nopportunities to participate in the enquiry, but he chose not to<br \/>\n<span class=\"hidden_text\">                                  3<\/span><\/p>\n<p>participate in the departmental proceedings. The Enquiry Officer,<br \/>\nafter completing the enquiry, found the charge of unauthorized<br \/>\nabsence of the petitioner for a period of 3 years 19 days 10<br \/>\nMinutes proved against the petitioner. On this grave charge of<br \/>\nmisconduct, the competent authority dismissed the petitioner<br \/>\nfrom service after giving him a show cause notice dated<br \/>\n29.5.2003. Therefore, the dismissal order has rightly been<br \/>\npassed.\n<\/p>\n<p>      In order to adjudicate the case, provisions of Note (I) of<br \/>\nAppendix I of the U.P. Officers of the Subordinate Rules<br \/>\n(Punishment and Appeal) Rules, 1991 are as under:-\n<\/p>\n<blockquote><p>      &#8220;(I)   The charge sheet should be given to the person<br \/>\n      concerned and his signature should be taken on a<br \/>\n      copy of the charge-sheet. If that is not possible, it<br \/>\n      should be served by registered post.&#8221;<\/p><\/blockquote>\n<p>      As has been mentioned in the counter-affidavit, the charge<br \/>\nsheet was sent to the petitioner through Special Messenger, which<br \/>\nwas received on 21.9.2002 by his wife Smt. Nirmala Singh. One of<br \/>\nthe charge sheet was affixed on the door of the petitioner&#8217;s<br \/>\nresidence in front of witnesses. A perusal of the aforesaid Note<br \/>\n(I), it reveals that the charge sheet should be given to the person<br \/>\nconcerned, otherwise, it should be sent by the registered post.<br \/>\nHere, in this case, neither the charge sheet has been served<br \/>\npersonally nor it has been sent by the registered post. Admittedly,<br \/>\nit has been served upon the petitioner&#8217;s wife, namely Smt.<br \/>\nNirmala Singh and the same has been affixed on the door of the<br \/>\npetitioner&#8217;s residence of the last known address, which has been<br \/>\nindicated in the department. Learned Standing Counsel does not<br \/>\ndispute the aforesaid proposition. On this point alone, the<br \/>\nimpugned orders are liable to be quashed.\n<\/p>\n<p>      Accordingly, the writ petition is allowed and the impugned<br \/>\ndismissal    order   dated   2.9.2003   passed   by   the   Senior<br \/>\nSuperintendent of Police, Lucknow and the order dated 9.3.2007<br \/>\npassed by the Appellate Authority\/Deputy Inspector General of<br \/>\nPolice rejecting the appeal of the petitioner are hereby quashed.\n<\/p>\n<p><span class=\"hidden_text\">                                  4<\/span><\/p>\n<p>However, it will be open for the opposite parties to proceed in<br \/>\naccordance with law, if they so desire.\n<\/p>\n<p>Dt. 29.1.2010<br \/>\nLakshman\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Dinesh Pratap Singh vs State Of U.P.
