The petitioner is  branded as &#8220;bootlegger&#8221;.\n<\/p>\n<p>Heard<br \/>\n\tMs. SG Patel, Ld. Advocate for Mr. UM Panchal, Ld. Advocate for  the<br \/>\n\tpetitioner and Mr. RC Kodekar, learned AGP for the respondents. The<br \/>\n\taffidavit-in-reply filed by the respondent &#8211; Commissioner of<br \/>\n\tPolice, Surat City has been taken into consideration.\n<\/p>\n<p>The<br \/>\n\tdetenu &#8211; Jayeshbhai came to be detained as &#8220;bootlegger&#8221;<br \/>\n\ton his involvement in two offences arising under the Bombay<br \/>\n\tProhibition Act.\n<\/p>\n<p>It<br \/>\n\thas been submitted by the learned Counsel for the petitioner that it<br \/>\n\tis a settled legal position that on registration of two offences, no<br \/>\n\torder of detention could have been passed, as petitioner &#8211;<br \/>\n\tdetenu cannot be branded as &#8220;bootlegger&#8221;. It has been<br \/>\n\tfurther submitted that the activities of the petitioner cannot be<br \/>\n\tsaid to be injurious to the public health or public order. It has<br \/>\n\tbeen further submitted by the learned Counsel for the petitioner<br \/>\n\tthat there is gross delay in passing the order of detention.\n<\/p>\n<p>Per<br \/>\n\tcontra, Mr. RC Kodekar, learned AGP representing the respondents<br \/>\n\tsupported the detention order dated 03\/07\/2010 passed by respondent\n<\/p>\n<p>\t&#8211; Commissioner of Police, Surat City and submitted that before<br \/>\n\tpassing the detention order, the detention authorities took into<br \/>\n\tconsideration all the relevant papers and after subjective<br \/>\n\tsatisfaction, the detention order is passed and thus the detention<br \/>\n\torder is legal and proper and no interference in the said order is<br \/>\n\twarranted and consequently the petition deserves dismissal.\n<\/p>\n<p>I<br \/>\n\thave gone through the grounds of detention and considered the<br \/>\n\tsubmissions advanced on behalf of both the sides.\n<\/p>\n<p>The<br \/>\n\tCourt is of the opinion that there is much substance in the<br \/>\n\targuments advanced by learned Counsel for the petitioner. It is seen<br \/>\n\tfrom the grounds that a general statement has been made by the<br \/>\n\tdetaining authority that consuming liquor is injurious to health. In<br \/>\n\tfact, a perusal of the order passed by the detaining authority shows<br \/>\n\tthat the grounds which are mentioned in the order are in reference<br \/>\n\tto the situation of &#8220;law and order&#8221; and not &#8220;public<br \/>\n\torder&#8221;. Therefore, on this ground, the subjective satisfaction<br \/>\n\tof the detaining authority is vitiated on account of non-application<br \/>\n\tof mind and the impugned order, therefore, deserves to be quashed<br \/>\n\tand set aside.\n<\/p>\n<p>Except<br \/>\n\tthe general statement, there is no material on record which shows<br \/>\n\tthat the detenu is carrying on illegal activities of selling liquor<br \/>\n\tor is engaged in such activity, which is harmful to the health of<br \/>\n\tthe public. In the case of ASHOKBHAI JIVRAJ @ JIVABHAI SOLANKI<br \/>\n\tv\/s. POLICE COMMISSIONER, Surat, reported in 2001 (1) GLH 393,<br \/>\n\thaving considered the decision of the Hon&#8217;ble Apex Court in the case<br \/>\n\tof Ram manohar Lohia v\/s. State of Bihar, reported in AIR<br \/>\n\t1966 SC 740, this Court held that the cases wherein the<br \/>\n\tdetention order are passed on the basis of the statements of such<br \/>\n\twitness fall under the maintenance of &#8220;law and order&#8221;<br \/>\n\tand not &#8220;public Order&#8221;.\n<\/p>\n<p>Applying<br \/>\n\tthe ratio of the above decisions, it is clear that before passing an<br \/>\n\torder of detention, the detaining authority must come to a definite<br \/>\n\tfindings that there is threat to the &#8216;public order&#8217; and it is very<br \/>\n\tclear that the present case would not fall within the category of<br \/>\n\tthreat to a public order. In that view of the matter, when the order<br \/>\n\tof detention has been passed by the detaining authority without<br \/>\n\thaving adequate grounds for passing the said order, cannot be<br \/>\n\tsustained and, therefore, it deserves to be quashed and set aside.\n<\/p>\n<p>\tFor the foregoing<br \/>\n\treasons, this petition is allowed. The impugned order of detention<br \/>\n\tdated 03\/07\/2010 passed by the respondent &#8211; Commissioner of<br \/>\n\tPolice, Surat City, is hereby quashed and set aside. The detenu &#8211;<br \/>\n\tJayeshbhai Hasmukhbhai Khambhati [Kharva] is ordered to be set at<br \/>\n\tliberty forthwith, if not required in any other case. Rule made<br \/>\n\tabsolute accordingly.
