PATTANAIK (J)\n\nCITATION:\n 1996 SCALE  (5)567\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     This appeal  by special  leave arises against the order<br \/>\nof the\tHigh Court of Allahabad made on February 22, 1980 in<br \/>\nW.P. No.6667  of 1978.\tThe finding,  as a fact, recorded by<br \/>\nboth the  Tribunals under  the U.P. Imposition of Ceiling on<br \/>\nLand Holdings  Act is  that the\t appellant had\tcut Out\t the<br \/>\nexisting trees\tas on  January\t24,  1971  and\tplanted\t new<br \/>\ntree.On that  premise, the question arose: whether the trees<br \/>\nplanted by  the appellant  would be  a grove land within the<br \/>\nmeaning of Section 23 [8] of the Act which reads as under:\n<\/p>\n<blockquote><p>     [8] &#8220;grove land&#8221; means any specific<br \/>\n     piece of  land in\ta holding having<br \/>\n     trees not including [Guava, Papaya,<br \/>\n     banana  or\t  vine\tplants]\t planted<br \/>\n     thereon before January 24, 1971, in<br \/>\n     such numbers that they preclude, or<br \/>\n     when full\tgrown will preclude, the<br \/>\n     land or  any  considerable\t portion<br \/>\n     thereof from  being used  primarily<br \/>\n     for  any  other  purpose,\tand  the<br \/>\n     threes on\tsuch land  constitute  a<br \/>\n     grove&#8221;.<\/p><\/blockquote>\n<p>     A\treading\t  thereof   clearly   indicates\t  that\t the<br \/>\nLegislature has\t put a cut off date for existing trees as on<br \/>\nJanuary 24,  1971 except  the Guava,  Papaya, Banana or vine<br \/>\nplants\tplanted\t before\t that  date.  In  other\t words,\t the<br \/>\nLegislature has indicated that any grove existing as on that<br \/>\ndate with  fully grown\ttrees would  be the grove except the<br \/>\nexcepted trees\tand for the purpose of the Act. By necessary<br \/>\nimplication any\t tree planted  after that date cannot be the<br \/>\ngrove land  under the  Act. Though  the contention  of\tShri<br \/>\nPramod Swarup,\tlearned counsel\t for the  appellant that  in<br \/>\nplace  of  fallen  trees  some\tnew  trees  were  grown,  is<br \/>\nplausible, we cannot give acceptance to the contention since<br \/>\nthe Legislature\t has specifically put a date of the existing<br \/>\ntrees, viz.,  January 24,  1971. under\tthese circumstances,<br \/>\nthe view  taken by  the High  Court cannot  be\tsaid  to  be<br \/>\nunwarranted.\n<\/p>\n<p>     The appeal is dismissed.
