He<br \/>\nfurther submitted that co-accused  Bhima Sidi Modha has been granted<br \/>\n  bail by this Court by order dated 16.3.2011.  Counsel further<br \/>\nsubmitted that the petitioners are  appointed as Muster Clerks in<br \/>\nOctober 2010 whereas even as per the FIR the period during which the<br \/>\noffence took place is shown as from 28.5.09 to 31.8.10.\n<\/p>\n<p>2.\tConsidering<br \/>\nthe above prima facie aspects of the matter, the petitioners  are<br \/>\nordered to be released on bail  in<br \/>\nconnection with C.R.No.I-46 of 2010 of Kutiyana   Police Station  on<br \/>\nfurnishing   bond of Rs.10,000\/- each  (Rupees Ten thousand only)<br \/>\nwith one surety of the like amount to the satisfaction of the lower<br \/>\nCourt and on conditions that they shall :\n<\/p>\n<p>[a]\tnot<br \/>\ntake undue advantage of their  liberty or abuse their liberty;\n<\/p>\n<p>[b]\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c]\tmaintain<br \/>\nlaw and order;\n<\/p>\n<p>[d]\tmark<br \/>\ntheir  presence before the concerned  Police Station on every 1st<br \/>\nand 15th day of English Calender month between  11.00 a.m.<br \/>\nAnd 2 p.m .\n<\/p>\n<p>[e]\tnot<br \/>\nleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>[f]\tfurnish<br \/>\nthe address of their   residence at the time of execution of the<br \/>\n\tbond and shall not change the residence without prior permission of<br \/>\nthis Court;\n<\/p>\n<p>[g]\tsurrender<br \/>\ntheir  passport, if any, to the Lower Court immediately.\n<\/p>\n<p>3.\tIf<br \/>\nbreach of any of the above conditions is committed,  the Sessions<br \/>\nJudge concerned will be free  to take appropriate action in the<br \/>\nmatter.\n<\/p>\n<p>4.\tBail<br \/>\nbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p>\tRule<br \/>\nis made absolute.\n<\/p>\n<p>\tDirect<br \/>\nservice is permitted.\n<\/p>\n<p>\t\t\t\t\t(Akil<br \/>\nKureshi, J.)<\/p>\n<p>(vjn)<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Odedara vs State on 6 April, 2011 Author: Akil Kureshi,&amp;Nbsp;
