Pinkalben who is residing with her father.\n<\/p>\n<p>2.<br \/>\n This Court vide order dated 12.10.2010 adjourned the matter to<br \/>\nenable the petitioner-party-in-person to annex the order passed by<br \/>\nthe learned Judicial Magistrate First Class, Vadodara in application<br \/>\nfiled by him under Section 97 of the Code of Criminal Procedure,<br \/>\n1973. Uptil now,  copy of the said order has not been produced by the<br \/>\npetitioner before this Court. Thereafter, this Court vide order dated<br \/>\n27.20.2010, upon statement made by the petitioner\/party-in-person,<br \/>\nwho was desirous to see wife and know the whereabouts of his son and<br \/>\nif they are in happy condition, he would offer Rs.20,000\/- by way of<br \/>\ngift to them and he is ready to deposit the said amount of<br \/>\nRs.20,000\/- latest by 28th October, 2010.\n<\/p>\n<p>3.<br \/>\n\t On condition, this Court issued Notice to the respondent No.18<br \/>\nmaking it returnable on 18th November, 2010. However,<br \/>\nRegistry has issued Notice to respondent without being deposited the<br \/>\namount as aforesaid.\n<\/p>\n<p>4.<br \/>\nTherefore, we direct the Registrar (Judicial) to explain as to why<br \/>\nNotice has been issued without there being deposit of Rs.20,000\/-, by<br \/>\nway of condition precedent, for issuance of Notice. Admittedly the<br \/>\nsaid amount has not been deposited by the petitioner.\n<\/p>\n<p>5.<br \/>\nToday when the matter is called out, petitioner, who is<br \/>\nparty-in-person, is not present before the Court whereas Pinkalben,<br \/>\nwife of the petitioner is present before the Court along with her<br \/>\nfather and uncle. She states that the male child  named Aumshree, who<br \/>\nis aged about 5 years, is in her custody since last  1 \u00bd<br \/>\nyears, who is studying at Vidyani school.\n<\/p>\n<p>6.<br \/>\nIn view of the above, petition is dismissed.
