APP for Opponent(s) :\n2, \n=========================================================\n\n\n \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\nDate\n: 09\/02\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.0<br \/>\nThe present appeal, under section 378 of the Code of Criminal<br \/>\nProcedure, 1973, is directed against the judgment and order of<br \/>\nacquittal dated 26.5.2010 passed by the learned Metropolitan<br \/>\nMagistrate, Court no. 8, Ahmedabad in Criminal  Case No. 11280\/2007,<br \/>\nwhereby the accused has been acquitted of the charges under sec. 7(1)<br \/>\n&amp; 16(1)(A)(I) of the Prevention of Food Adulteration Act,<br \/>\nleveled against him.\n<\/p>\n<p>2.0<br \/>\nThe brief facts of the prosecution case are as under:\n<\/p>\n<p>2.1<br \/>\nIt is the case of the prosecution that on 17.5.2007 the Food<br \/>\nInspector has visited the shop of respondents-accused, and has taken<br \/>\nthe sample of Milk. Thereafter, he purchased the same and paid the<br \/>\nprice, cash memo was taken and after following the necessary<br \/>\nprocedure,  the sample was sent to the Public Analyst, for analysis<br \/>\nand as per the report of the Public Analyst, the sample was found to<br \/>\nbe adulterated. On these facts, the complaint was filed before the<br \/>\nCourt, which was numbered as Criminal Case No. 11280\/2007 against the<br \/>\nrespondent. At the time of trial, evidence was led before the trial<br \/>\nCourt. The documents were produced  and oral evidence of the<br \/>\nwitnesses were also recorded by the trial Court and after considering<br \/>\nthe oral as well as documentary evidence, the learned Magistrate has<br \/>\npassed the order of acquittal which is impugned in this appeal.\n<\/p>\n<p>3.0<br \/>\nIt was contended by learned Advocate Mr. Soni for the appellant that<br \/>\nthe judgment and order of the learned Magistrate is not proper, legal<br \/>\nand it is erroneous. He has also argued that the learned Magistrate<br \/>\nhas not considered the evidence of the witnesses. He has argued that<br \/>\nFood Inspector has followed the rules prescribed by law and he has<br \/>\nalso followed the procedure of taking the sample and the contents of<br \/>\nForm No. 6 etc are just and proper. The sample was seized and sealed<br \/>\nproperly. Yet, the learned Magistrate has not considered the evidence<br \/>\nof prosecution. Therefore, the order impugned in this appeal passed<br \/>\nby the learned Magistrate requires to be quashed and set aside.\n<\/p>\n<p>4.<br \/>\n\tIt is a settled legal position that in acquittal appeal, the<br \/>\nAppellate Court is not required to re-write the judgment or to give<br \/>\nfresh reasonings when the Appellate Court is in agreement with the<br \/>\nreasons assigned by the trial court acquitting the accused.  In the<br \/>\ninstant case, this Court is in full agreement with the reasons given<br \/>\nand findings recorded by the trial Court while acquitting the<br \/>\nrespondents- accused and adopting the said reasons and for the<br \/>\nreasons aforesaid, in my view, the impugned judgment is just, legal<br \/>\nand proper and requires no interference by this Court at this stage.<br \/>\nHence, this appeal requires to be dismissed.\n<\/p>\n<p>5.<br \/>\nEven in a recent decision of the Apex Court in the case of <a href=\"\/doc\/585040\/\">State<br \/>\nof Goa V. Sanjay Thakran &amp; Anr. Reported<\/a> in (2007)3 SCC 75,<br \/>\nthe Court has reiterated the powers of the High Court in such cases.<br \/>\nIn para 16 of the said decision the Court has observed as under:\n<\/p>\n<p> 16.<br \/>\nFrom the aforesaid decisions, it is apparent that while exercising<br \/>\nthe powers in appeal against the order of acquittal the Court of<br \/>\nappeal would not ordinarily interfere<br \/>\nwith the order of acquittal unless the approach of<br \/>\nthe lower Court is vitiated by some manifest illegality and the<br \/>\nconclusion arrived at would not be arrived at by any<br \/>\nreasonable person and, therefore, the decision is to be<br \/>\ncharacterized as perverse. Merely because two views are possible, the<br \/>\nCourt of appeal would not take the view which would upset the<br \/>\njudgment delivered by the Court below. However, the appellate court<br \/>\nhas a power to review the evidence if it is of the view that the<br \/>\nconclusion arrived<br \/>\nat by the Court below is perverse and the Court has committed a<br \/>\nmanifest error of law and ignored the material evidence on<br \/>\nrecord. A duty is cast upon the appellate court, in such<br \/>\ncircumstances, to re-appreciate the evidence to arrive to a just<br \/>\ndecision on the basis of material placed on record to find out<br \/>\nwhether any of the accused is connected with the commission of the<br \/>\ncrime he is charged with.\n<\/p>\n<p>6.<br \/>\nSimilar principle has been laid down by the Apex Court in the cases<br \/>\nof State<br \/>\nof Uttar Pradesh Vs. Ram Veer Singh &amp; Ors, reported in 2007 AIR<br \/>\nSCW 5553 and<br \/>\nin Girja<br \/>\nPrasad (Dead) by LRs Vs. state of MP, reported in 2007 AIR SCW 5589.<br \/>\nThus, the powers which this Court may exercise against an order of<br \/>\nacquittal are well settled.\n<\/p>\n<p>7.<br \/>\nIt is also a settled legal position that in acquittal appeal, the<br \/>\nappellate court is not required to re-write the judgment or to give<br \/>\nfresh reasonings, when the reasons assigned by the Court below are<br \/>\nfound to be just and proper. Such principle is laid down by the Apex<br \/>\nCourt in the case of State<br \/>\nof Karnataka Vs. Hemareddy, reported in AIR 1981 SC 1417,<br \/>\nwherein,<br \/>\nit is held as under:\n<\/p>\n<p> &amp;<br \/>\nThis court<br \/>\nhas observed in Girija<br \/>\nNandini Devi V. Bigendra Nandini Chaudhary (1967)1 SCR 93: (AIR 1967<br \/>\nSC 1124) that<br \/>\nit is not the duty of the appellate court<br \/>\nwhen it agrees with the view of the trial court on the evidence to<br \/>\nrepeat the narration of the evidence or to<br \/>\nreiterate the reasons given by the trial court expression<br \/>\nof general agreement with the reasons given by the Court the decision<br \/>\nof which is under appeal, will ordinarily suffice.\n<\/p>\n<p>8.\tThus,<br \/>\nin case the appellate court agrees with the reasons and the opinion<br \/>\ngiven by the lower court, then the discussion of evidence is not<br \/>\nnecessary.\n<\/p>\n<p>9.\tI<br \/>\nhave gone through the judgment and order passed by the trial court. I<br \/>\nhave also perused the oral as well as documentary evidence led by the<br \/>\ntrial court and also considered the submissions made by learned<br \/>\nAdvocate for the appellant. The trial court while considering the<br \/>\noral as well as documentary evidence has clearly observed that the<br \/>\nprosecution has not followed the mandatory provisions during the<br \/>\nsealing and seizing the sample. The prosecution has failed to prove<br \/>\nits case beyond reasonable doubt.  Even in the present appeal,<br \/>\nnothing is produced or pointed out to rebut the conclusion of the<br \/>\ntrial Court.  Thus, from the evidence itself it is established that<br \/>\nthe prosecution has not proved its case beyond reasonable doubt.\n<\/p>\n<p>10.\tMr<br \/>\n Soni learned Advocate  for the appellant is not in a position to<br \/>\nshow any evidence to take a contrary view of the matter or that the<br \/>\napproach of the trial court is vitiated by some manifest illegality<br \/>\nor that the decision is perverse or that the trial court has ignored<br \/>\nthe material evidence on record.\n<\/p>\n<p>11.<br \/>\nIn the above view of the matter, I am of the considered opinion that<br \/>\nthe trial court was completely justified in acquitting the respondent<br \/>\nof the charges leveled against him.\n<\/p>\n<p>12.<br \/>\nI find that the findings recorded by the trial court are absolutely<br \/>\njust and proper and in recording the said findings, no illegality or<br \/>\ninfirmity has been committed by it.\n<\/p>\n<p>13.\tI<br \/>\nam, therefore, in complete agreement with the findings, ultimate<br \/>\nconclusion and the resultant order of acquittal recorded by the court<br \/>\nbelow and hence find no reasons to interfere with the same. Hence the<br \/>\nappeal is hereby dismissed. R &amp; P to be sent back to the trial<br \/>\nCourt, forthwith.
