By the judgment aforesaid learned appellate\n\ntribunal      affirmed    the      judgment           and   decree      dated\n\n28.3.2006 passed by learned Rent Tribunal, Bhilwara.\nThe    rent    tribunal    while           accepting     the    application\n\npreferred by respondent Balu Ram for eviction of the\n\npremises      and    recovery     of        rent    found    his     bonafide\n\nnecessity genuine.\n\n\n\n       Learned appellate tribunal accepted the finding\n\nand    also    reached    at    the        conclusion       that     adequate\n\nalternative premises is available with the tenant to\n\nshift his business. Learned appellate tribunal                           also\n\ndealt with the argument advanced at the instance of\n\nthe tenant petitioner that other appropriate place is\n\navailable with the landlord to start business for his\n                                      2\n\nson and held that the choice of place for business is\n\nwithin the domain of the landlord, the will of any\n\nother person cannot be imposed upon him.\n\n\n\n               In this petition for writ, it is urged that\n\nthe tribunals below erred while examining the issue\n\nrelating        to     bonafide      necessity            and    also      the\n\ncomparative hardship. As per learned counsel for the\n\npetitioner       the    adopted   son         of    the    petitioner       is\n\nalready working with his father and, therefore, the\n\nentire issue of bonafide necessity is concocted one\n\nonly with a view to get the premises evicted. It is\n\nalso urged that some other shops are available with\n\nthe landlord and by utilising those he can expand his\n\nbusiness.\n\n\n\n               On examination of record I found that the\n\nconcurrent      findings     given       by   the    courts      below     are\n\nbased on sound appreciation of evidence. The adopted\n\nson   of the         petitioner is       in   his    ripe age        and   the\n\nrequirement of his separate business is quite obvious,\n\nand for that the need of premises has been rightly\n\nfound bonafide one. It is also pertinent to note that\n\nthe courts below on basis of the admission made by the\n\npetitioner himself reached at the conclusion                         that he\n\nis    having    adequate    alternative premises                in   his   own\n\nbuilding and as such no hardship will be caused on his\n\neviction from the rented premises.
