SHAH\n\t\t\n\t\n\n \n\nDate\n: 14\/05\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tThe<br \/>\npresent Official Liquidator Report has been submitted by the<br \/>\napplicant   Official Liquidator of M\/s. Star of Gujarat Textile<br \/>\nMills Ltd. (In Liquidation). Pursuant to the order passed by this<br \/>\nCourt dated 22\/03\/2010, by which, the Official Liquidator was<br \/>\ndirected to place on record the status of the land of the Company (In<br \/>\nLiquidation) and the reasons as to why the land of the Company (In<br \/>\nLiquidation) is not sold so far. It is submitted that there was a<br \/>\nserious dispute with respect to area and boundary of the land of the<br \/>\nCompany (In Liquidation) and, therefore, it was decided by the Sale<br \/>\nCommittee to get further report from the GITCO about tenure and area<br \/>\nof the land of the Company (In Liquidation) and it is reported that<br \/>\nreport from the GITCO with respect to the status of the land, is<br \/>\nstill awaited. It is reported that in view of the above and in view<br \/>\nof the fact that HRP Suit No.97 of 1997 filed by the owners of the<br \/>\nremaining land of the Company is pending before the Small Causes<br \/>\nCourt at Ahmedabad, the Official Liquidator could not dispose of the<br \/>\nland of the Company (In Liquidation). It is submitted that it is not<br \/>\nclear as to whether the land where the Quarters \/ Chawls of the<br \/>\nCompany are situated, are on the land acquired under ULC Act or<br \/>\nLeasehold land or freehold land. These details will be available from<br \/>\nthe report of GITCO. It is submitted that as soon as the report is<br \/>\nsubmitted by GITCO, the appropriate necessary action with regard to<br \/>\nsale of land of the Company shall be initiated by the Official<br \/>\nLiquidator of the Company (In Liquidation).  The report from the<br \/>\nGITCO is awaited since long and despite various reminders inclusive<br \/>\nof last communication dated 13\/01\/2010. This Court passed an order to<br \/>\njoin the Manager, GITCO  as party respondent No.4 to appraise the<br \/>\nCourt as to when the GITCO is completing the work of demarkation<br \/>\npursuant to the communication dated 13\/01\/2010.\n<\/p>\n<p>\t\tIn<br \/>\nresponse to the order passed by this Court dated 05\/04\/2010,<br \/>\nMr.Girish P.Trivedi, Senior Consultant, GITCO is personally present<br \/>\nin the Court and has submitted that he has already completed survey<br \/>\nwork relating to fixation of boundary of the land area of M\/s Star of<br \/>\nGujarat Textile Mills Ltd. (In Liquidation) and has also collected<br \/>\ndetails of the land area and the related sketch from the Town<br \/>\nPlanning Officer and he has tried to match sketch with the<br \/>\nsurvey-sheet, but, both do not match with each other and they have<br \/>\nalready approached the Drawing Branch, Ahmedabad Municipal<br \/>\nCorporation to provide relevant data so that the boundary can be<br \/>\nascertained. It is submitted that on receiving the data from the<br \/>\nDrawing Branch, Ahmedabad Municipal Corporation, there shall be<br \/>\nfixation of boundaries of the land of the Company (In Liquidation).\n<\/p>\n<p>2.\t\tIn<br \/>\nview of the above, this Court requested Mr.R.M.Chhaya, learned<br \/>\nadvocate appearing on behalf of the Ahmedabad Municipal Corporation<br \/>\nto assist the Court and get information from the concerned Department<br \/>\nwhen they will supply the relevant data to the GITCO so that the<br \/>\nboundary can be ascertained by the GITCO. Today when the present<br \/>\nOfficial Liquidator Report is taken up for hearing, Mr.Chhaya,<br \/>\nlearned advocate appearing on behalf of the Ahmedabad Municipal<br \/>\nCorporation has submitted that by communication dated 13\/05\/2010 the<br \/>\nEstate Officer of the Ahmedabad Municipal Corporation has submitted<br \/>\nthe Site Survey Map of the land of the Company (In Liquidation).\n<\/p>\n<p>3.\t\tIn<br \/>\nview of the above, now GITCO is required to complete the work of<br \/>\ndemarcation of the land of the Company (In liquidation) and send it<br \/>\nto the Official Liquidator. Under the circumstances, the present<br \/>\nOfficial Liquidator Report is disposed of by directing the Official<br \/>\nLiquidator of the Company (In Liquidation) to get necessary report of<br \/>\ndemarkation from the GITCO at the earliest and to submit the report<br \/>\nbefore this Court and to proceed further with sell of the land of the<br \/>\nCompany (In Liquidation) at the earliest and to get Valuation Report<br \/>\nfrom the approved Valuer within a period of three weeks from the date<br \/>\nof receipt of the report from the GITCO and to submit appropriate<br \/>\nreport before this Court for fixation of upset price, etc. <\/p>\n<p>\t\tWith<br \/>\nthis, the present Official Liquidator Report is disposed of.\n<\/p>\n<p>[M.R.SHAH,J]<\/p>\n<p>*dipti<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court O.L.Of vs Central on 14 May, 2010 Author: M.R.
