Respondents\n\nPrayer\n\nWrit Petition filed under Article 226 of the Constitution of India\nfor issuance of a Writ of Mandamus, to direct the respondents to repay the\nFixed Deposit maturity amount made by the petitioner's husband Late.Mr.Anburaj\nwith the fourth respondent Co-operative Bank in CC.No.167 with additional\ninterest from the date of maturity (i.e. from 03.11.2005) till the realization\nof Fixed Deposit maturity amount.\n\n!For Petitioner    ...Mr.M.Saravana Kumar\n^For Respondents   ...Mr.K.A.Thirumalaippan\n\t              Additional Government Pleader\n\n:ORDER\n<\/pre>\n<p>\tHeard the learned counsel for the petitioner and also<br \/>\nMr.K.A.Thirumalaippan, learned Additional Government Pleader.\n<\/p>\n<p>\t2. A re&#8217;sume&#8217; of facts absolutely necessary and germane for the disposal<br \/>\nof this writ petition would run thus:\n<\/p>\n<p>\tThe petitioner is the widow of the deceased depositor of a sum of<br \/>\nRs.3,00,000\/- (Rupees three lakhs only) with the fourth respondent, viz.,<br \/>\nThandupathu Primary Agricultural Co-operative Bank.  The depositor died, leaving<br \/>\nbehind his wife Geetha and two minor children.  The petitioner on the strength<br \/>\nof the Fixed Deposit Cash Certificate in the name of the petitioner&#8217;s deceased<br \/>\nhusband issued by the said Cooperative Bank, approached the said Cooperative<br \/>\nBank for encashing it on maturity.  Thereupon the officials of the Cooperative<br \/>\nBank came forward with the plea as though the petitioner&#8217;s deceased husband<br \/>\nviz., Anburaj did not deposit a sum of Rs.3,00,000\/- (Rupees three lakhs only)<br \/>\nat all, but in fact he deposited only a sum of Rs.3000\/- (Rupees three thousand<br \/>\nonly); however he managed to obtain such a certificate from the then erring<br \/>\nofficials of the Cooperative Bank.  Thereupon she made several representations,<br \/>\nwhich evoked no positive response.  Hence, this writ petition.\n<\/p>\n<p>\t3. Whereas the learned Additional Government Pleader would submit that at<br \/>\na particular point of time in the said Cooperative Bank, two officials  indulged<br \/>\nin malpractices; thereupon action has been taken and the Cooperative Bank is of<br \/>\nthe firm view that the petitioner&#8217;s husband did not deposit a sum of<br \/>\nRs.3,00,000\/- (Rupees three lakhs only), but he deposited only a sum of<br \/>\nRs.3,000\/- (Rupees three thousand only); but in collusion with those erring<br \/>\nofficials, the deceased managed to obtain such Fixed Deposit Cash Certificate.\n<\/p>\n<p>\t4. The learned Additional Government Pleader also would develop his<br \/>\narguments to the effect that no writ would lie and furthermore if at all the<br \/>\ndispute is between the member and the Cooperative Society, Section 90 of the<br \/>\nTamil Nadu Cooperative Societies Act could be invoked, but here the petitioner&#8217;s<br \/>\ndeceased husband is not even a member.\n<\/p>\n<p>\t5. In this factual matrix, I would like to observe that there are lot of<br \/>\nfactual controversies between the petitioner and the respondents.  Whether the<br \/>\npetitioner&#8217;s husband deposited a sum of Rs.3,00,000\/- (Rupees three lakhs only)<br \/>\nor Rs.3,000\/- (Rupees three thousand only) is a big question based on fact;<br \/>\nfurthermore, the respondents are not admitting that the officials received a sum<br \/>\nof Rs.3,00,000\/- (Rupees three lakhs only), but they failed to bring it on<br \/>\nrecord and misappropriated it.  It is the case of the respondents that the<br \/>\npetitioner&#8217;s husband did not deposit a sum of Rs.3,00,000\/- (Rupees three lakhs<br \/>\nonly) at all.  As such in this factual situation, this Court has to focus its<br \/>\nattention as to whether a writ petition based on such contractual disputes,<br \/>\nwould lie at all.  My mind is redolent and reminiscent with the decision of this<br \/>\nCourt in <a href=\"\/doc\/186075\/\">Marappan, K. v. The Deputy Registrar of Co-operative Societies,<br \/>\nNamakkal<\/a> reported in 2006(4)CTC 689.  An excerpt from it would run thus:\n<\/p>\n<p>\t&#8220;21. From the above discussion, the following propositions emerge:\n<\/p>\n<p>\t\t(i)If a particular co-operative society can be characterized as a<br \/>\n&#8216;State&#8217; within the meaning of Article 12 of the Constitution (applying the tests<br \/>\nevolved by the Supreme Court in that behalf), it would also be &#8216;an authority&#8217;<br \/>\nwithin the meaning and for the purpose of Article 226 of the Constitution.  In<br \/>\nsuch a situation, an order passed by a society in violation of the bye-laws can<br \/>\nbe corrected by way of Writ Petition;\n<\/p>\n<p>\t(ii) Applying the tests in Ajay Hasi it is held that a co-operative<br \/>\nsociety carrying on banking business cannot be termed as an instrumentality of<br \/>\nthe State within the meaning of Article 12 of the Constitution;\n<\/p>\n<p>\t(iii) Even if a society cannot be characterised as a &#8216;State&#8217; within the<br \/>\nmeaning of Article 12 of the Constitution, a Writ would lie against it to<br \/>\nenforce a statutory public duty case upon the society.  In such a case, it is<br \/>\nunnecessary to go into the question whether the society is being treated as a<br \/>\n&#8216;person&#8217; or &#8216;an authority&#8217; within the meaning of Article 226 of the Constitution<br \/>\nand what is material is the nature of the statutory duty placed upon it and the<br \/>\nCourt will enforce such statutory public duty.  Although it is not easy to<br \/>\ndefine what a public function or public duty is, it can reasonably said that<br \/>\nsuch functions are similar to or closely related to those performable by the<br \/>\nState in its sovereign capacity.\n<\/p>\n<p>\t(iv) A society, which is not a &#8216;State&#8217; would not normally be amenable to<br \/>\nthe writ jurisdiction under Article 226 of the Constitution, but in certain<br \/>\ncircumstances, a writ may issue to such private bodies or persons as there may<br \/>\nbe statutory provisions which need to be complied with by all concerned<br \/>\nincluding societies.  If they violate such statutory provisions a writ would be<br \/>\nissued for compliance of those provisions.\n<\/p>\n<p>\t(v) Where a Special Officer is appointed in respect of a co-operative<br \/>\nsociety which cannot be characterised as a &#8216;State&#8217; a writ would lie when the<br \/>\ncase falls under Clauses(iii) and (iv) above.\n<\/p>\n<p>\t(vi) The bye-laws made by a co-operative society registered under the<br \/>\nTamil Nadu Co-operative Societies Act, 1983 do not have the force of law.<br \/>\nHence, where a society cannot be characterised as a &#8216;State&#8217;, the service<br \/>\nconditions of its employees governed by its bye-laws cannot be enforced through<br \/>\na Writ Petition.\n<\/p>\n<p>\t(vii) In the absence of special circumstances, the Court will not<br \/>\nordinarily exercise power under Article 226 of the Constitution of India when<br \/>\nthe Act provides for an alternative remedy.\n<\/p>\n<p>\t(viii) The decision in M.Thanikkachalam v.Madhuranthagam Agricultural Co-<br \/>\noperative Society, 2000 (4) CTC 556, is no longer good law, in view of the<br \/>\ndecision of the Seven-Judge Bench of the Supreme Court in Pradeep Kumar Biswas<br \/>\ncase and the other decisions referred to herein before.\n<\/p>\n<p>\t6. It is therefore clear from the above excerpt that in this factual<br \/>\nmatrix, writ would not lie.  Hence, while dismissing this writ petition, I would<br \/>\nobserve that if at all the petitioner is having evidence that the deceased<br \/>\nAnburaj was a member and deposited a sum of Rs.3,00,000\/- (Rupees three lakhs<br \/>\nonly) in the Cooperative Bank, then certainly the dispute could be taken under<br \/>\nSection 81 of the Tamil Nadu Cooperative Societies Act and she could get<br \/>\nprocessed the dispute under the Tamil Nadu Cooperative Societies Act as<br \/>\notherwise she has to process her claim in the way known to the general law of<br \/>\nthe land.\n<\/p>\n<p>\t7. The learned counsel for the petitioner made an extempore submission to<br \/>\nthe effect that the petitioner might be given opportunity of getting a copy of<br \/>\nthe report under Section 81 of the Tamil Nadu Cooperative Societies Act and the<br \/>\nsurcharge proceedings, which the respondents initiated as against the erring<br \/>\nofficials.\n<\/p>\n<p>\t8. I could see considerable force in the submission made by the learned<br \/>\ncounsel for the petitioner and accordingly within a period of ten days from the<br \/>\ndate of receipt of a copy of this order,the fourth respondent shall issue a copy<br \/>\nof report under Section 81 of the Tamil Nadu Cooperative Societies Act initiated<br \/>\nand a copy of the surcharge proceedings and the result of it to the petitioner<br \/>\non her approaching the office during office hours, so as to enable her to take<br \/>\nfurther action in this matter.\n<\/p>\n<p>\t9. With the above directions and observations, this Writ Petition is<br \/>\ndismissed.
