LAND ACQUISITION OFFICER &amp; 1 -\nPetitioner(s)\n \n\nVersus\n \n\nRUDIBEN\nJIVABHAI &amp; 1 - Respondent(s)\n \n\n=============================================================\n \nAppearance : \nMS\nMANISHA NARSINGHANI, AGP for\nthe Applicants \nMR AMIN for the Respondents\n \n=============================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE JAYANT PATEL\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE BANKIM.N.MEHTA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 16\/08\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE JAYANT PATEL)<\/p>\n<p>1.\tRule.\n<\/p>\n<p> Mr. Amin, learned counsel appears for the opponents   original<br \/>\nclaimants, as is appearing in the respective first appeals also and<br \/>\nwaives Notice of Rule.\n<\/p>\n<p>2.\tAll<br \/>\nthe applications are for interim injunction pending the respective<br \/>\nfirst appeals, which have been admitted by this Court and are<br \/>\nawaiting final hearing.\n<\/p>\n<p>3.\tConsidering<br \/>\nthe facts and circumstances, there shall be interim injunction<br \/>\nagainst execution and implementation of the award passed by the<br \/>\nReference Court, which is impugned in the respective first appeals,<br \/>\non condition that the applicant   appellant deposits the entire<br \/>\nawarded amount as per the order of the Reference Court within period<br \/>\nof eight weeks from today.\n<\/p>\n<p>4.\tWe<br \/>\nhave heard the learned counsel appearing for the parties for<br \/>\nwithdrawal.\n<\/p>\n<p>5.\tConsidering<br \/>\nthe facts and circumstances, out of the amount which may be deposited<br \/>\nby the applicant as per the above referred order, the opponents<br \/>\noriginal claimants shall be entitled to withdraw 50% of the amount<br \/>\nand the remaining 50% of the amount shall be invested by the<br \/>\nReference Court with the Nationalized Bank, initially for a period of<br \/>\nthree years and such investment shall be renewable from time to time<br \/>\nuntil the appeals are finally disposed of.  The FDR shall be drawn on<br \/>\nthe name of Nazir of the concerned Court.  The applications allowed<br \/>\nto the aforesaid extent.
