The appellant Insurance Company “calledii~.jn”~r<\/p>\n
question the judgment and award\u00b0–dated  SMVC
\nNo.63-4\/1993. The Tribunaxl afteriliaiiiarding thieicornlpensation
\nof Rs.I,98,600\/– with inlterest held that the
\nappellanblnsurancegj  of the vehicle<\/p>\n

3;; ii ‘In fact;-.on_____hearing the learned Counsel for the<\/p>\n
ll’-appellant  perusing the appeal papers including the records<\/p>\n
receivledp\u00abfrorrltheTribunal, the fact relating to the accident and<\/p>\n
V V the death ‘tlheieafter is not in dispute. The only question for<\/p>\n
4ii”lv.lic*oghsidreration is as to Whether the appellant–Insurance<\/p>\n
l_lCorr:_pa1i’j\/ could have been made liable to reimburse the<\/p>\n
dcornpensation in the facts and circumstances arising in the<\/p>\n
:\u00a7_\u00a7;*-e’\u00a7–\u00abMW<\/p>\n
instant case. The pleadings of the claimant in the claim petition
\nwould indicate that there is no dispute that the deceased was<\/p>\n
travelling in a goods tempo bearing No.KA~23-2955. vffihielyfact<\/p>\n
which is also evident is that the deceased is not tleic-.ien*i_ployee.<\/p>\n
of the insured but was employee working in    <\/p>\n
his place of work the deceased had u{z;t{};\u00e9iiec: ..in._thie <\/p>\n
which met with an accident.\n<\/p>\n
4. The appellant~Insur_aVncVe  contended
\nbefore the Tribunal that*–.._they’i._are’notflriable for payment of
\ncompensation since thereA.is..y_io.1a’t–ion oi”t.h’\u00a2’*5er’:ns of the police
\neven though the  qiiiestioniwas”covered by the policy.
\nIn so fari_as–.the  thlatrthe Vehicle in question is a goods<\/p>\n
Vehicle and”rt_hat_  was not the employee of the<\/p>\n
 insured and also”th.at the deceased was not accompanying any<\/p>\n
 goods in the Vdehvicle is evident from the very discussion made<\/p>\n
  the evidence tendered. Therefore, the fact<\/p>\n
V is clear that the deceased was unauthorised passenger in the<\/p>\n
it ‘ ‘-Vyehicle.\n<\/p>\n<\/p>\n
5. The Tribunal, in fact, after having accepted these
\naspects of the matter has thereafter proceeded to hold the
\ninsurance company liable only by noticing the fact that the<\/p>\n
insurance company had. not proved that the deceasvedylrazgs a<\/p>\n
fare paying passenger in the vehicle. The Tribun_a’l”i’n-\u00ablfastilizas _<\/p>\n
made specific reference that the 131 respondent.in.y.si;redi.:had I’1l3lL” .. <\/p>\n
been examined to state as to whelthertighje llpersonlwhio was<\/p>\n
travelling was a fare paying pass_enger}’g_T’hus, th’leATVribun;al.cn”‘xg<\/p>\n
coming to the said conclusion noticed’ that ‘thellnsurance
\nCompany has collected  sum  Rs;’5.Q\/\u00a5’aS premium towards<\/p>\n
non-fare paying passengers  and has held<\/p>\n
since extra  collected in respect of non–fare
\npaying passenger;  Insurance Company is liable to
\npay compensation. _ <\/p>\n
.,  In this regard, it is to be stated that the said term<\/p>\n
 thellllthell_:present case would not be applicable for the<\/p>\n
reason,  not at all the case of the claimants that the<\/p>\n
  ‘d.eceaseCiyVWias accompanying the goods in the vehicle. In that<\/p>\n
  “circumstance, when it is established that the vehicle itself was<\/p>\n
 l\ufb02goo\ufb01ds Vehicle the question of any passengers travelling in the<\/p>\n
