 4. a Brief facts of the case are:\n<\/p>\n
That on 21~Lt1–06, when the claimant was<\/p>\n
_.;%proceeding in his motor cycle bearing registration<\/p>\n
g\/..\n<\/p>\n
No.KA-4l–E–4249 and was Waiting for signal at Ring
\nRoad Junction, Kanakapura road, the driver of lorry<\/p>\n
bearing registration No. AP–26–U~91aO came viri’.::a’a.rash<\/p>\n
and negligent manner and dashed <\/p>\n
cycle. As a result, the claimant fell downandl  <\/p>\n
injuries. Hence, he \ufb01led a <\/p>\n
MACT, Bangalore, .s’ee__k1’ng’7,_ “‘com;jei1\u00a7,=a_tVio\ufb01’\u00a7 it  ;<\/p>\n
?.25.00,000\/–. The  inipugrledi\ufb01ijudgment
\nand award has  of Rs.1,59,-400\/–
\nand rounded’.i.txof   interest at 6%

seeking ‘.eI1ha11e’en1ent– –compensation.<\/p>\n
5.  .. As tlzere-is no “dispute regarding occurrence of<\/p>\n
  negligenoe and liability of the insurer of the<\/p>\n
   ifehicle, the only point that remains for my<\/p>\n
e0\u00abnsid’ei*.at’ion in the appeal is:<\/p>\n
Whether the quantum of
\ncompensation awarded by the Tribunal is
\njust and proper or does it call for
\nenhancement?\n<\/p>\n<\/p>\n
6. After hearing the learned Cd’unsel for the parties
\nand perusing the award of the Tribunal, I am of the
\nView that the compensation awarded by the Tribunal is
\nnot just and proper, it is on the lower side andvth:e1’e.fore<\/p>\n
it is deserved to be enhanced.\n<\/p>\n
7. The claimant has sustained the fol.loi\u00a3i7ing’:.injtu1*ies–t:_  <\/p>\n
Fracture of left lower end
\ncrush injury to right foot’.wit,h fract_ure,’~
\nmetacarpal and V jfiiiltiple  afoot:
\ndislocation. V’ H l ;\n<\/p>\n
Injuries sustained. by  evident from the
\nwound certificate  summaries ‘Mam<\/p>\n
  report — Ex.P.1 1, case sheet ~
\nEX.P. l3″t)y oral evidence of the claimant<\/p>\n
and doctor examined as P.Ws.1 and  respectively.<\/p>\n
  -\u00bb.~._doctor has stated in his evidence that he<\/p>\n
“e1\u00bbiarnine\u00a7ii’;_ the claimant on 21-11-06 and he had<\/p>\n
sustained the aforesaid injuries. He was treated with<\/p>\n
A  lvlvotirid debridement and  wire \ufb01xation under<\/p>\n
l\ufb01anesthesia and discharged on 25–11~O6 and thereafter,<\/p>\n
\ufb01e<\/p>\n
he was under follow up treatment as out patient. On
\nrecent examination, he found that the fractures are
\nunited with certain amount of osteoarthritis of right foot<\/p>\n
and there is restriction of movements. He asseseed the<\/p>\n
disability of 27% to the right lower limb  <\/p>\n
whole body.\n<\/p>\n
8. Considering the nature\ufb02xof <\/p>\n
awarded by the Tribunal.\u00bbtowardlst.plain  <\/p>\n
on the lower side and it is  to enhanced by
\nanother 15.000\/\u00bb an}: I iavvetd’tv.?’j.izio.ooo\/– under this<\/p>\n
head.\n<\/p>\n
9.  medical bills for
\n?.45,00″0._\/’L;  for \u20ac10,000\/–. He was<\/p>\n
treated as in”p”at.i_er1t for about 5 days. Considering the<\/p>\n
‘ — awarded by the Tribunal towards<\/p>\n
‘rnehdicalbajnd incidental expenses is on the lower side<\/p>\n
and is ‘deserved to be enhanced and 1 award<\/p>\n
i  ,?.”a5,oo0\/- under this head.<\/p>\n
10. Claimant claims to have been earning \u20ac8,500\/–
\nper month by working as a Wireinan at M \/ s. Chandra
\nElectrical Enterprises and in support of his contention,
\nhe has produced his salary certi\ufb01cate at EX.\u00a7:..’8p.8.l’1d<\/p>\n
examined his employer as P.W.3, but <\/p>\n
certificate with regard to nature of leaVe._a_n-dp   <\/p>\n
days of leave availed. However, considering”naturepof ‘<\/p>\n
injuries, ?.9,0oo\/– awarded by’:h’e- Trib;v17hVaVl4_ it t\u00a2}w\u00a71.;1g~r+<\/p>\n
loss of income during laid period  and proper<\/p>\n
and there is no scop-elfor enhauiiicey  i _<\/p>\n
11. Consi.der;ii’;g they  ijinjuries, disability<\/p>\n
  anmainount of discomfort and
\n“unhappiness h as to undergo for the rest of his<\/p>\n
life–,..  awarded by the Tribunal towards loss<\/p>\n
 .of amenities is just and proper and there is no scope for<\/p>\n
 . ‘e_nhanceVIn.lenit’ under this head.<\/p>\n
A  V_.~’i’he}.V*claimant has failed to establish his contention<\/p>\n
 AA that-\ufb01ter sustaining injuries. he has discontinued his<\/p>\n
it  ’employment. Even nature of injuries sustained do not<\/p>\n
 suggest that he cannot continue his employment in<\/p>\n

\nand evidence of P.W.3 working as Manager in Chandra<\/p>\n
