Justice ANTONY DOMINIC\n\n Dated :31\/01\/2011\n\n O R D E R\n                      ANTONY DOMINIC, J.\n                        -------------------------\n                    W.P (C) No.32619 of 2008\n                        --------------------------\n               Dated this the 31st January, 2011\n\n                          J U D G M E N T\n<\/pre>\n<p>      Non-implementation        of   Ext.P7      order  led  the<\/p>\n<p>petitioner to file this writ petition.<\/p>\n<p>      2.    According to the petitioner, the 7th respondent<\/p>\n<p>made    certain     un-authorised       constructions    in  the<\/p>\n<p>puramboke land and that the same was liable for eviction.<\/p>\n<p>He made Ext.P5 representation in this behalf before the<\/p>\n<p>2nd respondent. No steps were taken on Ext.P5. At that<\/p>\n<p>stage, petitioner approached this Court by filing W.P (C)<\/p>\n<p>No.1735\/2008.      That writ petition was         disposed of by<\/p>\n<p>Ext.P6 judgment rendered on 15th January, 2008 directing<\/p>\n<p>that a decision on the representation shall be taken by the<\/p>\n<p>Revenue Divisional Officer.\n<\/p>\n<p>      3.   Accordingly, the Revenue Divisional Officer<\/p>\n<p>inspected the land , heard the parties and passed Ext.P7<\/p>\n<p>order on 30.5.2008. This order says that unauthorised<\/p>\n<p>structures made by the 7th respondent in 3.30 ares of<\/p>\n<p>puramboke land was liable to be evicted.           The Tahsildar,<\/p>\n<p>Chengannur, the 4th respondent, was directed to take<\/p>\n<p>W.P (C) No.32619 of 2008<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>appropriate action under the Kerala Land Conservancy Act.<\/p>\n<p>In this writ petition what is complained of by the petitioner<\/p>\n<p>is   that not only further action based on Ext.P7 was not<\/p>\n<p>initiated but also the 7th respondent is continuing further<\/p>\n<p>constructions.\n<\/p>\n<p>      4.   Notice has been served on the 7th respondent.<\/p>\n<p>But no counter affidavit has been filed on their behalf. In<\/p>\n<p>the counter affidavit filed by the respondent No.3, the<\/p>\n<p>Revenue Divisional Officer, who was issued Ext.P7 he says<\/p>\n<p>that unauthorised structures are liable to be demolished<\/p>\n<p>and occupants to be evicted. However, nothing has been<\/p>\n<p>mentioned about the steps that the Tahsildar has taken<\/p>\n<p>pursuance to the directions in Ext.P7 order. Obviously<\/p>\n<p>there has been      abdication of duty not only by the 3rd<\/p>\n<p>respondent but also by the 4th respondent.           In such<\/p>\n<p>circumstances, petitioner is justified in his complaint.<\/p>\n<p>      5.   Therefore, I direct that on production of a copy<\/p>\n<p>of this judgment, respondents 3 and 4 will ensure that steps<\/p>\n<p>are taken for the appropriate implementation of Ext.P7<\/p>\n<p>order passed by the 3rd respondent.
