In the facts and circumstances of the<br \/>\ncase and with the consent of learned advocates appearing for<br \/>\nrespective parties, application is taken up for final hearing today.\n<\/p>\n<p>2.\tPresent<br \/>\napplication has been preferred by the applicant herein &#8211;<br \/>\nappellant &#8211; original opponent No.2 National Insurance Company<br \/>\nLimited for interim relief to stay further execution, implementation<br \/>\nand operation of the impugned judgment and award dated 29.04.2010<br \/>\npassed by the learned Motor Accident Claims Tribunal (Auxi.), 2nd<br \/>\nFast Track Court, Anand in M.A.C.P. No.332\/2007, during the pendency<br \/>\nand final disposal of the main First Appeal.\n<\/p>\n<p>3.\tThough<br \/>\nserved, nobody appears on behalf of respondent No.1 &#8211; original<br \/>\nclaimant.\n<\/p>\n<p>4.\tHaving<br \/>\nheard Shri Mehul S. Shah, learned advocate appearing on behalf of the<br \/>\nappellant and Shri Vishal Mehta, learned advocate appearing on behalf<br \/>\nof respondent No.2 and considering the defence raised by the<br \/>\napplicant herein &#8211; original appellant, Ad-interim relief<br \/>\ngranted earlier is directed to<br \/>\nbe continued as INTERIM RELIEF<br \/>\ntill final disposal of the main First Appeal No.2833\/2010.  It is<br \/>\nreported that pursuant to the ad-interim order passed by this Court<br \/>\ndated 23.09.2010, the applicant has deposited the entire amount<br \/>\nbefore the Tribunal.  Hence, Tribunal is directed to invest entire<br \/>\namount deposited by the applicant in the name of Nazir in fixed<br \/>\ndeposit in any Nationalized Bank initially for a period of five years<br \/>\nand continue to renew the same from time to time.  However, claimant<br \/>\nshall be entitled to withdraw the periodical interest on the same,<br \/>\nhowever, the same shall be without prejudice to the rights and<br \/>\ncontentions of respective parties in the First Appeal subject to<br \/>\nultimate outcome of main First Appeal.  Rule is made absolute to the<br \/>\naforesaid extent.
