Balachandran, J.\n              --------------------------\n               W.P.(C)No.34182 of 2008 T\n              --------------------------\n\n                       JUDGMENT\n<\/pre>\n<p>    Heard counsel for the petitioner\/defendant.      As<\/p>\n<p>per Exhibit P1 order in C.R.P.No.1037\/03, this Court<\/p>\n<p>found that the wife of the first respondent\/ plaintiff,<\/p>\n<p>who is the second respondent herein, is not competent<\/p>\n<p>to  be  appointed  as  guardian,  as  she  opposed  the<\/p>\n<p>application of the plaintiff as matters then stood.<\/p>\n<p>This Court further observed that the trial court may<\/p>\n<p>appoint some other person as the next friend of the<\/p>\n<p>plaintiff.\n<\/p>\n<p>    2.    According to the learned counsel for the<\/p>\n<p>petitioner, in the meanwhile, it so happened that after<\/p>\n<p>passing of Exhibit P1 order, the suit was dismissed<\/p>\n<p>without any action from the part of the court below to<\/p>\n<p>appoint a court guardian or to appoint some one else as<\/p>\n<p>guardian.  Thereafter,  the  second  respondent   filed<\/p>\n<p>Exhibit P2 application for restoration of the suit and<\/p>\n<p>thereupon, vide Exhibit P3 order, the court below<\/p>\n<p>restored the suit.\n<\/p>\n<p><span class=\"hidden_text\">WPC 34182\/08                2<\/span><\/p>\n<p>     3.    It is vehemently contended before me by the<\/p>\n<p>learned counsel for the petitioner that on Exhibit P2<\/p>\n<p>application filed by the second respondent, who is the<\/p>\n<p>wife of the first respondent, the suit should not have<\/p>\n<p>been restored, as pursuant to Exhibit P1 order, she was<\/p>\n<p>incompetent to act on behalf of the first respondent\/<\/p>\n<p>plaintiff.   The submission, no doubt, is true. But, all<\/p>\n<p>the same, the fact remains that without complying with<\/p>\n<p>the direction of this Court in Exhibit P1 order, it so<\/p>\n<p>happened that the trial court dismissed the suit for<\/p>\n<p>default. The procedure, no doubt, is irregular and<\/p>\n<p>improper. But the court below should have, on Exhibit<\/p>\n<p>P1 being brought to its notice, suo motu restored the<\/p>\n<p>suit and acted according to the directions contained in<\/p>\n<p>Exhibit P1 order. The restoration of the suit viewed in<\/p>\n<p>that angle deserves to be upheld. It is the further<\/p>\n<p>contention of the petitioner that Exhibit P4 order was<\/p>\n<p>passed consequent on Exhibit P3, whereby, the trial<\/p>\n<p>court   held  that  the  first  respondent\/plaintiff  is<\/p>\n<p>physically and mentally fit to conduct the case and<\/p>\n<p>there is no necessity to appoint a next friend.<\/p>\n<p><span class=\"hidden_text\">WPC 34182\/08                3<\/span><\/p>\n<p>     4.     The question as to whether the plaintiff<\/p>\n<p>requires a next friend to be appointed as guardian to<\/p>\n<p>prosecute the suit is a matter on which the trial court<\/p>\n<p>is competent to conduct an enquiry.     It is seen that<\/p>\n<p>the court below has passed Exhibit P4 consequent on his<\/p>\n<p>entering a finding that the plaintiff is physically and<\/p>\n<p>mentally fit to conduct the case after recording his<\/p>\n<p>sworn statement.   The question of appointment of a next<\/p>\n<p>friend as guardian as directed by this Court arises<\/p>\n<p>only in the event of necessity of appointing a guardian<\/p>\n<p>existing even at the time of passing of Exhibit P4 in<\/p>\n<p>November 2008.   Exhibit P1 order was passed on 8.4.2005<\/p>\n<p>when this Court had occasion to observe that despite<\/p>\n<p>the contention of the present petitioner, who is the<\/p>\n<p>defendant in the suit, that the first respondent is not<\/p>\n<p>of unsound mind, in the circumstances available in the<\/p>\n<p>case and the evidence adduced in the case, it is not<\/p>\n<p>clear whether the plaintiff will be able to take<\/p>\n<p>decision of his own on merits and that it can be found<\/p>\n<p>only after evidence is taken in the suit.   The evidence<\/p>\n<p>that   is   made mention  of  in  Exhibit  P1  order  is<\/p>\n<p>certainly not regarding the evidence on merits of the<\/p>\n<p><span class=\"hidden_text\">WPC 34182\/08               4<\/span><\/p>\n<p>claim   in   the  case, but,   evidence  regarding  the<\/p>\n<p>competency    of the  plaintiff  to   protect  his  own<\/p>\n<p>interest. Exhibit P4 order shows that the court below<\/p>\n<p>recorded the sworn statement of the first respondent\/<\/p>\n<p>plaintiff and got convinced that the first respondent<\/p>\n<p>is physically and mentally fit to conduct the case and<\/p>\n<p>that there is no necessity to appoint a next friend.<\/p>\n<p>     5.    The prayer in this writ petition is only to<\/p>\n<p>quash Exhibit P3, which I have already found is not<\/p>\n<p>liable    to be  quashed as  even  otherwise  the  suit<\/p>\n<p>deserved to be restored suo motu.
