However,<br \/>\nthere is no recovery discovery of the weapon as has been recovered<br \/>\nfrom the other co-accused. He, therefore, submitted that as<br \/>\ninvestigation is over and charge-sheet is filed, present application<br \/>\nmay be allowed.\n<\/p>\n<p>4.\tLearned<br \/>\nAPP resisted the application and submitted that as stated in the FIR<br \/>\nitself, he had got the forged licence prepared which has also been<br \/>\nreferred suggesting prima facie role or the involvement and therefore<br \/>\nit cannot be said that he is not involved as there is no recovery of<br \/>\nweapon. But, there is recovery of forged licence which prima facie<br \/>\nsuggest about the involvement and the conspiracy. Further, he<br \/>\nsubmitted that the applicant belongs to U.P. and if he is released,<br \/>\nhis presence may not be secured.\n<\/p>\n<p>5.\tHaving<br \/>\nheard the learned Advocate Mr. Raval and learned APP Mr. Sejpal and<br \/>\nhaving considered the nature of offence, role attributed and also<br \/>\nconsidering the fact that the charge-sheet has now been filed,<br \/>\npresent application deserves to be allowed. However, the apprehension<br \/>\nvoiced by learned APP about his presence is also required to be<br \/>\nconsidered by imposing suitable condition. Therefore, the application<br \/>\ndeserves to be allowed subject to the conditions hereinafter.\n<\/p>\n<p>6.\tAccordingly,<br \/>\npresent application stands allowed. The applicant is ordered to be<br \/>\nreleased on regular bail in connection with the F.I.R. being<br \/>\nI.C.R.No. 23 of 2010 registered with D.C.B.Police Station, Ahmedabad<br \/>\ncity, on his executing a bond of Rs.5,000\/- (Rupees Five Thousand)<br \/>\nwith one solvent surety of the like amount to the satisfaction of the<br \/>\nlower Court and subject to the conditions that he shall:\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty.\n<\/p>\n<p>(b)\tnot<br \/>\nto try to tamper or pressurize the prosecution witnesses or<br \/>\ncomplainant in any manner.\n<\/p>\n<p>(c)\tnot<br \/>\nact in any manner injurious to the interest of the prosecution.\n<\/p>\n<p>(d)\tmaintain<br \/>\nlaw and order and should cooperate with the investigating officers.\n<\/p>\n<p>(e)\tmark<br \/>\nhis presence before concerned Police Station on 1st Monday<br \/>\nof every month of English calender between 11:00 AM to 2:00 PM till<br \/>\nthe trial commences;\n<\/p>\n<p>(f)\tfurnish<br \/>\nthe address of his residence to the Investigating Officer and also to<br \/>\nthe Court at the time of execution of the bond and shall not change<br \/>\nhis residence without prior permission of the Court.\n<\/p>\n<p>(g)\tsurrender<br \/>\nhis passport, if any, to the lower Court, within a week.\n<\/p>\n<p>(h)\tnot<br \/>\nleave the boundary of the State of Gujarat without the prior<br \/>\npermission of the trial Court.\n<\/p>\n<p>7.\tIf<br \/>\n\tbreach of any of the above conditions is committed, the concerned<br \/>\n\tSessions Judge will be  free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>8.\tBail<br \/>\n\tbefore the lower Court having jurisdiction to try the case. It would<br \/>\n\tbe open to the trial Court concerned to give time to furnish the<br \/>\n\tsolvency certificate if prayed for.\n<\/p>\n<p>9.\tRule<br \/>\n\tis made absolute to the aforesaid   extent.
