Being not satis\ufb01ed with\n\n judgniaent and award dated 28-03-2007 passed in\n\n  "'l:NuI'.IC\ufb02"pF.\\lo.l8\/2006 by the Sessions Judge, Fast Track\n\nA?\n\n\n\nCourt -- I and Motor Accidents Claims Tribunal,\nMandya, ('the Tribunal' for short], \ufb01led this appeal\n\nseeking enhancement of compensation.\n\n2. The brief facts leading to the filing of   \n\nE1178 2\n\nbrother, were returning  their-.  **Jill_a\u00a7e4'V\\VV"irom\nUmmadahalli village by~..yvalking*lVonV:th:_e letitside of the\nroad towards Srinivasapnrl-a_  a Scooter\n\nbea;ing"'felg1'st\u00a3e:1oiif'N:{;KA. 1 i\u00a7H;8598 driven by the 1st\nrespondent  manner, dashed\n\nagainst. the   to the accident, the claimant\n\n  injt1ries.vMlrnmediately he was shifted to the\n\nholspitpaleivdattvvplyltfanidya. The X--ray reveals that there is a\n\n _ fracture,__"oi'-lateral tibial condyle. The claimant was\n\n dptreated  inpatient for a period of 10 days and he has\n\n  spelntshuge money for the treatment. The claimant, who\n\nT  'Was aged about 23 yegrs as on the date of accident\n\nOn 09-11-2005 the clairnant--A-A_lVdalongvwith"\n\n\n\nworking as a driver and was getting a salary of\n\u20ac4,500\/-- per month, has sought for compensatirm-.ggof\n\n35,00,000\/--.\n\n3. Pursuant to the notice issued by the  M\n\nfirst respondent -- owner of the "Scoo.tery .rerr_;ained \n\nunrepresented. The second respondent--Ir1su'rer'fileduhis. V\n\nobjections denying the avennerits made the \npetition. They denied ~--ar}.d aifocvation of\nthe claimant. However.  that the\nsaid Scooter   It was further\ncontended '--t11atV"v'1't'-\u00bb,:i:S claimant to prove that\n\naccident has-toccturred'  to the rash and negligent\n\n 'driving ofthe rid'er..Qf A the scooter. Further, the Insurer\n\n that the rider of the scooter does not\n\nha'v.e"a vatidj_ license and sought for dismissal of the\n\n  tcplairn petitiovn as against the second respondent.\n\n    the basis of the pleadings of the parties, the\n\nit ;:Tribuna1 framed the following issues:\n\niv\n\n\n\n(1')\n\n(ii)\n\nWhether the petitioner proves that on \ngate on Ummadahalli\u00abSr'inivasaptiraV:Vi":u\u00a73..V"'i V.\nRoad, when he was walking   A\nroad, the rider of the  \nKA.11\/H8598 drove  :.vehic!e':\nhigh speed and ina and negligerit"\n\nmanner and    \n\npetitioner and cdused'\u00bb.him iry'arie.s as\n\nstated in   " '\n\nWhe  _ the-_'  roves: that he is\n\nen i'itle5Ifor  r_npens_a\ufb01on? ' \n\n    the amount\n\n \u00e9 of corti}i\u00e9*nsa.t:ion:i?V.,And who are liable to\n\n"p,c_iy?  .\n\n  \n\nWh,ether__2f1\u20ac'. respondent proves that the\n\nA   of the scooter did not have valid\n\n \/a 'drip licence?\nMohat order?\n\n\/$~\n\n\n\n5. The claimant in order to prove his case exaznihed\n\nhimself as P.W. 1 and got examined Dr. K.Bha;sl;a_,1ji \n\nhas treated him as P.W.2 and got, \n\ndocuments as Ex.P.1 to Ex.P. 12. \n\nnot led any evidence. But with the"r::_oi1ser1rt"'Vof:jlthe \n\nparties, the insurance policydzl the  l_ scooter has\nbeen marked. p Z A\n6. The Tribunal on  the eitidence led in by\n\nthe   to Ex.P.12\n\nproducedddddby  held\ufb02that due to rash and\nnegligent  the accident had took\n\nplace, --.'I_'he'u"rei:io1*t7' of Motor Vehicle Inspector and\n\n Es\u00a7hee't.'and clearly disclose that due to rash and\n\n  of the scooter accident had took place.\n\n 1 VVith\u00ab. regard' to the quantum of the Compensation,\n\nJDr.VK.Bhaskar, who has treated the claimant deposed\n\nthat "due to the accident the claimant has suffered\n\nT  'permanent disability to his left knee. Due to the\n\n\/\u00a3~\n\n\n\naccident he cannot do the work of driver and there is\n\ndisability of 15% of his lower limb and overall disability\n\nof 8%. On the basis of the medical report ~ 2\n\nDr.K.Bhaskar, the Tribunal taking into  l\n\nthe injury suffered and other l'inc'urr'ed_':d"\u00a3)y_VV'the\n\nclaimant awarded compensation oli'---{.;;'3\u00ab8,'72g(,l];'.3: \n\ninterest. _ A p\n7. Being aggrieved 'by  ju\ufb02dylginent landl award\npassed by the Tribunai. has \ufb01led this\n\nappeal, allegir_igt;h.at  awarded is too\n\nmeager';-, = l\n\n8. Sri.l\\u\/larigowdaV,Azlearned counsel appearing for the\n\n  conter1ded....that the compensation awarded by\n\n  too meager. He has sustained fracture\n\nof  condyle due to the accident and he\n\n l*..cannot_w:orl<; as a Driver. He has spent huge amount\n\n   medical expenditure and other expenditure. He\n\n  gyvgsiibmits that without examining the same, the Tribunal\n\n\/KM\n\n\n\nhas awarded a Very meager compensation of i'.38,7__20\/--\n\nand sought for enhancement of compensation.\n\n9. On the other hand, Sri.K.Sridh.ai1.'\u00e9'r.VV\n\ncounsel appearing for the second;__resp4or:den't@:'on't.endedVi'\n\nthat the Tribunal taking into.___considderaticnhthey \n\nsustained by the ciaimant_,:"'\u00abagc. and  has\nawarded Rs.  just H and fair\ncompensation and. same"is::h.ot  interfered by\nthis Honble  s:ou.._ghjt"'i"oi*WVdismissa1 of the\n\nappeal,   \n\n10. I have  through the arguments\n\naddresvsed  counsel for the parties and\n\n  andvddddocumentary evidence let in by the\n\n"pa1'tieAs".~ i j' *\u00ab dd\n\nW._11. itifis not in dispute that the appellant has\n\n"'d:V'_s=.ist'ained injury on 0911-2005 due to the rash and\n\n "negligent riding of the scooter bearing registration\n\n\/\u00a7~\n\n\n\nNo.KA-11-i-P8598. The Police have registered Cr._.,No.\n\n364\/2005 on the file of the Mandya Rural Police A4\n\nfor the offence punishable under Sec. 279,   V'\n\nand Sec. 134 of the Motor Vehicle: Act.  it\n\nof the scooter KA.ii\/H-8598. ',l.lhe   on"\n\nbasis of the report  the la\u20ac[otor"'-\u00abVehicle\nInspector and   due to the rash\nand negligent driving of llthel 'accident has\n\ntook place.\n\n12. 'i'hon_gh-~..ti?i-ed that he was aged\nabout    salary of $4,500\/* per\n\nmonth, no doczlrnent'Ah'asl..'o'been produced to show that\n\n  getting l.sa1a1f_y__of \u20ac4,500\/~. In the absence of\n\nVl'-theV'sarne,"~thve:l"'-.ribunal taking into consideration the\n\nmonthly  the claimant at $2000\/-- and applying\n\n 'the  of 16 has awarded a sum of $26,720\/--\n\n   the future loss of income, \u20ac10,000\/~ towards\n\nV'  and suffering, 12000\/~ towards food and\n\n\n\n10\n\nnourishment. In all a sum of $38,720\/-- is awarded.\n\nThe compensation awarded by the Tribunal \n\naccordance with Motor vehicie Act. As could  "\n\nfrom the Driving Licence produced\n\ndate of birth of appellant is  \n\nhas been took place on   is it\n\naged about 25 'years V asonivtitheiVr,:\u00a7iate.._gof the accident.\nFurther, the appellant   as a\ndriver having  --   taking into\nconsideration -- is very meager.\nEven   can earn ?'.3,000\/-\nper  * In of any proof the Tribunal\n\nought, -to have ._,ta;kcn 'into consideration the income at\n\n iper'iday i.Aedi,i%.3,ooo\/-- per month and should\n\nhave -compensation. Hence, the claimant is\n\n _ entitled for enhancement of compensation.
