Ltd. as<br \/>\n\twell as the Gujarat State Transport Corporation have preferred an<br \/>\n\tappeal against the judgment and award of the Motor Accident Claims<br \/>\n\tTribunal (Main), Rajkot in two Motor Accident Claim Petitions, i.e.<br \/>\n\tM.A.C.P. No.44\/1985 and M.A.C.P. No.69\/1985 respectively, whereby<br \/>\n\tthe Tribunal has held that both the drivers of both the vehicles to<br \/>\n\tcontributory negligence.\n<\/p>\n<p>The<br \/>\n\tfacts in brief giving rise to this appeal arise out of a common<br \/>\n\taccident involving a Truck No.GTX-5599 and a State Transport Bus<br \/>\n\tNo.GRP-8793 which took place on 18.08.1984 at 6.30 pm on Kuvadava<br \/>\n\troad.\n<\/p>\n<p>Learned<br \/>\n\tCounsel for the State Transport Corporation has contended that the<br \/>\n\tTribunal has committed an error in holding the S.T. Driver 40%<br \/>\n\tnegligent and 60% negligent to the Truck Driver. Learned Counsel for<br \/>\n\tthe Insurance Company has submitted that the claimants were<br \/>\n\ttravelling in Truck No.GTX-5599.  The truck was a commercial goods<br \/>\n\tvehicles and the claimants were travelling in a goods vehicle.<br \/>\n\tTherefore, the Insurance Company is not liable to deposit the amount<br \/>\n\tas awarded by the Tribunal.  Further, the accident happened on<br \/>\n\t18.08.1984. Therefore, it was prior to the Amendment Act. Therefore,<br \/>\n\tthe learned Counsel is not liable to pay the amount of compensation.\n<\/p>\n<p>I<br \/>\n\thave heard the learned Advocates at length. On the factum of<br \/>\n\tcontributory negligence while considering the issue of negligence,<br \/>\n\tthe Tribunal has discussed in Paragraphs 18, 19 and 20.  Paragraph<br \/>\n\t18 is quoted as under :-\n<\/p>\n<p> 18.<br \/>\n\tThe complaint before the police was lodged by S.T. Driver which is<br \/>\n\tat Ex.35.  He says that he started his bus from Ambaji for Rajkot<br \/>\n\tand at about 6-30 p.m. they were near Kuvadava and one truck was<br \/>\n\tcoming from opposite side driven rashly and negligently and he took<br \/>\n\this bus on the left side on extreme left, while truck came from the<br \/>\n\twrong side and that is on the right side and dashed and collided<br \/>\n\twith the bus and the bus went off the road and truck also became<br \/>\n\tturtle and on this basis, complaint was lodged and offence was<br \/>\n\tregistered against the driver of the offending truck.\n<\/p>\n<p>Looking<br \/>\n\tto the facts and circumstances of the case and looking to the<br \/>\n\tjudgment of the Tribunal, I am in complete agreement with the<br \/>\n\tfindings and reasons given by the Tribunal.  The contributory<br \/>\n\tnegligence of 40% attributed to S.T. Driver is just and proper since<br \/>\n\tit is a head on collusion. Regarding contention of the Insurance<br \/>\n\tCompany, the same is required to be considered.\n<\/p>\n<p>In<br \/>\n\tview of the aforesaid, I am of the opinion that the Insurance<br \/>\n\tCompany is not liable to pay the amount of compensation. The owner<br \/>\n\tof the Truck is liable to deposit the compensation amount. The order<br \/>\n\tof the Tribunal is modified to the extent that the claim petition is<br \/>\n\tallowed. However, it will be qua original respondent Nos.1,2,4 and\n<\/p>\n<p>\t5.  If any amount towards compensation has been deposited by the<br \/>\n\tInsurance Company, the same will be refunded back to the Insurance<br \/>\n\tCompany.  It will be open for the Insurance Company to recover the<br \/>\n\tamount from the owner.
