In \u00a0 pursuance \u00a0 of \u00a0 Commission&#8217;s \u00a0 order \u00a0 dated\u00a0<br \/>\n12.5.2011, \u00a0 CPIO \u00a0 appeared \u00a0 before \u00a0 the \u00a0 Commission \u00a0 to\u00a0<br \/>\nexplain \u00a0 the \u00a0 circumstances \u00a0 which \u00a0 led \u00a0 to \u00a0 denial \u00a0 of\u00a0<br \/>\ndisclosure\u00a0of\u00a0information\u00a0to\u00a0the\u00a0appellant\u00a0under\u00a0the\u00a0<br \/>\nprovisions \u00a0 of \u00a0 Section \u00a0 8(1)(h), \u00a0 \u00a0 even \u00a0 though \u00a0 as \u00a0 per\u00a0<br \/>\nthe \u00a0 averments \u00a0 of \u00a0 the \u00a0 appellant, \u00a0 the \u00a0 disciplinary\u00a0<br \/>\nproceedings \u00a0 had \u00a0 been \u00a0 completed, \u00a0 final \u00a0 orders \u00a0 passed\u00a0<br \/>\nand\u00a0penalty\u00a0awarded\u00a0to\u00a0the\u00a0appellant\u00a0well\u00a0before\u00a0the\u00a0<br \/>\norders\u00a0of\u00a0the\u00a0CPIO.\n<\/p>\n<p>2.   The \u00a0 First \u00a0 Appellate \u00a0 Authority \u00a0 has \u00a0 also \u00a0 \u00a0 some\u00a0<br \/>\nwritten \u00a0 submissions \u00a0 in \u00a0 this \u00a0 matter \u00a0 and \u00a0 was \u00a0 also\u00a0<br \/>\npresent\u00a0at\u00a0the\u00a0hearing\u00a0today.\u00a0\u00a0\n<\/p>\n<p>3.\u00a0 CPIO \u00a0 has \u00a0 stated \u00a0 that \u00a0 the \u00a0 appellant \u00a0 is \u00a0 a \u00a0 former\u00a0<br \/>\nemployee \u00a0of\u00a0Chandigarh \u00a0 Administration \u00a0and\u00a0during \u00a0 his\u00a0<br \/>\nservice, \u00a0 was \u00a0 issued \u00a0 various \u00a0 charge\u00adsheets \u00a0 in\u00a0<br \/>\ndepartmental \u00a0 proceedings \u00a0 besides \u00a0 registration \u00a0 of\u00a0<br \/>\nserious\u00a0criminal\u00a0cases\u00a0against\u00a0him\u00a0(details\u00a0of\u00a0these\u00a0<br \/>\ncases \u00a0 are \u00a0 provided \u00a0 in \u00a0 the \u00a0 written \u00a0 submission).\u00a0<br \/>\nTherefore, \u00a0 keeping \u00a0 in \u00a0 view \u00a0 the \u00a0 background \u00a0 of \u00a0 the\u00a0<br \/>\nappellant, \u00a0 who\u00a0was\u00a0 involved \u00a0in\u00a0 criminal \u00a0intimidation\u00a0<br \/>\nand \u00a0 launching \u00a0 of \u00a0 physical \u00a0 attack, \u00a0 the \u00a0 CPIO, \u00a0 in \u00a0 his\u00a0<br \/>\nbest\u00a0judgement,\u00a0invoke\u00a0the\u00a0provisions\u00a0of\u00a0Section\u00a08(1)\n<\/p>\n<p>(g) \u00a0 in \u00a0 denying \u00a0 the \u00a0 information \u00a0 to \u00a0 the \u00a0 appellant.\u00a0<br \/>\nThese \u00a0facts \u00a0were \u00a0also \u00a0in\u00a0the\u00a0 knowledge \u00a0 of\u00a0the\u00a0First\u00a0<br \/>\nAppellate \u00a0 Authority, \u00a0 who, \u00a0 therefore, \u00a0 up\u00adheld \u00a0 the\u00a0<br \/>\norder\u00a0of\u00a0the\u00a0CPIO\u00a0after\u00a0exercising\u00a0her\u00a0best\u00a0judgement\u00a0<br \/>\nin\u00a0the\u00a0given\u00a0situation.\u00a0\u00a0It\u00a0is\u00a0noted\u00a0that\u00a0these\u00a0facts\u00a0<br \/>\n                \u00a0\u00a0\u00a0Adjunct\u00a0to\u00a0Appeal\u00a0:\u00a0No.\u00a0CIC\/DS\/A\/2011\/000220\u00a0\u00a0<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>were\u00a0not\u00a0brought\u00a0before\u00a0the\u00a0Commission\u00a0at\u00a0the\u00a0hearing\u00a0<br \/>\nheld\u00a0on\u00a012.5.2011,\u00a0which\u00a0should\u00a0have\u00a0been\u00a0done\u00a0by\u00a0the\u00a0<br \/>\nCPIO \u00a0 who \u00a0 represented \u00a0 the \u00a0 Public \u00a0 Authority \u00a0 at \u00a0 the\u00a0<br \/>\nhearing.\u00a0\n<\/p>\n<p>                        DECISION\u00a0NOTICE<\/p>\n<p>4.     After \u00a0 hearing \u00a0 the \u00a0 arguments \u00a0 presented \u00a0 by \u00a0 the\u00a0<br \/>\nCPIO \u00a0 and \u00a0 after \u00a0 perusing \u00a0 the \u00a0 written \u00a0 submissions \u00a0 of\u00a0<br \/>\nthe \u00a0 First \u00a0 Appellate \u00a0 Authority, \u00a0 the \u00a0 Commission \u00a0 is\u00a0<br \/>\nsatisfied \u00a0 with \u00a0 the \u00a0 explanation \u00a0 that \u00a0 in \u00a0 view \u00a0 of \u00a0 the\u00a0<br \/>\nreputation\u00a0and\u00a0past\u00a0behaviour\u00a0of\u00a0the\u00a0appellant,\u00a0which\u00a0<br \/>\nis \u00a0 substantiated \u00a0 by \u00a0 providing \u00a0 details \u00a0 of \u00a0 the \u00a0 cases\u00a0<br \/>\nregistered \u00a0 against \u00a0 the \u00a0 appellant, \u00a0 the \u00a0 CPIO \u00a0 and \u00a0 the\u00a0<br \/>\nFirst \u00a0 Appellate \u00a0 Authority \u00a0 had, \u00a0 in \u00a0 their \u00a0 best\u00a0<br \/>\njudgement,\u00a0taken\u00a0the\u00a0decision\u00a0to\u00a0deny\u00a0the\u00a0disclosure\u00a0<br \/>\nof\u00a0information\u00a0under\u00a0the\u00a0provisions\u00a0of\u00a0 \u00a0Section\u00a08(1)\n<\/p>\n<p>(h) \u00a0 and \u00a0 8(1)(g) \u00a0 of \u00a0 the \u00a0 Act. \u00a0 \u00a0 The \u00a0 Commission,\u00a0<br \/>\ntherefore, \u00a0 drops \u00a0 the \u00a0 proposed \u00a0 penalty \u00a0 proceedings\u00a0<br \/>\nagainst \u00a0 the \u00a0 CPIO \u00a0 and \u00a0 also \u00a0 having \u00a0 considered \u00a0 afresh\u00a0<br \/>\nthe \u00a0case\u00a0 in\u00a0the\u00a0light \u00a0of\u00a0 the\u00a0facts \u00a0presented \u00a0before\u00a0<br \/>\nthe \u00a0 Commission \u00a0 today, \u00a0 withdraws \u00a0 its \u00a0 recommendations\u00a0<br \/>\nto \u00a0 the \u00a0 controlling \u00a0 authority \u00a0 to \u00a0 issue \u00a0 memo \u00a0 of\u00a0<br \/>\nstricture\u00a0to\u00a0the\u00a0First\u00a0Appellate\u00a0Authority\u00a0for\u00a0lapse\u00a0<br \/>\nin \u00a0 discharging \u00a0 her \u00a0 duties \u00a0 as \u00a0 mandated \u00a0 under \u00a0 the \u00a0 RTI\u00a0<br \/>\nAct.\u00a0 \u00a0The\u00a0respondent\u00a0has\u00a0confirmed\u00a0that\u00a0on\u00a0the\u00a0basis\u00a0<br \/>\nof \u00a0 the \u00a0 Commission&#8217;s \u00a0 previous \u00a0 order, \u00a0 he \u00a0 has \u00a0 already\u00a0<br \/>\nreceived \u00a0 the \u00a0 information \u00a0 requested \u00a0 by \u00a0 him. \u00a0 \u00a0 No\u00a0<br \/>\nfurther\u00a0action\u00a0is\u00a0required\u00a0to\u00a0be\u00a0taken.\u00a0 \u00a0The\u00a0case\u00a0is\u00a0<br \/>\nclosed.\u00a0\n<\/p>\n<p>\u00a0<\/p>\n<p>                                       (Smt.\u00a0Deepak\u00a0Sandhu)<br \/>\n                              Information\u00a0Commissioner\u00a0(DS)<br \/>\nAuthenticated\u00a0true\u00a0copy:\n<\/p>\n<p>(T.\u00a0K.\u00a0Mohapatra)<br \/>\nUnder\u00a0Secretary\u00a0&amp;\u00a0Dy.\u00a0Registrar<br \/>\n\u00a0<br \/>\nCopy\u00a0to:\u00ad<\/p>\n<p>1.
