JUSTICE H.R.PANWAR\n\n\nMr. P.P.Choudhary for the petitioners.\nMr. S.M.Toshniwal for the respondents.\n\n\nBY THE COURT<\/pre>\n<p>           Heard learned counsel for the parties.\n<\/p>\n<p>           Learned counsel for the petitioners submits that the<\/p>\n<p>petitioners at this stage do not press the other prayers except<\/p>\n<p>the prayer No.1 wherein the petitioners have prayed that the<\/p>\n<p>respondents may kindly be directed for imparting teachers&#8217;<\/p>\n<p>training to the petitioners also in accordance with order issued<\/p>\n<p>by the State Government on 27.04.2002.\n<\/p>\n<p>           According to the learned counsel for the petitioners,<\/p>\n<p>looking to the number of years services put in by the petitioners,<\/p>\n<p>they ought to have been allowed to continue on the        post of<\/p>\n<p>Para-Teachers and be sent for teachers&#8217; training on the basis of<\/p>\n<p>the order of the State Government for imparting teachers&#8217;<br \/>\n<span class=\"hidden_text\">                                       2<\/span><\/p>\n<p>training to the Para-Teachers by order dated 27.04.2002.<\/p>\n<p>According     to    the    learned   counsel    for    the   petitioners    in<\/p>\n<p>compliance of the order of the State Govt. dated 27.04.2002<\/p>\n<p>various persons serving as Para-Teachers and who are untrained<\/p>\n<p>have been sent for teachers&#8217; training by the State Government.<\/p>\n<p>             Learned       counsel    appearing    for   the   respondents<\/p>\n<p>submits that a merit has been prepared for sending the Para-<\/p>\n<p>Teachers for training and the petitioners would also be sent for<\/p>\n<p>training on their own turn.\n<\/p>\n<p>             By      order       Annex.P\/7     dated     27.04.2002,       the<\/p>\n<p>respondent State decided that the Para-Teachers who are<\/p>\n<p>untrained and working as Teachers in Rajeev Gandhi Swarn<\/p>\n<p>Jayanti     Pathashala       be    provided    BSTC      training   through<\/p>\n<p>correspondence course for the years 2002-2004 and accordingly<\/p>\n<p>sanction was accorded on the terms and conditions mentioned in<\/p>\n<p>the order Annex.P\/7. Thus, it has not been disputed by the<\/p>\n<p>respondent State that the Para-Teachers who are untrained and<\/p>\n<p>serving with the respondent State under the Rajeev Gandhi<\/p>\n<p>Swarn Jayanti Pathashala Scheme in various schools and are<\/p>\n<p>untrained     have        been    provided     BSTC      training   through<\/p>\n<p>correspondence course and the fact that the petitioners herein<\/p>\n<p>are untrained teachers and are serving as Para-Teachers in the<\/p>\n<p>Schools     under    the Scheme Rajeev            Gandhi Swarn      Jayanti<\/p>\n<p>Pathashala and therefore, they deserve the similar treatment<br \/>\n<span class=\"hidden_text\">                                      3<\/span><\/p>\n<p>     which has been given to other untrained teachers by imparting<\/p>\n<p>     the training of BSTC through correspondence.<\/p>\n<p>                  In this view of the matter, the respondents are<\/p>\n<p>     directed to send the petitioners also for BSTC training on their<\/p>\n<p>     own turn on the terms and conditions mentioned in the order<\/p>\n<p>     Annex.P\/7.\n<\/p>\n<p>                  The writ petition is allowed to the extent above.
