JAGANMOHAN\n\nCITATION:\n 1971 AIR 1188\t\t  1971 SCR  294\n 1971 SCC  (1) 843\n\n\nACT:\nLand Acquisition Act (1 of 1894), ss. 5A and 55-Rules framed\nregulating enquiry under s. 5A-Complied with-Acquisition for\nCorporation Right to cross examine officers of Corporation.\n\n\n\nHEADNOTE:\nBy a notification issued under s. 4 of the Land\t Acquisition\nAct,   1894,   the  State  Government  declared\t  that\t the\nappellant's  lands  were needed for the\t public\t purpose  of\nconstruction   of  an  Industrial  Estate  by  the   Gujarat\nIndustrial Development Corporation.  The officer on  special\nduty informed the,appellant that if he had any objection  to\nthe  acquisition  he might file objections on  or  before  a\nparticular  date and, that he or his counsel would be  heard\nat  the time of filing the objections.\tThe appellant  filed\nhis   objections  and  prayed  that  the  officers  of\t the\nCorporation  may  be  summoned for  the\t purpose  of  cross-\nexamination  to show that the proposed acquisition  was\t not\nfor  a public purpose and that there was no need to  acquire\nhis land, and that a personal hearing may be granted to him.\nThe hearing was fixed for a particular date and the date was\nextended from time to time but the appellant did not  appear\non  those dates nor did he apply for any, further  extension\nof  time.   His\t written objection were\t considered  by\t the\nofficer\t and included in his report to the Government  under\ns. 5A.\nOn the question whether the report was vitiated because\t the\nofficer\t had not granted an opportunity to the appellant  to\ncross-examine the officers of the Corporation,\nHELD:The    question\twhether\t  the\t inquiry    was\nadministrative\tor quasi-judicial did not arise.  Rules\t had\nbeen  framed  under  s. 55 of the Act for  the\tguidance  of\nofficers dealing with objections under s. 5A, and the  rules\nhad  been complied with in the present case.  The  appellant\nwas  given an opportunity to be heard personally but he\t did\nnot  choose to avail himself of that opportunity.  He  could\nnot, under the rules, claim to cross-examine officers of the\nCorporation when they had not given any evidence before\t the\nofficer\t on  special duty and there was no  principle  which\nentitled the, appellant to claim such right. Hathi, for respondent No. 3.\n<\/p>\n<p><span class=\"hidden_text\">295<\/span><br \/>\n<span class=\"hidden_text\">5<\/span><\/p>\n<p>The Judgment of the Court was delivered by<br \/>\nSikri, C. J.-This appeal, by certificate granted by the High<br \/>\nCourt  of Gujarat under Art. 132 and Article 133 (1) (c)  of<br \/>\nthe Constitution of India, is directed against its  judgment<br \/>\nand order dismissing the present appellant&#8217;s petition  under<br \/>\nArticle 226 of the Constitution.\n<\/p>\n<p>The  appellant\tis the owner of Survey Nos.  219\/1  and\t 121<br \/>\nsituated  on the outskirts of Mahuva in Bhavnagar  District.<br \/>\nBy notification dated April 25, 1969, issued under Section 4<br \/>\nof  the\t Land Acquisition Act, 1894,  the  State  Government<br \/>\ndeclared that the above-mentioned lands were needed for\t the<br \/>\npublic\tpurpose of construction of an Industrial  Estate  by<br \/>\nthe  Gujarat  Industrial  Development  Corporation  or\twere<br \/>\nlikely\tto  be needed for that purpose.\t On May\t 3,  1969  a<br \/>\nnotice\twas  issued  to the appellant by  S.  0.  Collector,<br \/>\nOfficer\t on  Special Duty, Land Acquisition,  informing\t the<br \/>\nappellant that if he had any objection to the acquisition of<br \/>\nthe lands, he might file objections on or before August\t 16,<br \/>\n1969.\tHe was further informed that the Officer  will\thear<br \/>\nhim  or\t his Counsel at the time of filing  the\t objections.<br \/>\nThe appellant filed his objections.  He took various points,<br \/>\nbut we are only concerned with one.  He pointed out that the<br \/>\nGujarat Industrial Development Corporation has come out with<br \/>\nambitious  projects for the establishment of the  Industrial<br \/>\nestate\tthough,\t in fact, the land already acquired  by\t the<br \/>\nCorporation   is  in  excess  of  the  requirement  of\t the<br \/>\nCorporation.\tI  say\tthat  the  corporation\tis  not\t  in<br \/>\npossession  of such material as would establish\t genuineness<br \/>\nfor the establishment of an industrial estate of Mahuva.  1,<br \/>\ntherefore,  claim  that the responsible\t officer  should  be<br \/>\ncross-examined\tby  me for the purpose of showing  that\t the<br \/>\nproposed  acquisition  is not for public  purpose  and\tthat<br \/>\nthere  is no need to acquire the present lands.\t  The  other<br \/>\nsuitable  lands\t are available and the Corporation  has\t not<br \/>\navailed\t of  the same and that the acquisition needs  to  be<br \/>\ndropped.  I say that the contiguous lands to the lands under<br \/>\nthe  first notification are available and it would  be\tmore<br \/>\nsuitable  than the present land. 1, therefore,\tsubmit\tthat<br \/>\nthe  proposed acquisition is mala fide inasmuch as my  lands<br \/>\nare preferred to the other land owners available immediately<br \/>\nnear the lands required under the first notification.\n<\/p>\n<p>\t      He accordingly prayed<br \/>\n\t      &#8220;(a) That the officers of the said Corporation<br \/>\n\t      which have sought the acquisition and\/or\tsuch<br \/>\n\t      Officer\tname hereafter be summoned  for\t the<br \/>\n\t      purpose of cross-examination.\n<\/p>\n<p>\t      (b)   That personal hearing be granted.&#8221;\n<\/p>\n<p><span class=\"hidden_text\">296<\/span><\/p>\n<p>It  appears that hearing was fixed for September  18,  1969;<br \/>\nthis date was extended from time to time, till November\t 18,<br \/>\n1969.\tThe appellant did not appear on these dates nor\t did<br \/>\nhe  apply for any extension of time.  His written  objection<br \/>\ndated  August 12\/18, 1969 and dated September 18, 1969\twere<br \/>\nconsidered  and included in the report, under Section 5A  to<br \/>\nthe Government.\n<\/p>\n<p>Three  points were pressed by the appellant before the\tHigh<br \/>\nCourt.\t The  principal point that  the\t Gujarat  Industrial<br \/>\nDevelopment Corporation Act, 1962 was beyond the legislative<br \/>\ncompetence  of the State legislature no longer\tsurvives  as<br \/>\nthis  Court  has held this Act to be valid in  the  case  of<br \/>\nRamtanu\t C.  H. Society v. State of  Maharashtra  (1).\t The<br \/>\nsecond\tground\tpressed before the High Court was  that\t the<br \/>\nestablishment of Industrial Area by the Corporation was\t not<br \/>\na  public  purpose but a private purpose.  In our  view\t the<br \/>\nHigh  was right in holding that this was a  public  purpose.<br \/>\nThe  third ground raised before the High Court was  strongly<br \/>\npressed\t before\t us.  According to the learned\tCounsel\t the<br \/>\nreport\tunder  Section 5-A of the Land Acquisition  Act\t was<br \/>\nvitiated   because   the  Collector  had  not\tgranted\t  an<br \/>\nopportunity  to the appellant to cross-examine the  officers<br \/>\nof  the\t Corporation  for the purpose of  showing  that\t the<br \/>\npurpose\t for  which the Corporation sought  to\tacquire\t the<br \/>\nlands  was  not a public purpose and there was\tno  need  to<br \/>\nacquire,  the appellant&#8217;s land.\t The High Court\t relying  on<br \/>\nits earlier decision in Gandalal v. State(2) held that\t&#8220;the<br \/>\ninquiry under Section 5A(2) is an administrative inquiry and<br \/>\nobjector  is not entitled to cross-examine any\tofficers  or<br \/>\nmembers of the acquiring body.&#8221;\n<\/p>\n<p>Under  Section 55 of the Land Acquisition Act certain  rules<br \/>\nhave been made for the guidance of officers in dealing\twith<br \/>\nobjections lodged under Section 5-A of the Act.\t These rules<br \/>\nare as follows :\n<\/p>\n<blockquote><p>\t      &#8221;\t  Whenever any notification under Section  4<br \/>\n\t      of   the\tAct  has  been\tpublished  but\t the<br \/>\n\t      provisions of Section 17 have not been applied<br \/>\n\t      and the Collector has under, the provision  of<br \/>\n\t      Section  4(1)  issued notice to  the  parties,<br \/>\n\t      interested  ;  and on or before the  last\t day<br \/>\n\t      fixed  by\t the Collector in those\t notices  in<br \/>\n\t      this  behalf  any objection  is  lodged  under<br \/>\n\t      section  5-A(2), firstly, the Collector  shall<br \/>\n\t      record  the  objection  in  his\tproceedings,<br \/>\n\t      secondly, the Collector shall consider whether<br \/>\n\t      the objection is admissible according to these<br \/>\n\t      rules.\n<\/p><\/blockquote>\n<blockquote><p>\t      (1) A. I. R. 1970 S. C. 1771.    (2)  (1963) 4<br \/>\n\t      Gujarat Law Reporter 326<br \/>\n<span class=\"hidden_text\">\t      297<\/span><br \/>\n\t      To  be  admissible (a) an\t objection  must  be<br \/>\n\t      presented in writing by a party interested  in<br \/>\n\t      the notified land and must be presented within<br \/>\n\t      thirty  days after the date of publication  of<br \/>\n\t      the  notification\t under Section 4  or  within<br \/>\n\t      such period as may be fixed by the  Collector;\n<\/p><\/blockquote>\n<blockquote><p>\t      (b) it must allege some specific\tobjections,<br \/>\n\t      such as these ;\n<\/p><\/blockquote>\n<blockquote><p>\t      (i)   the notified purpose is not genuinely or<br \/>\n\t      properly a public purpose ;\n<\/p><\/blockquote>\n<blockquote><p>\t      (ii)  the\t land notified is not  suitable\t for<br \/>\n\t      the purpose for which it is notified;\n<\/p><\/blockquote>\n<blockquote><p>\t      (iii)the land is not so well suited as  other<br \/>\n\t      land;\n<\/p><\/blockquote>\n<blockquote><p>\t      (iv)  the area proposed is excessive;\n<\/p><\/blockquote>\n<blockquote><p>\t      (v)   the\t objector&#8217;s land has  been  selected<br \/>\n\t      maliciously or vexatiously;\n<\/p><\/blockquote>\n<blockquote><p>\t      (vi)  the\t acquisition will destroy or  impair<br \/>\n\t      the   amenity   of  historical   or   artistic<br \/>\n\t      monuments\t and places of public  resort;\twill<br \/>\n\t      take  away important public rights of  way  or<br \/>\n\t      other conveniences or will desecrate religious<br \/>\n\t      buildings, graveyard and the like.\n<\/p><\/blockquote>\n<blockquote><p>\t      3.After  admitting an objection and  after<br \/>\n\t      having  ,given the objector an opportunity  of<br \/>\n\t      being  heard either in person or\tby  pleader,<br \/>\n\t      the  Collector  shall  decide  whether  it  is<br \/>\n\t      desirable\t  to   hear  oral   or\t documentary<br \/>\n\t      evidence, which under Section 14 or Section 40<br \/>\n\t      of  the  Act, he has power to  call  for.\t  If<br \/>\n\t      evidence tendered by the objector is admitted,<br \/>\n\t      the  Collector  shall also  afford  the  other<br \/>\n\t      party an opportunity of rebutting it by  other<br \/>\n\t      evidence or of cross examining the witnesses :<br \/>\n\t      If he admits evidence, he will fix a time\t and<br \/>\n\t      place of hearing it-, and will hear and record<br \/>\n\t      it in, his proceedings.\n<\/p><\/blockquote>\n<blockquote><p>\t      4.Agents, other than pleaders, will not be<br \/>\n\t      allowed\tto  appear  on\tbehalf\tof   persons<br \/>\n\t      interested in any enquiry under Section 5-A of<br \/>\n\t      the Act.\n<\/p><\/blockquote>\n<blockquote><p>\t      5.After completing the record of evidence,<br \/>\n\t      the  Collector  shall submit  his\t report\t and<br \/>\n\t      recommendations as to each objection,  whether<br \/>\n\t      inadmissible  or admissible for the orders  of<br \/>\n\t      Government under Section 5A(2) of the Act.&#8221;\n<\/p><\/blockquote>\n<p>It seems to us that the rules have been complied with.\t The<br \/>\nappellant  was given an opportunity to be heard\t personally.<br \/>\nHe  ,chose  not to avail himself of that  opportunity.\t The<br \/>\nappellant<br \/>\n<span class=\"hidden_text\">298<\/span><br \/>\ncannot under these rules claim to cross-examine officers  of<br \/>\nthe  Corporation,  and in our opinion the prayer  to  cross-<br \/>\nexamine\t officers  was rightly rejected.  Indeed  it  was  a<br \/>\nstrange\t request.  The officers had not given  any  evidence<br \/>\nbefore\tthe Collector and were unable to see what  principle<br \/>\nentitles the appellant to claim this right.  When rules have<br \/>\nbeen  framed regulating the enquiry under Section 5A of\t the<br \/>\nLand  Acquisition  Act,\t it is\tnot  necessary\tto  consider<br \/>\nwhether the enquiry is administrative or quasi-judicial\t and<br \/>\nwhether\t rules of natural justice have been  complied  with,<br \/>\nand accordingly we say nothing on this point.<br \/>\nIn the result the appeal fails and is dismissed with costs.\n<\/p>\n<pre>V.P.S.\t\t\t\tAppeal dismissed-\n<span class=\"hidden_text\">299<\/span>\n\n\n\n<\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Parshottam Jadavji Jani vs State Of Gujarat &amp; Ors on 1 April, 1971 Equivalent citations: 1971 AIR 1188, 1971 SCR 294 Author: S Sikri Bench: Sikri, S.M.
