Petitioner is common in both<\/p>\n<p>the petitions. She is the defendant in O.S No.294 of 2007<\/p>\n<p>pending on the file of 1st Additional Sub Court, Kozhikode<\/p>\n<p>which is instituted by the respondent\/plaintiff for a decree of<\/p>\n<p>specific performance on an agreement of sale. She is also<\/p>\n<p>the plaintiff in O.S No. 330 of 2008 pending on the file of the<\/p>\n<p>3rd Additional Sub Court, Kozhikode wherein she has sought<\/p>\n<p>for setting aside two documents, a mortgage deed and also<\/p>\n<p>an agreement of sale which are alleged to have been<\/p>\n<p>collected from her by the respondent\/defendant in the suit<\/p>\n<p>by   fraud,     undue       influence       and      misrepresentation.<\/p>\n<p>Respondent is stated to be a practicing advocate in the<\/p>\n<p>courts of Kozhikode. Petitioner is stated to be an old lady<\/p>\n<p>aged 78 years permanently settled at Kannur. She seeks<\/p>\n<p>Tr.P.(C).Nos.262<br \/>\nAND 263 OF 2009                Page numbers<\/p>\n<p>transfer of both the suits to the Sub Court, Kannur<\/p>\n<p>canvassing a case that she may not get justice if the cases<\/p>\n<p>are tried at Kozhikode since the respondent is a practicing<\/p>\n<p>advocate at that place. Her inconveniences and difficulties<\/p>\n<p>in    appearing   before    the  courts    at  Kozhikode   for<\/p>\n<p>prosecuting\/defending the suit are also canvassed for the<\/p>\n<p>transfer requested for.\n<\/p>\n<\/p>\n<p>              2. Notice given, the respondent has entered<\/p>\n<p>appearance.       The request for transfer is vehemently<\/p>\n<p>opposed by the learned counsel appearing for the<\/p>\n<p>respondent contending that the presence of the petitioner<\/p>\n<p>for trial of the suits at the most may be required hardly for<\/p>\n<p>one or two days and the plea canvassed that in view of her<\/p>\n<p>old age she has to undergo a lot of difficulties to attend the<\/p>\n<p>court at Kozhikode hardly merits any consideration.<\/p>\n<p>Similarly, the other ground canvassed that since the<\/p>\n<p>respondent is a practicing advocate in the courts at<\/p>\n<p>Kozhikode, petitioner will not get justice, cannot be accepted<\/p>\n<p>Tr.P.(C).Nos.262<br \/>\nAND 263 OF 2009                 Page numbers<\/p>\n<p>as a tenable and sustainable ground for transfer, according<\/p>\n<p>to the counsel.\n<\/p>\n<\/p>\n<p>              3. Having regard to the submissions made by the<\/p>\n<p>counsel on both sides and taking note of the facts and<\/p>\n<p>circumstances presented, I find, the fundamental principle in<\/p>\n<p>dispensation of justice is that justice should not only be done<\/p>\n<p>but appear to be done. Petitioner, an aged lady, it seems,<\/p>\n<p>has an apprehension       that she will not get justice if the<\/p>\n<p>cases are tried in the courts at Kozhikode since the<\/p>\n<p>respondent is a practicing advocate in the courts at that<\/p>\n<p>place. May be her apprehension is baseless and unfounded,<\/p>\n<p>but, still when such an apprehension is raised, it cannot be<\/p>\n<p>brushed aside for the reason that she is unable to produce<\/p>\n<p>any material to substantiate that ground canvassed for. The<\/p>\n<p>age of the petitioner and also the apprehension canvassed<\/p>\n<p>by her that being a practicing advocate the respondent will<\/p>\n<p>have more access to the courts perhaps not of influencing<\/p>\n<p>the presiding officer but in getting things done for<\/p>\n<p>Tr.P.(C).Nos.262<br \/>\nAND 263 OF 2009                Page numbers<\/p>\n<p>prosecution of the cases, I find it is better and appropriate to<\/p>\n<p>transfer both the cases to a court outside Kozhikode district.<\/p>\n<p>In the given facts of the case, I direct for transfer of both the<\/p>\n<p>cases, O.S No.294\/2007 of 1st Additional Sub Court,<\/p>\n<p>Kozhikode and O.S No. 330\/2008 of 3rd Additional Sub Court,<\/p>\n<p>Kozhikode to the Principal Sub Court, Thalassery. The 1st<\/p>\n<p>Additional Sub Judge and also 3rd Additional Sub Judge shall<\/p>\n<p>transmit the records of the respective cases to the Principal<\/p>\n<p>Sub Court, Thalassery without delay. Parties are directed to<\/p>\n<p>appear before the Principal Sub Court, Thalassery on<\/p>\n<p>06\/01\/2010.
