JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 21\/10\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE D.H.WAGHELA)<\/p>\n<p>\tThe  petitioner has invoked<br \/>\n\tArticles 14, 19 and 226 of the Constitution to challenge order dated<br \/>\n\t18.01.2010 of the Authorized Officer and Cooperation Officer, Patan,<br \/>\n\twhereby the objection of the petitioner against inclusion in the<br \/>\n\tvoters&#8217; list of members of the Committee of respondent No.6 &#8211;<br \/>\n\tCooperative Society is<br \/>\n\trejected.\n<\/p>\n<p>It<br \/>\n\twas argued by learned counsel Mr.Vaghela that respondent No.6 &#8211;<br \/>\n\tSociety  was existing in violation of the Gujarat Cooperative<br \/>\n\tSocieties Act, 1961, insofar as it was constituted<br \/>\n\twith the signatures of such persons who had passed away at the<br \/>\n\trelevant time. He, on that basis, submitted that the existence and<br \/>\n\tmanagement of respondent No.6 &#8211; Society was fraudulent and the<br \/>\n\tpetitioner has in fact already lodged a criminal complaint in the<br \/>\n\tCourt of learned Chief Judicial Magistrate at Patan; and the Court<br \/>\n\thas ordered an inquiry by order dated 06.08.2005.\n<\/p>\n<p>Learned<br \/>\n\tcounsel Mr.Dipen Desai appearing for the respondent No.6 &#8211;<br \/>\n\tSociety submitted that respondent No.6 was working as a genuine<br \/>\n\tcooperative Society and the necessary record was produced before the<br \/>\n\tAuthorized Officer, on the basis of which due satisfaction is<br \/>\n\talready recorded in the impugned order. Learned counsel relied upon<br \/>\n\tDivision Bench decision of this Court in <a href=\"\/doc\/77038251\/\">Kalubhai<br \/>\n\tRanabhai Akabari v. State of Gujarat and Ors.<\/a> &#8211; (2007(3) GLH 57),<br \/>\n\twherein it is observed in paragraph-31 that as far as elections to<br \/>\n\tAPMC are concerned, the challenge to registration of a cooperative<br \/>\n\tsociety falling under clause (i) or clause (iii) of Section 11(1)<br \/>\n\tcan only be entertained by the appellate \/ revisional forum<br \/>\n\texpressly created under Sections 153 and 155 of the Gujarat<br \/>\n\tCooperative Societies Act, 1961.\n<\/p>\n<p>\tIn<br \/>\n\tview of the above facts and circumstances and the view taken<br \/>\n\tby this Court in the aforesaid decision, the impugned order appears<br \/>\n\tto have been based upon material produced before the Authorized<br \/>\n\tOfficer and it also appears to be within the jurisdiction of the<br \/>\n\tAuthorized Officer.
