      The prayer sought for in this writ petition is to direct the<\/p>\n
respondent to accept the completion report as regards the<\/p>\n
building constructed pursuant to Exts.P2 and P3 and to number<\/p>\n
the same.\n<\/p>\n
      2. It is stated that on the strength of Ext.R1(a) exemption<\/p>\n
order passed by the Government of Kerala exercising its powers<\/p>\n
under the Kerala Building Rules, 1994, on 23.10.1997 Ext.P2<\/p>\n
building permit was granted to the predecessor-in-interest of the<\/p>\n
petitioner.  Petitioner submits that on the strength of Ext.P2<\/p>\n
permit, a special residential building consisting of apartments,<\/p>\n
having a total plinth area of 28000 square feet                        was to be<\/p>\n
constructed and completed by 22.10.2000. It is stated that his<\/p>\n
predecessor could not complete the construction in all respects<\/p>\n
within the time allowed and therefore had sought extension of<\/p>\n
the time specified in the permit twice. The extensions sought for<\/p>\n
were granted and the extended period was upto 22.10.2006.<\/p>\n
Ext.P3 is the last order of            extension         and endorsements on<\/p>\n
WP(C) 12437\/08                   2<\/span><\/p>\n
Ext.P2 also show the extensions granted to the predecessor-in-<\/p>\n
interest of the petitioner.\n<\/p>\n
     3.    According to the petitioner, on the strength of Ext.P2<\/p>\n
and within the extended period, the entire civil work including<\/p>\n
plastering of the building was completed, and what remained to<\/p>\n
be done is fixing of Belgium glass on the front portion of the<\/p>\n
building.  Petitioner submits that in the meanwhile, on account<\/p>\n
of financial crisis, his   predecessor-in-interest had sold the<\/p>\n
property to the petitioner, in as is where is condition, with effect<\/p>\n
from 21.7.2006. According to the petitioner, on completion of<\/p>\n
the work as above, he applied to the Municipality for numbering<\/p>\n
the building and the Municipality replied stating that only if the<\/p>\n
permit is current, the building in question could be numbered.<\/p>\n
     4.     Thereupon, the petitioner had applied to the<\/p>\n
Municipality for extension of period of the building permit.     In<\/p>\n
the meanwhile, Kerala Municipality Building Rules 1984 were<\/p>\n
replaced by the Kerala Municipality Building Rules 1999.        The<\/p>\n
application made by the petitioner for extension was forwarded<\/p>\n
by the Municipality to the Government under the cover of Ext.P4<\/p>\n
dated 10.4.2007.     In this communication of the Municipality<\/p>\n
also it is mentioned that most the work in terms of the permit<\/p>\n

was already completed.        However, on receipt of Ext.P4, the<\/p>\n
Government replied by Ext.P5 stating that in terms of the 1999<\/p>\n
Rules, it was not practical to extend the period of the permit.<\/p>\n
On that basis the Municipality was directed to treat the<\/p>\n
petitioner’s application as one filed under the 1999 Rules and<\/p>\n
take action     as if it is a fresh application.  Accordingly, the<\/p>\n
Municipality considered the application of the petitioner as a<\/p>\n
fresh one in the light of the 1999 Rules, ignoring Ext.R1(a)<\/p>\n
exemption. On such examination the Municipality found several<\/p>\n
violations of the 1999 Rules and on that basis, by Ext.P6<\/p>\n
informed the petitioner         that his application cannot be<\/p>\n
considered. It is on receipt of Ext.P6 that this writ petition was<\/p>\n
filed by the petitioner seeking a direction to the Municipality to<\/p>\n
accept the completion report and number the building.<\/p>\n
      5. Learned counsel for the petitioner mainly contends that<\/p>\n
since even according to the Municipality, a substantial portion of<\/p>\n
the work was completed, the petitioner should be allowed to<\/p>\n
make use of the building as otherwise the building having 28000<\/p>\n
sq. ft. of plinth area cannot be made use of at all and will be a<\/p>\n
total waste of money and effort.     It is also his contention that<\/p>\n
Ext.P2 having been granted under the 1984 Rules, the extension<\/p>\n
WP(C) 12437\/08                   4<\/span><\/p>\n
sought for by him, should also be considered in the light of the<\/p>\n
said rule and not the 1999 Rules.\n<\/p>\n
      6. The Municipality on its part had filed a counter affidavit.<\/p>\n
According to the Municipality, on every respect the construction<\/p>\n
is in violation of the Rules. They would say that the very permit<\/p>\n
was granted on the strength of an order of exemption and that<\/p>\n
now as the petitioner’s application is to be considered in the light<\/p>\n
of the 1999 Rules, compliance with those Rules is an essential<\/p>\n
pre-requisite.      The Municipality, therefore, would submit that<\/p>\n
its stand that the application cannot be considered is legal and<\/p>\n
correct.\n<\/p>\n
      7. The contention of the petitioner that the entire civil<\/p>\n
works including plastering was completed before the expiry of<\/p>\n
the extended period of the permit is also denied by the<\/p>\n
Municipality.      The Municipality submits that the transfer in<\/p>\n
favour of the petitioner was not intimated to it either by the<\/p>\n
petitioner’s predecessor-in-interest or by the petitioner himself<\/p>\n
and that without any permit petitioner continued the work<\/p>\n
leading to the issue of stop memo and, on its disobedience, a<\/p>\n
police complaint as well.\n<\/p>\n
      8. From the facts noticed above it is evident that as at<\/p>\n

present, the building having a plinth area of 2800 sq. ft. has been<\/p>\n
completed either by the predecessor-in-interest or the petitioner<\/p>\n
himself on the strength of Ext.P2 building permit.    The fact that<\/p>\n
the construction was undertaken on the basis of Ext.P2 and was<\/p>\n
allowed to continue until 22.10.2006 on which date the extended<\/p>\n
period of the permit expired is also not disputed. It is also to be<\/p>\n
noticed that the Municipality has not initiated any coercive<\/p>\n
action against the structure constructed by the petitioner.      As<\/p>\n
already noticed, even according to the Municipality, a substantial<\/p>\n
portion of the work was completed as is mentioned by it in<\/p>\n
Ext.P4 letter issued on 10.4.2007. Now, therefore, a workable<\/p>\n
solution will have to be found out to make use of the building,<\/p>\n
permitting the petitioner to complete the remaining part of the<\/p>\n
work and make use of the same. I feel, the only option is to<\/p>\n
permit the petitioner to complete the work and accept the<\/p>\n
completion certificate and issue occupancy certificate on that<\/p>\n
basis after completing necessary formalities.<\/p>\n
      9.  Since, according to the petitioner, the building in<\/p>\n
question has been completed and what remains is only fixing of<\/p>\n
Belgium glasses, I feel the ends of justice require that the writ<\/p>\n
petition shall be disposed of with the following directions:-<\/p>\n

       i. The Respondent Municipality shall inspect the building<\/p>\n
       in question and ascertain as to whether the construction<\/p>\n
       undertaken is in compliance with Ext.P2 permit.<\/p>\n
       ii. If the construction undertaken by the petitioner thus<\/p>\n
       far is found to be in compliance with Ext.P2 permit, the<\/p>\n
       petitioner will be permitted to complete the remaining<\/p>\n
       works without in any manner departing from Ext.P2 or<\/p>\n
       increasing the built up area of the building in question.<\/p>\n
       iii. Once the remaining work is completed as above,<\/p>\n
       petitioner will submit the completion certificate to the<\/p>\n
       Municipality.\n<\/p><\/blockquote>\n
\n       iv. On receipt of the completion certificate as above, the<\/p>\n
       Municipality shall again inspect the building and after<\/p>\n
       completing     necessary   formalities,  issue   occupancy<\/p>\n
       certificate to the petitioner.\n<\/p><\/blockquote>\n
\n
       Writ petition is disposed of as above.<\/p><\/blockquote>\n
