No.21866\/2008-C\n              ~~~~~~~~~~~~~~~~~~~~~~~~~~~\n         Dated this the 10th day of December, 2010\n\n                    J U D G M E N T\n<\/pre>\n<p>    The petitioner is the purchaser of a contract<\/p>\n<p>carriage  vehicle   No.KL-7-AJ-6242    from   one   Tibo<\/p>\n<p>Kuruvila.  When he approached the first respondent for<\/p>\n<p>endorsing the transfer, he was directed to pay Motor<\/p>\n<p>Transport  Workers  Welfare  Fund  from   01\/01\/2008  to<\/p>\n<p>31\/03\/2008 which, according to the petitioner, is not<\/p>\n<p>liable to be paid by him.      Aggrieved by the demand<\/p>\n<p>raised  for  payment  of   tax   for  the  period   from<\/p>\n<p>01\/04\/2008 to 30\/06\/2008 as well as Welfare Fund dues,<\/p>\n<p>this writ petition has been filed.      This Court had<\/p>\n<p>passed an interim order as sought for on 24\/07\/2008.<\/p>\n<p>    2.   Heard the learned Government Pleader appearing<\/p>\n<p>for the first respondent and the learned counsel for<\/p>\n<p>the second respondent.    The learned counsel for the<\/p>\n<p>second respondent submitted that the vehicle has not<\/p>\n<p>been  registered  with  the  RTO  in   Kannur  District.<\/p>\n<p>Therefore, it is not clear whether the vehicle is<\/p>\n<p>plying in Thiruvalla as of now.    In the light of the<\/p>\n<p>above facts, the competent authority of the concerned<\/p>\n<p>W.P.(C). No.21866\/2008<br \/>\n<span class=\"hidden_text\">                        -:2:-<\/span><\/p>\n<p>district will be free to take action for recovery of<\/p>\n<p>any arrears of tax.    If the petitioner disputes any<\/p>\n<p>liability,  that  objection will   be  adjudicated  in<\/p>\n<p>accordance with law.  The writ petition is accordingly<\/p>\n<p>disposed of.
