No. 18157 of 2002\n               =-=-=-=-=-=-=-=-=--=-=-=-=-=-=-=-=-=\n                 Dated this, the 17th September, 2009.\n\n                             J U D G M E N T\n<\/pre>\n<p>      In this original petition, the petitioners are challenging Ext. P3<\/p>\n<p>notification issued by the Government of Kerala under the Kerala<\/p>\n<p>Private Forests (Vesting and Assignment) Act, 1991 declaring that the<\/p>\n<p>properties mentioned in that notification, which included the<\/p>\n<p>petitioners&#8217; property, vest with the Government under the Act.<\/p>\n<p>      I am of opinion that the petitioners&#8217; remedy against the same<\/p>\n<p>lies in filing an original application before the Forest Tribunal<\/p>\n<p>concerned as provided in the Act itself. Therefore, without prejudice<\/p>\n<p>to that right, if the petitioners can still maintain such an O.A at this<\/p>\n<p>point of time, this original petition is dismissed.<\/p>\n<p>                                            Sd\/- S.
