Through\u00a0his\u00a0RTI\u00adapplication\u00a0dated\u00a020.02.2010,\u00a0appellant\u00a0listed\u00a0nine\u00a0<br \/>\nqueries\u00a0to\u00a0be\u00a0answered\u00a0by\u00a0CPIO.\u00a0\u00a0These\u00a0queries\u00a0were\u00a0as\u00a0follows:\u00ad<\/p>\n<p>      &#8220;1.    Total\u00a0number\u00a0of\u00a0applications\u00a0received\u00a0category\u00adwise\u00a0i.e.\u00a0for \u00a0<br \/>\n             200\u00a0sq.\u00a0yards\u00a0&amp;\u00a0250\u00a0sq.\u00a0yards.\n<\/p>\n<p>        2.   Total\u00a0amount\u00a0collected\u00a0category\u00adwise.\n<\/p>\n<p>        3.   Total\u00a0number\u00a0of\u00a0applicants\u00a0who\u00a0have\u00a0raised\u00a0the\u00a0loan.\u00a0\u00a0From \u00a0<br \/>\n             you\u00a0being\u00a0the\u00a0nodal\u00a0bank.\n<\/p>\n<p>        4.   Total\u00a0amount\u00a0delivered\u00a0as\u00a0loan\u00a0to\u00a0the\u00a0applicants.\n<\/p>\n<p>        5.   Total\u00a0amount\u00a0collected\u00a0as\u00a0interest\u00a0on\u00a0loan.\n<\/p>\n<p>        6.   Total\u00a0amount\u00a0refunded\u00a0after\u00a0the\u00a0date\u00a0of\u00a0draw\u00a0i.e.\u00a011th\u00a0 Nov\u00ad<br \/>\n             2009\u00a0out\u00a0of\u00a0interest\u00a0collected\u00a0by\u00a0bank.\n<\/p>\n<p>CIC_AT_A_2010_000463_M_45180.doc\u00a0<br \/>\n                                                                      Page\u00a01\u00a0of\u00a04\n<\/p>\n<p>          7.    Total\u00a0interest\u00a0paid\u00a0to\u00a0GLADA\u00a0on\u00a0the\u00a0deposits.\u00a0\n<\/p>\n<p>         8.    TDS\u00a0deducted\u00a0on\u00a0the\u00a0interest.\n<\/p>\n<p>         9.    How\u00a0much\u00a0and\u00a0at\u00a0what\u00a0rate\u00a0of\u00a0interest\u00a0amount\u00a0has\u00a0been\u00a0paid \u00a0<br \/>\n               to \u00a0 successful \u00a0 and \u00a0 unsuccessful \u00a0 applicants \u00a0 on \u00a0 the \u00a0 amount \u00a0<br \/>\n               which\u00a0remained\u00a0with\u00a0the\u00a0authorities.&#8221;\u00a0\n<\/p>\n<p>2.    CPIO, \u00a0 through \u00a0 his \u00a0 reply \u00a0 dated \u00a0 25.02.2010, \u00a0 gave \u00a0 the \u00a0 requisite\u00a0<br \/>\ninformation\u00a0to\u00a0the\u00a0appellant,\u00a0but\u00a0for\u00a0the\u00a0balance\u00a0items\u00a0of\u00a0requests,\u00a0CPIO\u00a0<br \/>\nclaimed \u00a0 exemption \u00a0 under \u00a0 Section \u00a0 8(1)(d) \u00a0 of \u00a0 the \u00a0 RTI \u00a0 Act \u00a0 claiming \u00a0 the\u00a0<br \/>\ninformation\u00a0to\u00a0be\u00a0of\u00a0commercial\u00a0confidence\u00a0to\u00a0the\u00a0Bank.\n<\/p>\n<p>3.     Appellate \u00a0Authority, \u00a0 in \u00a0 his \u00a0 order \u00a0dated \u00a0 30.03.2010, \u00a0held \u00a0that \u00a0the\u00a0<br \/>\ninformation\u00a0requested\u00a0through\u00a0items\u00a0at\u00a0Sl.Nos.4\u00a0to\u00a09\u00a0in\u00a0appellant&#8217;s\u00a0RTI\u00ad<br \/>\napplication \u00a0 not \u00a0 only \u00a0 was \u00a0 information \u00a0 commercial \u00a0 in \u00a0 nature, \u00a0 it \u00a0 also\u00a0<br \/>\npertained\u00a0to\u00a0the\u00a0third\u00adparty\u00adcustomers\u00a0of\u00a0the\u00a0Bank.\u00a0\u00a0Therefore,\u00a0apart\u00a0from\u00a0<br \/>\nSection \u00a0 8(1)(d), \u00a0 the \u00a0 Appellate \u00a0 Authority \u00a0 also \u00a0 invoked \u00a0 Section \u00a0 8(1)(j) \u00a0 to\u00a0<br \/>\ndecline\u00a0to\u00a0disclose\u00a0the\u00a0information\u00a0to\u00a0appellant.\n<\/p>\n<p>4.    In \u00a0 his \u00a0 second\u00adappeal \u00a0 petition, \u00a0 the \u00a0 appellant \u00a0 has \u00a0 argued \u00a0 that\u00a0<br \/>\ndisclosure \u00a0 of \u00a0 the \u00a0 requested \u00a0 information \u00a0 was \u00a0 necessary \u00a0 because,\u00a0<br \/>\naccording \u00a0 to \u00a0 him, \u00a0 in \u00a0 advancing \u00a0 loans \u00a0 for \u00a0 purchase \u00a0 of \u00a0 158 \u00a0 numbers \u00a0 of\u00a0<br \/>\nplots\u00a0offered \u00a0for\u00a0sale\u00a0to\u00a0public\u00a0by\u00a0Greater\u00a0Ludhiana\u00a0Area\u00a0Development\u00a0<br \/>\nAuthority \u00a0on\u00a020\u00a0July\u00a02009\u00a0the\u00a0Bank\u00a0had,\u00a0in\u00a0collusion\u00a0with\u00a0the\u00a0statutory\u00a0<br \/>\nbodies, \u00a0&#8220;fleeced\u00a0the\u00a0gullible\u00a0public\u00a0of\u00a0about\u00a0Rs.8\u00a0crores\u00a0(i.e.\u00a0the\u00a0interest \u00a0<br \/>\n@10%\u00a0on\u00a0the\u00a0collected\u00a0amount \u00a0of\u00a0Rs.247\u00a0crores,\u00a0which\u00a0was\u00a0refunded \u00a0<br \/>\nback\u00a0to\u00a0unsuccessful\u00a0applicants\u00a0after\u00a0(Bank\u00a0retained\u00a0the\u00a0amount\u00a0for)\u00a03\u00ad4 \u00a0<br \/>\nmonths&#8221;.\n<\/p>\n<p>5.   During\u00a0hearing,\u00a0it\u00a0was\u00a0stated\u00a0on\u00a0behalf\u00a0of\u00a0the\u00a0respondents\u00a0that\u00a0the\u00a0<br \/>\nabove\u00admentioned \u00a0 loans \u00a0 were \u00a0 advanced \u00a0 by \u00a0 the \u00a0 Branches \u00a0 of \u00a0 the \u00a0 Bank\u00a0<\/p>\n<p>CIC_AT_A_2010_000463_M_45180.doc\u00a0<br \/>\n                                                                             Page\u00a02\u00a0of\u00a04<br \/>\n located \u00a0 within \u00a0 the \u00a0 Circle. \u00a0 The \u00a0 information, \u00a0 which \u00a0 the \u00a0 appellant \u00a0 has\u00a0<br \/>\nrequested,\u00a0needs\u00a0to\u00a0be\u00a0collected\u00a0from\u00a0all\u00a0those\u00a0Branches,\u00a0collated\u00a0and\u00a0<br \/>\nprovided \u00a0 to \u00a0 the \u00a0 appellant. \u00a0 They \u00a0 reiterated \u00a0 the \u00a0 point \u00a0 that \u00a0 the \u00a0 sought\u00a0<br \/>\ninformation,\u00a0if\u00a0disclosed,\u00a0would\u00a0be\u00a0hurtful\u00a0to\u00a0the\u00a0Bank\u00a0commercially\u00a0as\u00a0it\u00a0<br \/>\nwould\u00a0give\u00a0out\u00a0all\u00a0details\u00a0of\u00a0the\u00a0loaning\u00a0activities.\u00a0The\u00a0competitors\u00a0might\u00a0<br \/>\nuse \u00a0 this \u00a0 information \u00a0 to \u00a0 financially \u00a0 hurt \u00a0 the \u00a0 Bank. \u00a0 \u00a0 So \u00a0 apart \u00a0 from \u00a0 the\u00a0<br \/>\nexemption\u00adSections, \u00a0 respondents \u00a0 also \u00a0 claimed \u00a0 that \u00a0 the \u00a0 exercise \u00a0 of\u00a0<br \/>\ncollecting \u00a0 the \u00a0 above \u00a0 information \u00a0 from \u00a0 all \u00a0 Bank \u00a0 Branches \u00a0 would \u00a0 be\u00a0<br \/>\nexpensive\u00a0and\u00a0hence\u00a0the\u00a0matter\u00a0also\u00a0came\u00a0within\u00a0the\u00a0scope\u00a0of\u00a0Section\u00a0<br \/>\n7(9)\u00a0of\u00a0the\u00a0RTI\u00a0Act.\n<\/p>\n<p>6.    A\u00a0look\u00a0at\u00a0the\u00a0appellant&#8217;s\u00a0queries\u00a0in\u00a0his\u00a0RTI\u00adapplication\u00a0at\u00a0points\u00a04\u00ad9\u00a0<br \/>\nwould\u00a0reveal\u00a0that\u00a0queries\u00a0at\u00a0Sl.Nos.4,\u00a06,\u00a09\u00a0as\u00a0well\u00a0as\u00a0item\u00a0at\u00a0Sl.No.8\u00a0do\u00a0<br \/>\nnot\u00a0attract\u00a0Section\u00a08(1)(d)\u00a0as\u00a0these\u00a0relate\u00a0to\u00a0gross\u00a0figures\u00a0pertaining\u00a0to\u00a0<br \/>\nBank&#8217;s\u00a0loans\u00a0relating\u00a0to\u00a0the\u00a0GLADA.\n<\/p>\n<p>7.    In \u00a0 my \u00a0 view, \u00a0 the \u00a0 information \u00a0 requested \u00a0 through \u00a0 these \u00a0 items \u00a0 of\u00a0<br \/>\nqueries\u00a0may\u00a0be\u00a0provided\u00a0to\u00a0the\u00a0appellant\u00a0as\u00a0held\u00a0by\u00a0the\u00a0Zonal\u00a0Office.\n<\/p>\n<p>8.      On\u00a0consideration\u00a0of\u00a0the\u00a0context\u00a0of\u00a0the\u00a0queries\u00a0in\u00a0Sl.Nos.5\u00a0and\u00a07,\u00a0it\u00a0<br \/>\nis\u00a0my\u00a0view\u00a0that\u00a0this\u00a0information\u00a0should\u00a0also\u00a0be\u00a0disclosed.\n<\/p>\n<p>9.      What\u00a0appellant\u00a0has\u00a0requested\u00a0to\u00a0be\u00a0informed\u00a0relates\u00a0to\u00a0a\u00a0welfare\u00ad<br \/>\nrelated\u00a0activity\u00a0of\u00a0the\u00a0GLADA,\u00a0in\u00a0which\u00a0the\u00a0Bank\u00a0became\u00a0a\u00a0participant.\u00a0<br \/>\nThe \u00a0 loans \u00a0 given \u00a0 were \u00a0 to \u00a0 promote \u00a0 the \u00a0 welfare \u00a0 measure \u00a0 taken \u00a0 by \u00a0 the\u00a0<br \/>\nGLADA\u00a0to\u00a0provide\u00a0affordable\u00a0houses\u00a0to\u00a0the\u00a0people.\u00a0There\u00a0is,\u00a0therefore,\u00a0<br \/>\npublic\u00a0interest\u00a0in\u00a0divulging\u00a0as\u00a0to\u00a0how\u00a0much\u00a0of\u00a0this\u00a0loan\u00a0was\u00a0provided,\u00a0how\u00a0<br \/>\nthe\u00a0interests\u00a0were\u00a0charged\u00a0and\u00a0who\u00a0received\u00a0what\u00a0quantum\u00a0of\u00a0interest.\u00a0<br \/>\nThis\u00a0information\u00a0will\u00a0enable\u00a0the\u00a0public\u00a0to\u00a0critically\u00a0assess\u00a0the\u00a0Scheme\u00a0and\u00a0<br \/>\nalert\u00a0them\u00a0about\u00a0the\u00a0risks\u00a0and\u00a0benefits.\u00a0There\u00a0is,\u00a0therefore,\u00a0public\u00a0interest\u00a0<br \/>\nin\u00a0its\u00a0disclosure,\u00a0which\u00a0overrides\u00a0any\u00a0claim\u00a0to\u00a0exemption.\n<\/p>\n<p>10. It\u00a0is\u00a0accordingly\u00a0directed\u00a0that\u00a0all\u00a0information\u00a0pertaining\u00a0to\u00a0queries\u00a0of\u00a0<br \/>\nthe\u00a0appellant\u00a0at\u00a0Sl.Nos.4\u00a0to\u00a09\u00a0be\u00a0provided\u00a0to\u00a0him\u00a0within\u00a0three\u00a0weeks.\n<\/p>\n<p>CIC_AT_A_2010_000463_M_45180.doc\u00a0<br \/>\n                                                                              Page\u00a03\u00a0of\u00a04\n<\/p>\n<p> 11.
