KURIAKOSE,J.\n\n                  - - - - - - - - - - - - - - - - - - - - - - - - -\n\n                           W.P.(C) No.2044 of 2008\n\n                   - - - - - - - - - - - - - - - - - - - - - - - - -\n\n                           Dated: 7th February, 2008\n\n\n                                    JUDGMENT\n<\/pre>\n<p>       The   petitioner,   a   resident   of   the   first   respondent-Municipality<\/p>\n<p>challenges in this Writ Petition  under Article  226  of the  Constitution<\/p>\n<p>Exts.P1   and   P5   by   which   the   Municipality   rejects   or   refuses   to<\/p>\n<p>consider the petitioner&#8217;s application for construction of a commercial<\/p>\n<p>building   on   his   properties   in   R.S.Nos.51\/66,   51,67,   51\/69,   51\/72,<\/p>\n<p>51\/73   &amp;   51\/74   of   Kunnamkulam   village.   The   petitioner   alleges   that<\/p>\n<p>the   Municipality   has   shown   hostile   discrimination   towards   him   in   as<\/p>\n<p>much as a lady by name Annamma Jacob who owns properties very<\/p>\n<p>near to the petitioner has been issued with a permit notwithstanding<\/p>\n<p>the existence of the so-called proposal to acquire the property for the<\/p>\n<p>purpose   of   construction   of   the   bye-pass   road   and   proposal   to<\/p>\n<p>promulgate a notification of a D.T.P.Scheme in relation to the area in<\/p>\n<p>question.\n<\/p>\n<\/p>\n<p>       2.   A   counter   affidavit   has   been   filed   by   the   1st  respondent-<\/p>\n<p>Municipality   wherein   it   is   contended   that   the   property   in   respect   of<\/p>\n<p>which the building permit  is applied for the petitioner is situated at a<\/p>\n<p>place  where   the  Municipality  proposes   to   construct  a  bye-pass   road<\/p>\n<p>connecting the new bus stand. This proposed road, it is contended, is<\/p>\n<p><span class=\"hidden_text\">W.P.C.No.2044\/08                                   &#8211;  2  &#8211;<\/span><\/p>\n<p>very much essential for the development of the town and for easing<\/p>\n<p>the increasing vehicular traffic in the town. It is also contended in the<\/p>\n<p>counter affidavit that steps are underway for getting the area notified<\/p>\n<p>under the Town Planning Act.\n<\/p>\n<\/p>\n<p>         3.   I   have   heard   the   submissions   of   Mr.Isaac   M.Perumpillil,<\/p>\n<p>learned   counsel   for   the   petitioner   and   those   of   Mr.Grashious<\/p>\n<p>Kuriakose, learned Standing Counsel for the Municipality.<\/p>\n<p>         4.   Mr.Isaac   M.Perumpillil   would   draw   my   attention   to   Ext.P3<\/p>\n<p>judgment   of   this  court   pursuant   to   which  Smt.Annamma   Jacob,   the<\/p>\n<p>petitioner&#8217;s   neighbour   was   issued   with   a   building   permit   by   the<\/p>\n<p>Municipality.   Learned   counsel   submitted   that   there   is   no   reason   for<\/p>\n<p>declining the justice  given to Smt.Annamma Jacob to the petitioner.<\/p>\n<p>Learned   counsel   also   drew   my   attention   to   the   various   judgments<\/p>\n<p>including those of the Supreme Court in <a href=\"\/doc\/1755100\/\">Raju S.Jethmalani v. State<\/p>\n<p>of  Maharashtra<\/a>  [(2005)  11   S.C.C. 222]  and  the  Division  Bench  of<\/p>\n<p>this court in <a href=\"\/doc\/1115418\/\">Padmini v. State of Kerala<\/a> (1999(3) KLT 465).<\/p>\n<p>         5. Learned Standing Counsel for the Municipality would oppose<\/p>\n<p>the   submissions   on   the   basis   of   the   contentions   raised   by   the<\/p>\n<p>Municipality in its counter affidavit.\n<\/p>\n<\/p>\n<p>         6.   Having   considered   the   rival   submissions,   I   am   of   the   view<\/p>\n<p><span class=\"hidden_text\">W.P.C.No.2044\/08                                   &#8211;  3  &#8211;<\/span><\/p>\n<p>that the fact situation which obtains in this case is very much similar<\/p>\n<p>to the one which obtains in Ext.P3 judgment. It is not disputed before<\/p>\n<p>me   that   the   properties   of   Smt.Annamma   Jacob   and   that   of   the<\/p>\n<p>petitioner are lying nearby. Under these circumstances, I   direct the<\/p>\n<p>Municipality to receive an affidavit from the petitioner undertaking to<\/p>\n<p>demolish the building to be constructed by him on the strength of the<\/p>\n<p>permit to be issued without claiming any compensation at all for the<\/p>\n<p>building   in   case   a   notification   under   Section   4(1)   of   the   Land<\/p>\n<p>Acquisition   Act   is   promulgated   for   acquisition   of   any   portion   of   the<\/p>\n<p>petitioner&#8217;s   property   within   one   year   from   today.   Once   such   an<\/p>\n<p>affidavit is received, the 2nd respondent will reconsider the question of<\/p>\n<p>granting approval to the plan submitted by the petitioner and issuing<\/p>\n<p>building   permit   to   the   petitioner   without   being   influenced   by   the<\/p>\n<p>proposal to acquire  the property for the construction of the by-pass<\/p>\n<p>road or the steps which are stated to be underway for promulgation<\/p>\n<p>of   a   D.T.P.Scheme   under   the   Town   Planning   Act.   If   the   plan   is<\/p>\n<p>otherwise   in   order,   the   same   will   be   approved   by   the   Municipality.<\/p>\n<p>Fresh orders on the permit application submitted by the petitioner will<\/p>\n<p>be passed by the 2nd respondent within three weeks of the petitioner<\/p>\n<p>filing affidavit in response to this judgment. It is however made clear<\/p>\n<p><span class=\"hidden_text\">W.P.C.No.2044\/08                                   &#8211;  4  &#8211;<\/span><\/p>\n<p>that even after the expiry of the period of one year mentioned in this<\/p>\n<p>judgment,   it   will   always   be   open   to   the   respondents   to   acquire   the<\/p>\n<p>petitioner&#8217;s   property   including   the   building   constructed   on   the<\/p>\n<p>strength of the permit for any genuine public purposes subject to the<\/p>\n<p>condition   that   under   such   an   eventuality   the   respondents     will   be<\/p>\n<p>liable to pay adequate compensation to the petitioner under the Land<\/p>\n<p>Acquisition Act.\n<\/p>\n<\/p>\n<p>         The Writ Petition is allowed as above.\n<\/p>\n<\/p>\n<pre>srd                                                    PIUS C.KURIAKOSE, JUDGE\n\n\n<\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Abdul Rahman vs The Kunnamkulam Municipality on 7 February, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C) No. 2044 of 2008(R) 1.
