Justice K.T.SANKARAN\n\n Dated :26\/08\/2009\n\n O R D E R\n                         K.T.SANKARAN, J.\n                 ---------------------------------------------\n                        B.A.No.4818 of 2009\n                 ---------------------------------------------\n             Dated this the 26th day of August, 2009\n\n                               O R D E R\n<\/pre>\n<p>      This is an application for anticipatory bail under Section<\/p>\n<p>438 of the Code of Criminal Procedure.                    The petitioners are<\/p>\n<p>accused Nos.3 and 4 in Crime No.259 of 2009 of Erattupetta<\/p>\n<p>Police Station.\n<\/p>\n<p>     2.    The offences alleged against the accused are under<\/p>\n<p>Sections 15(c) of the Abkari Act and Sections 224, 225 and 353<\/p>\n<p>of the Indian Penal Code.\n<\/p>\n<p>     3.    The prosecution case is that the first accused, who is a<\/p>\n<p>toddy tapper, was selling toddy to accused Nos.2, 3 and 4 in a<\/p>\n<p>public place. On seeing the police party, the first accused ran<\/p>\n<p>away. Accused Nos.2, 3 and 4 were taken to custody by the<\/p>\n<p>police. But, pushing the police persons away, they escaped from<\/p>\n<p>the police jeep.\n<\/p>\n<p>     4.    Accused No.1 was granted anticipatory bail by the<\/p>\n<p>Sessions Court, Kottayam, as per the order dated 18th July 2009<\/p>\n<p>in Crl.M.P.No.1553 of 2009. As per the order dated 3-8-2009,<\/p>\n<p><span class=\"hidden_text\">BA 4818\/09                       2<\/span><\/p>\n<p>anticipatory bail was granted by this Court in favour of the 2nd<\/p>\n<p>accused.\n<\/p>\n<p>      5.   Taking into account the facts and circumstances of the<\/p>\n<p>case, the nature of the offence and other circumstances, I am of<\/p>\n<p>the view that anticipatory bail can be granted to the petitioners.<\/p>\n<p>      6. There will be a direction that in the event of the arrest of<\/p>\n<p>the petitioners, the officer in charge of the police station shall<\/p>\n<p>release them on bail on their executing bond for Rs.25,000\/-<\/p>\n<p>each with two solvent sureties for the like amount to the<\/p>\n<p>satisfaction of the officer concerned, subject to the following<\/p>\n<p>conditions:\n<\/p>\n<blockquote><p>      a)   The    petitioners   shall    report   before    the<br \/>\n           investigating officer between 9 A.M.       and 11<br \/>\n           A.M. on all Mondays, till the final report is filed<br \/>\n           or until further orders;\n<\/p><\/blockquote>\n<blockquote><p>      b)   The    petitioners   shall   appear    before    the<br \/>\n           investigating officer for interrogation as and<br \/>\n           when required;\n<\/p><\/blockquote>\n<blockquote><p>      c)   The petitioners shall not try to influence the<br \/>\n           prosecution witnesses or tamper with the<br \/>\n           evidence;\n<\/p><\/blockquote>\n<blockquote><p>      d)   The petitioners shall not commit any offence or<br \/>\n           indulge in any prejudicial activity while on bail;\n<\/p><\/blockquote>\n<blockquote><p>      e)   In case of breach of any of the conditions<br \/>\n           mentioned above, the bail shall be liable to be<br \/>\n           cancelled.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">BA 4818\/09                   3<\/span><\/p>\n<blockquote><p>          The Bail Application is allowed to the extent<br \/>\n          indicated above.<\/p><\/blockquote>\n<p>                                        K.T.SANKARAN,<br \/>\n                                            JUDGE<br \/>\nmn<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Tomy Joseph vs State Of Kerala on 26 August, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 4818 of 2009() 1.
