He further contended that the suit filed by the plaintiff &#8211;<br \/>\nrespondent is not maintainable in law as no cause of action has taken<br \/>\nplace within the territorial jurisdiction of the Court and in that<br \/>\nevent the amendment application ought not to have been granted by the<br \/>\nCourt below. He has placed reliance on the following decisions of the<br \/>\nHon&#8217;ble Apex Court and submitted that the order of the Court below<br \/>\nallowing amendment application may be quashed and set aside as the<br \/>\nsame would change the nature of suit.\n<\/p>\n<p>AIR<br \/>\n\t2008 SC 3123 in case of Dabur India Ltd. Vs. K R Industries.\n<\/p>\n<p>2006(1)<br \/>\n\tCPMR P1 (SC) in case of S K Maing with Patel Field Marshal<br \/>\n\tIndustries And Others Vs. P.M. Diesel Ltd.\n<\/p>\n<p><span class=\"hidden_text\">2010<\/span><\/p>\n<p>\t(44) PTC 520 (Del.)(DB) in case of Archie Comic Publications Inc.<br \/>\n\tVs. Purple Creations Pvt Ltd. &amp; Ors.\n<\/p>\n<p><span class=\"hidden_text\">2008<\/span><\/p>\n<p>\t(36) PTC 558(Guj.) in case of Bhandari Products, A Proprietory<br \/>\n\tConcern Vs. Giriraj Enterprise.\n<\/p>\n<p>3.\t\tHaving<br \/>\nheard the learned Advocate for the petitioner and having perused the<br \/>\nimpugned order of the Court below is just and proper.  The Court<br \/>\nbelow has rightly observed in paragraph No.6 and 7 that if the<br \/>\namendment application is granted the nature of suit will not be<br \/>\nchanged and it will be helpful in adjudicating the issue effectively.<br \/>\nIt has been rightly held by the Court below that to avoid the<br \/>\nmultiplicity of proceedings, the amendment can be allowed. I am in<br \/>\ncomplete agreement with the view taken by the Court below.\n<\/p>\n<p>3.1\t\tSo<br \/>\nfar as the decisions upon which the learned Advocate for the<br \/>\npetitioner has relied upon, it deserves to be noted that the<br \/>\namendment application after the subsequent event has been made to<br \/>\ndecide the suit effectively and to avoid the multiplicity of<br \/>\nproceedings.
