The averments made in<br \/>\n\tthe application are supported by an affidavit sworn by G.P.Rathod,<br \/>\n\tUnder Secretary, Legal Department, Sachivalaya, Gandhinagar.  It is<br \/>\n\tinter alia stated that because of intra-department and<br \/>\n\tinter-department  proceedings, considerable time is consumed and the<br \/>\n\tdelay has been caused. It is also pleaded that there was sufficient<br \/>\n\tcause which prevented the applicant in filing appeal in time. It is,<br \/>\n\ttherefore, prayed that the delay may be condoned.\n<\/p>\n<p>Having<br \/>\n\theard Mr. R.C.Kodekar, learned APP for the Applicant   State of<br \/>\n\tGujarat and Mr. Y.M.Thakore, learned Advocate for the Opponents<br \/>\n\taccused and a perusal of the averments made in the Application which<br \/>\n\thave remained uncontroverted, and also considering the celebrated<br \/>\n\tprinciples governing the discretionary exercise of power conferred<br \/>\n\tunder Section 5 of the Act so also the reported decisions of the<br \/>\n\tHon&#8217;ble Supreme Court construing Section 5 of the Act liberally, we<br \/>\n\tare of the considered  opinion that delay caused in filing the<br \/>\n\tappeal has been aptly and sufficiently explained. The record does<br \/>\n\tnot indicate that there was inaction or negligence on the part of<br \/>\n\tthe Applicant in prosecuting the appeal. The Applicant has never<br \/>\n\tabandoned the lis. The explanation offered for condonation of delay<br \/>\n\tis not only plausible, but acceptable. In the aforesaid view of the<br \/>\n\tmatter, since there was sufficient cause which prevented the<br \/>\n\tApplicant in filing the Appeal in time, application deserves to be<br \/>\n\tallowed by condoning the delay as prayed for.\n<\/p>\n<p>For<br \/>\n\tthe foregoing reasons, the application succeeds and accordingly it<br \/>\n\tis allowed. Delay of 23 days caused in filing the appeal is<br \/>\n\tcondoned.
