Public Prosecutor waives service of<br \/>\n\tnotice of rule on behalf of the respondent &#8211; State of Gujarat.\n<\/p>\n<p>2.\tHaving<br \/>\n\tregard to the facts of the case, the application is taken up for<br \/>\n\thearing today.\n<\/p>\n<p>3.\tThe<br \/>\n\tapplicant &#8211; convict prisoner, who, by judgment and order dated<br \/>\n\t29.10.2009 rendered in Sessions Case No.155 of 2006 by the learned<br \/>\n\tSessions Court,<br \/>\n\tPalanpur, has been convicted for the offence<br \/>\n\tpunishable under Sections 302 and 323 of the Indian Penal Code and<br \/>\n\tsentenced to imprisonment of life, has filed this application<br \/>\n\tthrough jail authority, praying to enlarge him on temporary bail for<br \/>\n\ta period of 30 days, to enable him to attend the after death<br \/>\n\tceremony of his maternal grand father, who has died on 12.12.2010.\n<\/p>\n<p>4.\tWe<br \/>\n\thave gone through the application and the supporting documents that<br \/>\n\tform part of the application and have considered the submissions<br \/>\n\tadvanced by Mr. LB Dabhi, learned Public Prosecutor for the<br \/>\n\trespondent &#8211; State of Gujarat.  We have also gone through the<br \/>\n\tjail remarks sheet forwarded by the jail authority.\n<\/p>\n<p>5.\tUpon<br \/>\n\tperusal of the jail remarks sheet, we have noticed that the<br \/>\n\tapplicant has undergone total period of 1 years 4 months and 26 days<br \/>\n\timprisonment as against the imprisonment for life awarded to him.<br \/>\n\tThat apart, ground stated by the applicant to attend the after death<br \/>\n\tceremony of his maternal grand father cannot be considered for<br \/>\n\tenlarging him on temporary bail.\n<\/p>\n<p>6.\tIn<br \/>\n\tview of this, we are not inclined to grant temporary bail in favour<br \/>\n\tof the applicant.\n<\/p>\n<p>7.\tFor<br \/>\n\tthe foregoing reasons, the application fails and it is accordingly<br \/>\n\trejected.
