JOSEPH, J.\n\n             ````````````````````````````````````````````````````\n                   W.P.(C) No. 33901 OF 2008 J\n             ````````````````````````````````````````````````````\n             Dated this the 28th day of January, 2009\n\n                           J U D G M E N T\n<\/pre>\n<p>            Petitioner challenges Exts.P5 and P10 and seeks a<\/p>\n<p>direction to pass fresh orders on Ext.P1 after considering all the<\/p>\n<p>grounds raised in Ext.P1 appeal. Further ancillary prayers are<\/p>\n<p>also raised.\n<\/p>\n<p>      2.    Case of the petitioner in brief is as follows.<\/p>\n<p>      Petitioner is a small scale industry which applied for<\/p>\n<p>exemption from payment of sales tax under the provisions of SRO<\/p>\n<p>1729\/1993. The 5th respondent, namely, the General Manager,<\/p>\n<p>District Industries Centre, Palakkad, rejected the application. The<\/p>\n<p>petitioner preferred appeal to the 2nd respondent, State Level<\/p>\n<p>committee for Exemption of Sales Tax. The appeal was allowed<\/p>\n<p>and the matter was remitted back to the 5th respondent. The 5th<\/p>\n<p>respondent again rejected the application.                  Thereafter, the<\/p>\n<p>petitioner preferred Ext.P1 appeal which has been rejected by<\/p>\n<p>Ext.P10 by the 2nd respondent.\n<\/p>\n<p>WPC.33901\/08<br \/>\n<span class=\"hidden_text\">                                   : 2 :<\/span><\/p>\n<p>       3.   The petitioner is a company incorporated under the<\/p>\n<p>Companies Act, 1956, for the purpose of establishing, operating<\/p>\n<p>LPG bottling plants and sale of LPG cylinders and other functions.<\/p>\n<p>It is the case of the petitioner that hearing of Ext.P1 appeal was<\/p>\n<p>scheduled on 6.3.2006 and the petitioner was notified by Ext.P3.<\/p>\n<p>It is stated that the counsel was out of station and, therefore, the<\/p>\n<p>petitioner sought for an adjournment and the request was made<\/p>\n<p>through Ext.P4 letter. It is thereafter that the petitioner came to<\/p>\n<p>know about Ext.P10 order passed on Ext.P1 appeal after filing the<\/p>\n<p>writ petition. A counter affidavit is filed to which a reply affidavit is<\/p>\n<p>filed.\n<\/p>\n<p>       4.   I heard learned counsel for the petitioner and learned<\/p>\n<p>Government Pleader. It is contended that the finding that there is<\/p>\n<p>no manufacture involved is absolutely unsustainable. He would<\/p>\n<p>point out that actually the process involved in the case satisfied<\/p>\n<p>the requirement of the definition of the word &#8216;manufacture&#8217; in the<\/p>\n<p>notification. &#8216;Manufacture&#8217; has been defined as follows in clause 1<\/p>\n<p>(ix) of SRO 1729\/93:\n<\/p>\n<p>                   &#8221; &#8216;Manufacture&#8217; shall mean the use of raw<\/p>\n<p>            materials and production of goods commercially<\/p>\n<p>WPC.33901\/08<br \/>\n<span class=\"hidden_text\">                                  : 3 :<\/span><\/p>\n<p>           different from the raw materials used but shall<\/p>\n<p>           not include mere packing of goods, polishing,<\/p>\n<p>           cleaning, grading, drying, blending or mixing<\/p>\n<p>           different varieties of the same goods, sawing,<\/p>\n<p>           garbling, processing one form of goods not<\/p>\n<p>           another form of the same goods by mixing with<\/p>\n<p>           chemicals or gas fumigation or any other<\/p>\n<p>           process applied for preserving the goods in good<\/p>\n<p>           condition or for easy transportation.           The<\/p>\n<p>           process of producing desiccated coconut out of<\/p>\n<p>           coconut shall be deemed to be &#8216;manufacture&#8217; for<\/p>\n<p>           the purpose of this notification.\n<\/p>\n<p>           The following processes shall not be deemed to<\/p>\n<p>           be &#8216;manufacture&#8217; for the purpose of this<\/p>\n<p>           notification.\n<\/p>\n<p>           (a) Crushing copra and producing coconut oil<\/p>\n<p>           and coconut oil cake.\n<\/p>\n<p>           (b) Converting timber logs into timber sizes.<\/p>\n<p>           (c) Crushing rubble into small metal pieces.<\/p>\n<p>           (d) Converting sodium silicate into liquid silicate.<\/p>\n<p>           (e) Tyre-retreading.\n<\/p>\n<p>           (f) Cutting granite or marble slabs into smaller<\/p>\n<p>           pieces and\/or polishing them.\n<\/p>\n<p>           (g) Such other processes as may be notified by<\/p>\n<p>           Government in this behalf. &#8221;\n<\/p>\n<p>     The process &#8216;manufacture&#8217; has been detailed in the appeal<\/p>\n<p>memorandum. Paragraphs 6 and 7 would appear to be devoted to<\/p>\n<p>WPC.33901\/08<br \/>\n<span class=\"hidden_text\">                                   : 4 :<\/span><\/p>\n<p>the process involved and it is extracted as hereunder.<\/p>\n<blockquote><p>                  &#8220;6.     Without prejudice to the above<\/p>\n<p>           submissions, it is submitted that the process of<\/p>\n<p>           bottling LPG is not mere packing. The petitioner<\/p>\n<p>           purchases bulk quantity of LPG from oil<\/p>\n<p>           refineries and LPG importers and transports it in<\/p>\n<p>           tanker lorries to its factory.      The same is<\/p>\n<p>           unloaded and stored in large storage tanks and<\/p>\n<p>           thereafter filled into smaller cylinders. This is a<\/p>\n<p>           complex process, which involves expertise and<\/p>\n<p>           special knowledge, especially the process of<\/p>\n<p>           purging of Oxygen from the Cylinder by pumping<\/p>\n<p>           in Nitrogen and thereafter decanting Nitrogen to<\/p>\n<p>           fill LPG under strict controls of the parameters<\/p>\n<p>           like pressure and0. temperature. Moreover, the<\/p>\n<p>           Gas Cylinder Rules, 1981, which was formulated<\/p>\n<p>           under the Explosive Act, 1994, which is an Act to<\/p>\n<p>           regulate the manufacture, possession, use, sale,<\/p>\n<p>           etc. of explosive material, defines manufacture<\/p>\n<p>           of gas in Rule 2(xxv) as filling of a cylinder with<\/p>\n<p>           any compressed gas and also includes transfer<\/p>\n<p>           of compressed gas from one cylinder to any<\/p>\n<p>           other cylinder.     Similarly Section 4(h) of the<\/p>\n<p>           Explosive Act also gives a definition for the word<\/p>\n<p>           &#8216;manufacture&#8217; in the same lines. Similarly even<\/p>\n<p>           the     word     &#8216;manufacture&#8217;     expressed     in<\/p>\n<p>           SRO.1729\/93 means the use of raw materials<\/p>\n<p>           and production of goods commercially different<\/p>\n<p>WPC.33901\/08<br \/>\n<span class=\"hidden_text\">                                  : 5 :<\/span><\/p>\n<p>           from the raw materials. The submissions made<\/p>\n<p>           in the preceding paragraph will definitely show<\/p>\n<p>           that the bottling of LPG is not mere packing.<\/p>\n<\/blockquote>\n<blockquote><p>                 7. Now the next question is whether there<\/p>\n<p>           an emergence of any goods during the<\/p>\n<p>           manufacture, which is commercially different<\/p>\n<p>           from the raw materials. The process of bottling<\/p>\n<p>           LPG has not been deemed as packing of LPG<\/p>\n<p>           under the KGST Act.          Entry 91 of the 1st<\/p>\n<p>           Schedule of the KGST Act and SRO.405\/94<\/p>\n<p>           which gives details of various packing materials<\/p>\n<p>           for commodities does not include the Steel<\/p>\n<p>           Cylinder for LPG in the said list. LPG is listed<\/p>\n<p>           under Item 97 (VI) of the 1st Schedule. As no<\/p>\n<p>           packing is specified in LPG under Item 97 (VI) or<\/p>\n<p>           Item 91 of the 1st Schedule, it can only be<\/p>\n<p>           presumed that LPG under the 1st Schedule is the<\/p>\n<p>           commercial product LPG and not the bulk LPG.<\/p><\/blockquote>\n<p>           Bulk LPG has to be processed and bottled to<\/p>\n<p>           make it suitable for domestic and commercial<\/p>\n<p>           use. Hence by no product substantially different<\/p>\n<p>           from LPG obtained in the process of refining of<\/p>\n<p>           petroleum.     It has been held by the Hon&#8217;ble<\/p>\n<p>           Supreme court as well as various High Courts,<\/p>\n<p>           including the Kerala High Court it is the<\/p>\n<p>           marketability of the product that attracts the<\/p>\n<p>           incidence of tax. From the foregoing paragraph<\/p>\n<p>           it can be seen that the process of bottling LPG<\/p>\n<p>WPC.33901\/08<br \/>\n<span class=\"hidden_text\">                                   : 6 :<\/span><\/p>\n<p>            has every characteristic of a manufacturing<\/p>\n<p>            process and has to be rightly classified as<\/p>\n<p>            &#8216;manufacture&#8217; for the purpose of SRO.1729\/93.&#8221;<\/p>\n<p>      It is stated that there is manufacture and he would submit<\/p>\n<p>that this court should discourage this sort of approach to the<\/p>\n<p>matter by the State Level Committee. He would submit that under<\/p>\n<p>the Explosive Rules, it is treated as manufacture. It is also stated<\/p>\n<p>that bottling of LPG was a regulated industrial activity and covered<\/p>\n<p>with the first Schedule of the Industries (Development and<\/p>\n<p>Regulation) Act, 1951 and licence under the Act was necessary till<\/p>\n<p>1994.     It is also pointed out that in Karnataka and Andhra<\/p>\n<p>Pradesh, it is being treated as manufacture. It is also pointed out<\/p>\n<p>that a new commercially different product emerges in this process.<\/p>\n<p>      5.    Per     contra,      learned     Government      Pleader<\/p>\n<p>Sri.C.K.Govindan would submit that it is a clear case where<\/p>\n<p>absolutely no manufacture is involved. LPG remained as LPG<\/p>\n<p>even after process undertaken by the petitioner is completed. It is<\/p>\n<p>further pointed out that actually it would amount to packaging and<\/p>\n<p>no new commercial product emerged.\n<\/p>\n<p>      6.    There can be no doubt that the question as to whether<\/p>\n<p>WPC.33901\/08<br \/>\n<span class=\"hidden_text\">                                  : 7 :<\/span><\/p>\n<p>it is manufacture or not to be answered with reference to the terms<\/p>\n<p>of the definition of the word &#8216;manufacture&#8217; in the notification. On a<\/p>\n<p>perusal of the definition, there are three crucial elements involved<\/p>\n<p>in manufacture as defined. In the first place, there must be raw<\/p>\n<p>materials. Secondly, there must be production and lastly, what is<\/p>\n<p>produced must be commercially different product. Applying these<\/p>\n<p>three tests to the process undertaken in the petitioner&#8217;s factory, I<\/p>\n<p>am of the firm view that it cannot be said that there is any<\/p>\n<p>manufacture involved.      It is not in dispute that what was LPG<\/p>\n<p>continues to be LPG.       In other words, the product which was<\/p>\n<p>present in bulk form is put into smaller form and thereafter it is<\/p>\n<p>sold in the end consumer. In this process, what is involved is<\/p>\n<p>stated by the petitioner itself in its appeal memorandum which I<\/p>\n<p>have already extracted. A perusal of the same would clearly show<\/p>\n<p>that the petitioner specifically admits that LPG is purchased in bulk<\/p>\n<p>from oil refineries and LPG importers and transports it in tanker<\/p>\n<p>lorries to its factory. It is unloaded and stored in large storage<\/p>\n<p>tanks and later filled into smaller cylinders. This is the process<\/p>\n<p>which is involved. Therefore, there is no dispute that what is filled<\/p>\n<p>WPC.33901\/08<br \/>\n<span class=\"hidden_text\">                                 : 8 :<\/span><\/p>\n<p>into the smaller cylinders continues to be LPG. There is no case<\/p>\n<p>that there is any chemical change in the product. What is stated<\/p>\n<p>as a complex process involving skill and special knowledge is as<\/p>\n<p>follows.   Oxygen is purged from the cylinder by pumping in<\/p>\n<p>Nitrogen and thereafter decanting Nitrogen to fill LPG under strict<\/p>\n<p>control of the parameters like pressure and temperature. This is<\/p>\n<p>the complex process which is adverted to. This process, in my<\/p>\n<p>view, is apparently undertaken for the purpose of filling the small<\/p>\n<p>cylinders with LPG. In other words, what is brought in bulk is<\/p>\n<p>transferred into small cylinders and for carrying out this process,<\/p>\n<p>purging of Oxygen from the cylinder by pumping in Nitrogen and<\/p>\n<p>subsequently decanting Nitrogen under the strict control of the<\/p>\n<p>parameters like pressure and temperature is undertaken. By no<\/p>\n<p>stretch of imagination, can it be said that this involves production<\/p>\n<p>of a commercially different article. What was LPG remains LPG in<\/p>\n<p>smaller cylinders. Learned counsel for the petitioner relied on the<\/p>\n<p>decision reported in Deputy Commissioner of Sales Tax (Law),<\/p>\n<p>Board of Revenue(Taxes), Ernakulam Vs. M\/s.Coco Fibres<\/p>\n<p>[1992 Supp. (1) SCC 290].            Therein, the apex court was<\/p>\n<p>WPC.33901\/08<br \/>\n<span class=\"hidden_text\">                                 : 9 :<\/span><\/p>\n<p>considering whether making of coconut fibre from husk involves<\/p>\n<p>any manufacturing process.       The court proceeded to hold as<\/p>\n<p>follows:\n<\/p>\n<blockquote><p>                 &#8221;  In view of the admitted position that<\/p>\n<p>          green husk is soaked into saltish sea water for<\/p>\n<p>          days together and after decomposition, on being<\/p>\n<p>          subjected to beating either by manual or<\/p>\n<p>          mechanical process, fibre is produced in the<\/p>\n<p>          process, which is a distinct commodity known in<\/p>\n<p>          the commercial parlance. No one in the market<\/p>\n<p>          would sell or supply husk when fibre is asked for.<\/p>\n<p>          Accordingly, it must be held that the coconut fibre<\/p>\n<p>          is commercially a different identifiable commodity<\/p>\n<p>          known as such in the commercial parlance.&#8221;<\/p><\/blockquote>\n<p>     7.    It is noted, in the facts of this case, that there is no<\/p>\n<p>case that what is marketed is a product different from LPG.<\/p>\n<p>     8.    No doubt,     learned counsel for the petitioner would<\/p>\n<p>submit that the process involved by the petitioner satisfies the<\/p>\n<p>requirement of the manufacture as what emerges is a<\/p>\n<p>commercially different article. I feel that there is no merit in the<\/p>\n<p>said contention. In the first place, the said contention overlooks<\/p>\n<p>the indispensable requirement of manufacture as defined in the<\/p>\n<p>Clause as already noted that there must be raw material and an<\/p>\n<p>WPC.33901\/08<br \/>\n<span class=\"hidden_text\">                                   : 10 :<\/span><\/p>\n<p>act of production and the product being commercially different. It<\/p>\n<p>may be true that to reach it to the end consumer it has to be<\/p>\n<p>packed into smaller cylinders. It may be necessary for marketing it<\/p>\n<p>to the end consumer. I am not able to find out as to what are the<\/p>\n<p>raw materials from which this LPG is made. In other words, LPG<\/p>\n<p>is transferred from bulk quantity into smaller cylinders. There is no<\/p>\n<p>raw materials as such from which a product is made which can be<\/p>\n<p>said to be commercially different. Apparently, the makers of the<\/p>\n<p>notification intended to promote manufacturing activity within the<\/p>\n<p>State. It has expressed its clear intention not to extend the benefit<\/p>\n<p>to activities like packaging as the definition shows. As already<\/p>\n<p>noted, there is no production of a commercially different article<\/p>\n<p>from a different raw material and LPG remains as LPG after the<\/p>\n<p>entire process is over.
