NO. 1303 OF 2009\n            = = = = = = = = = = = = = = =\n       Dated this the 28th day of January, 2010.\n\n                      J U D G M E N T\n<\/pre>\n<p>     This appeal is preferred against the award of the Motor<\/p>\n<p>Accidents Claims Tribunal, Thrissur in O.P.(MV)525\/02. The<\/p>\n<p>Tribunal has awarded a compensation of Rs.30,500\/- and<\/p>\n<p>directed the insurance company to pay the amount. It is<\/p>\n<p>against that decision the insurance company has come up in<\/p>\n<p>appeal challenging the liability.\n<\/p>\n<p>      2.   Though respondents are served they have not<\/p>\n<p>entered appearance. Heard the learned counsel for the<\/p>\n<p>appellant. The short point that arises for determination in<\/p>\n<p>the appeal is whether in an Act only policy the insurance<\/p>\n<p>company can be directed to pay the amount. Strangely I find<\/p>\n<p>that the Claims Tribunal has taken a stand that since<\/p>\n<p>additional premium is paid for coverage of unlimited property<\/p>\n<p>damages to third parties it will take in the pillion rider as well<\/p>\n<p>and so the insurance company is liable. It has to be stated<\/p>\n<p>M.A.C.A. 1303 OF 2009<br \/>\n<span class=\"hidden_text\">                                  -:2:-<\/span><\/p>\n<p>that the said approach is totally incorrect and cannot stand<\/p>\n<p>the scrutiny of law. By virtue of the Circular dated<\/p>\n<p>16.11.2009 of the Insurance Regulatory and Development<\/p>\n<p>Authority, it has clarified that risk of persons travelling in a<\/p>\n<p>private vehicle or pillion riders travelling in a two wheeler are<\/p>\n<p>only covered by the terms and conditions issued by a<\/p>\n<p>Standard Motor Package Policy. So it is only the package<\/p>\n<p>policy which contains the clause. So far as an Act only policy<\/p>\n<p>policy is concerned the very specific condition that the words<\/p>\n<p>&#8216;any person carried in a vehicle other than for hire or reward&#8217;<\/p>\n<p>will be significantly absent.     Therefore an Act only policy<\/p>\n<p>cannot cover the risk of such persons. That is what has been<\/p>\n<p>precisely considered and decided by the Apex Court in Tilak<\/p>\n<p>Singh&#8217;s case [<a href=\"\/doc\/423517\/\">United India Insurance Co. Ltd. v. Tilak<\/p>\n<p>Singh)2006<\/a> (2) KLT 884(SC) and the status of any person<\/p>\n<p>referred to in the policy cannot be extended to a pillion rider<\/p>\n<p>or a passenger travelling in a private vehicle and therefore<\/p>\n<p>the status is only that of a gratuitous passenger. Therefore<\/p>\n<p>the award passed by the Tribunal fixing the liability on the<\/p>\n<p>insurance company is incorrect and therefore it is set aside.<\/p>\n<p>M.A.C.A. 1303 OF 2009<br \/>\n<span class=\"hidden_text\">                                -:3:-<\/span><\/p>\n<p>     Therefore the MACA is allowed and the finding of the<\/p>\n<p>Tribunal making the insurance company liable is set aside. It<\/p>\n<p>is exonerated from the liability and it is made clear that the<\/p>\n<p>claimant can proceed against the other respondents 1 and 2<\/p>\n<p>in the claim petition jointly and severally for the realisation<\/p>\n<p>of the amount awarded by the Tribunal.\n<\/p>\n<\/p>\n<p>                            M.N.
